Adjourn • • GROUP: ADVERTISING & PROMOTION COMMISSION DATE: March 12, 2001 PRESENT: Bob Davis, Joe Fennel, John Gilliam, Alex Jerde, Ching Mong, Curtis Shipley, Kevin Santos, John Maguire, Kit Williams, Denise Bembenek, and Marilyn Johnson. ABSENT : None The regular meeting of the Advertising and Promotion Commission was called to order at the Chamber of Commerce conference room at 2: 10 p.m. by Chairman Joe Fennel. MINUTES Moved by Shipley, second by Jerde to approve the minutes of the February 12 meeting. Motion carried. FINANCIAL REPORT John Maguire presented the financial report for February. Collections for the month were up 4. 91 % with total collections of $95,810. Year to date collections totaled $ 194,207, a 1 .33% increase. February expenses were $7,916, with largest expenditure the quarterly payment to the Arkansas Air Museum. • CONVENTION AND VISITOR DEVELOPMENT REPORT Marilyn Johnson introduced Denise Bembenek as Sales Manager for the Town Center. Denise briefed the Commission on her background. Marilyn reviewed her activities that were distributed in Agenda packet. In addition, she has been contacted to join a coalition of SEC Convention and Visitor Bureau's for the purpose of not only sporting events but also convention and meeting cooperation. The Big 12 presently has a successful coalition in operation. BLACKWOOD/MARTIN/CJRW REPORT Susan Wallace reported that the initial inquiries from advertising were more than those received last year. The Dining and Lodging Guide was scheduled for delivery today. The Running/Walking Trail Guide will be delivered on the 26`s. Town Center collateral material were sent to the printer. The new Booth will be ready at the next A & P meeting. Old Business TOWN CENTER Richard Alderman told the Commission that work on the lower levels was finished. They are close to stabilizing the tower with brick and putting up the remaining section. The roof over the lobby space will be done when the tower is in place. We are well on to our • July 4 completion date. • Moved by Shipley, second by Santos to authorize WDD to write specs for sprinkler system and parking system for a fee not to exceed $ 1 ,000. A hard hat tour will be conducted after the Commission meeting. DRAFT HMR ORDINANCE The HMR draft ordinance was divided into two sections 1 ) one with penalties and enforcement; and 2) broadening the tax to include off premise consumption places. The parks HMR tax has been added. There is some sentiment among the City Council that they wish grocery store delis removed from the list. City Attorney Kit Williams is researching the issue of can they pick and choose which businesses to include. The penalty and enforcement ordinances are on the agenda for March 20. CONTRACT WITH THE ADVERTISING AGENCY Moved by Shipley, second by Jerde to extend the contract with Blackwood Martin for six months. Motion carried. A RFP will be issued in October to give other agencies a chance to bid on our account. New Business APPOINTMENT OF COMMISSIONERS Moved by Jerde, second by Gilliam that Ching Mong and Curtis Shipley be appointed to • fill vacancies on the A & P Commission. Motion carried with Shipley abstaining. HOG WILD PRE-GAME ACTIVITIES Commissioners requested that Marilyn come with recommendation of what' s planned and how much funding will be required. SERV SAFE FOOD AND SAFETY Rick Johnson and Melissa Wannacot discussed this program for food service managers. The course is an 8-hour course and costs $85 per person. It gives managers the basics of food safety knowledge in order to train those they supervise. Graduates get certification upon completion of the course. Joe Fennel recommended that the A & P Commission give an incentive for restaurants to send their managers. He recommended that the A & P Commission buy the book ($45) and the restaurant pay $40 to send the manager to the training. Tentative dates for the first course are May 6-9. A scholarship opportunity was discussed offered on a first come- first serve basis. Joe recommended that the Commission support with 150 scholarships and joint promotion efforts. John Gilliam suggested pursuing regulation of people who serve at the Town Center have l person trained in ServSafe or its equivalent. • Shipley recommended a limit of 25 scholarships and money for promotion. Marilyn will come with a recommendation at the April meeting. • There being no further business, the meeting was adjourned. WHEREAS, the City wishes to allow for the examination of taxpayer records and investigations to assist in the fair and accurate collection of the Hotel, Motel and Restaurant tax (hereinafter HMR tax) and; WHEREAS, provisions are needed for penalties against those who fail to comply with the HMR tax ordinance and; WHEREAS, the City believes that promulgating rules and regulations in administering the HMR tax will be beneficial in fairly and accurately interpreting the provisions of the HMR tax. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CITY OF FAYETTEVILLE, ARKANSAS: C;Prtlnn 1 . That §35.25 of the Code of Fayetteville is hereby added as follows: §35.25 Penalties and Enforcement. The City may assess penalties and interest against taxpayers who fail to timely report or pay the tax. The penalty shall be equal to five percent (5 %) of the unpaid tax amount per month not to exceed a total assessment of thirty-five percent (35%) of the unpaid tax. Simple interest on unpaid taxes shall be assessed at the rate of ten percent (10%) per annum. In addition, the City may exercise all powers listed under A.C.A.§26-75- 603 (c) as may be amended from time to time and may utilize the provisions of A.C.A. §26-75-603 (d) and (e) as may be amended from time to time in enforcing the tax. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That §35.20 of the Code of Fayetteville, Tax, Levy of Tax, is hereby repealed and the following inserted in its stead: • §35.20 Levy of Tax. There is hereby levied, a tax of 1 % (the tax) upon the gross receipts or gross proceeds from the renting, leasing, or otherwise furnishing of hotel or motel accommodations for profit in the City and upon the portion of the gross receipts or gross proceeds received by restaurants, cafes, cafeterias, delis, drive-in restaurants, carry-out restaurants, concessions stands, convenience stores, grocery store-restaurants, caterers and similar businesses as may be defined from time to time by ordinance from the sale of prepared food and beverages for on or off-premises consumption, but such tax shall not apply to such gross receipts or gross proceeds of organizations qualified under section §50(c) (3) of the federal Internal Revenue Code. Section 2. That §35.28 is hereby added as follows: §35.28. Definitions {pursuant to A.C.A. §26-75-602 (c) (2)) A. Delis - Delis shall include establishments selling sandwiches and salads, but this tax shall NOT apply to sliced meat and/ or cheese sold by the pound. • B. Concession Stands - Stands run by non-profit groups are excluded from this taxation. C. Convenience Stores - All food and beverages prepared on site (except coffee) are taxable. D. Caterers - Caterers are for profit businesses or persons who deliver or serve catered food or beverages at a location within the city limits of Fayetteville. E. Bakeries, Donut Shops & Ice Cream Shops - These are included within the definitions of "similar businesses' of this ordinance and are, therefore, subject to this tax. F. Beverage Shops — Businesses that sell beverages prepared or dispensed at their business are included within the definition of "similar businesses" of this ordinance and are therefore subject to this tax. G. Prepared Food or Beverage - Any food or beverage product prepared or altered in a food/beverage establishment for sale. • • PROPOSED RULES AND REGULATIONS HOTEL, MOTEL, RESTAURANT TAX (BOTH HMR and PARKS HMR TAXES) These rules and regulations for collection of the HMR tax shall apply to businesses engaged in the sale of prepared food and beverages for on or off- premises consumption. Prepared food and beverages shall be defined as any food product or beverage prepared or altered in a food service establishment for sale. Health department inspections will be obtained on a monthly basis to determine that new businesses are approved to open as a food service establishment. A new food service establishment shall be sent: A) Cover letter from tax collector • B) Hotel/motel and restaurant gross receipts tax report form C) Authorization for release of tax and franchise report information D) Hotel/ Motel/ Restaurant data sheet At the end of each month, after balancing collections with General Ledger accounts, tax collector shall: Analyze listing of payments received for the year to determine which establishments are delinquent. Send letters to all establishments that are two months delinquent in HMR remittances. Send letters to all establishments that are three months or more delinquent in their HMR. Prepare a list of all establishments that are four months or more delinquent. Indicate on the list if the delinquent establishment also has an alcoholic beverage permit. If an establishment has a private club or an on- premises consumption permit, also indicate if they are delinquent in their • supplemental beverage tax payments. • Send notice advising establishment of the date delinquent taxes must be paid to avoid formal collection efforts. For establishments that do not have an alcoholic beverage permit, contact the Prosecuting Attorney or City Attorney about filing charges or suit. For establishments that have an Alcoholic Beverage permit, contact the Prosecuting Attorney, Alcoholic Beverage Control or Fayetteville City Attorney to request their assistance. • • Watch your wallets;.
