Adjourn • • GROUP : ADVERTISING & PROMOTION COMMISSION DATE: January 8, 2001 PRESENT: Bob Davis, Joe Fennel, John Gilliam, Alex Jerde, Ching Mong, Curtis Shipley, Kevin Santos, John Maguire, Lisa Lee and Marilyn Johnson. ABSENT: None The regular meeting of the Advertising and Promotion Commission was called to order at the Chamber of Commerce conference room at 2:00 p.m. by Chairman Joe Fennel. MINUTES Moved by Shipley, second by Mong to approve the minutes of the December 11 meeting. Motion carried. FINANCIAL REPORT John Maguire presented the financial report for December. Collections for the month were up 1 .23% with total collections at $97,771 . Total collections for the year were $ 1 ,254,310. December expenses were $56,213 and year end expenses totaled $661 ,834. CONVENTION AND VISITOR DEVELOPMENT REPORT • Responses to inquiries were up in December because of inquiries received from Travel Marketing Group from spring and fall issues. FAM Tour with Kincaid of Oklahoma was a success. Forty four group tour leaders participated in the tour. The Town Center Topping Off ceremony was held in December. Lights of the Ozarks festival was not as successful with the bad weather encountered the last two weeks of December. BLACKWOOD/MARTIN/CJRW REPORT Susan Wallace reported that the agency was competing work of placement of spring ads. The agency met with Joe Fennel and Wade Colwell regarding the trails in the Running and Walking brochure. 01dBusiness TOWN CENTER Richard Alderman told the Commission that the Town Center had lost three weeks during the ice in December. There are no major issues on the project. DRAFT I-MIR ORDINANCE Joe Fennel, Marilyn, John Maguire, Steve Davis, Jerry Rose, LaGayle McCarty, Emma Badgley, and Marsha Farthing met to discuss the ordinance. Consensus was that the whole issue is one of competitive fairness. The following were issues of concern: 1) define food or businesses, 2) stronger emphasis on collections, and definition of delinquent taxpayers. Marilyn will present new ordinance to Ordinance Review • Committee. • New Business BUDGET ROLLFORWARDS FOR 2001 Moved by Shipley, second by Jerde to approve budget rollforwards from 2000 Budget to 2001 Budget. Motion carried TURNBACK FUNDS Marilyn reported that there was a move by Jodie Mahoney to end turnback funds for those who had not applied by June 2000. The Town Center would be affected by this. Marilyn will discuss with our legislators to determine why the Town Center was approved two years ago and not in current bill. There being no further business, the meeting was adjourned. The term includes wholesale and retail food stores, convenience stores, food markets, delicatessens, restaurants, catering kitchens, commissaries, food processing or manufacturing plants, bottling and canning plants, wholesale and retail block and prepackaged ice manufacturing plants and food warehouses. Exempt are nonprofit organizations that sell food on a temporary basis for fund-raising events. Seasonal operation — means an establishment operating on a seasonal basis not to exceed a 150 day period of time per calendar year, limited to the serving of dispensed drinks, coffee, snow cones, shaved ice, and other similar ice based products. • Temporary food service establishment - means a food service establishment that operates at a fixed location for a period of time not more than 14 consecutive days in conjunction with a single event or celebration. RULES AND REGULATIONS These rules and regulations for collection of the HMR tax shall apply to facilities (delis, drive-in restaurants, carry-out restaurants, concession stands, convenience stores, grocery store-restaurants, caterers, and similar businesses) engaged in the sale of prepared food and beverages for on or off-premises consumption. Prepared food and beverages shall be defined as any food product prepared or altered in a food service establishment (defined as facilities - above) for sale to the general public. Health department inspections will be obtained on a monthly basis to determine new facilities that are approved to open as a food service establishment. A new food service establishment is sent: A) Cover letter from tax collector B) Hotel/motel and restaurant gross receipts tax report C) Authorization for release of tax information D) Hotel/Motel/Restaurant data sheet • At the end of the month, after balancing collections with General Ledger accounts: • Analyze, listing of payments received for the year to determine which establishments are delinquent Send letters to all establishments that are two months delinquent in HMR remittances. Send letters to all establishments that are three months or more delinquent in their HMR Prepare a list of all establishments that are four months or more delinquent. Indicate on the list if the delinquent establishment also has an alcoholic beverage permit. If an establishment has a private club or an on-premises consumption permit, also indicate if they are delinquent in their supplemental beverage tax payments.
