1 . Trolley Operations Report
• GROUP: ADVERTISING & PROMOTION COMMISSION
DATE: November 13 , 2000
PRESENT: Heather Daniel, Joe Fennel, John Gilliam, Alex Jerde, Curtis Shipley,
Steven Davis, Lisa Lee and Marilyn Johnson
ABSENT: Fred Hanna and Ching Mong
The regular meeting of the Advertising and Promotion Commission was called to order at
the Chamber of Commerce conference room at 2: 00 p.m. by Chairman Joe Fennel.
MINUTES
Moved by Shipley, second by Jerde to approve the minutes of the October 9 meeting.
Motion carried.
FINANCIAL REPORT
The financial reports for September showed collections were $ 105,820, a 10.43%
increase. Year to date collections are $ 1 ,039,433, a 7. 83% increase over last year' s
collections year to date. Expenses for the month of October were $7,865 . Moved to
approve by Shipley, second by Daniel. Motion carried.
• CONVENTION AND VISITOR DEVELOPMENT REPORT
Marilyn Johnson reviewed August activity of her office. Inquiries year-to-date continue
to surpass inquiries for last year. Activities in all areas (bus tours, conventions/meetings,
tourist activities, working with other groups) have increased. Bus tours are coming from
Kansas, Little Rock, and Oklahoma. Future groups of note were the All-Star Festival and
the Foretravel R. V. Rally. Marilyn showed the book by Bonnie Ramsey, Most Beautiful
Villages and Towns of the South, which includes Fayetteville
ADVERTISING AGENCY REPORT
Mark Blackwood presented the agency report. The agency will present 2001 media
recommendations to the Commission in December. They are proceeding with the hogging
brochure.
OLD BUSINESS
Town Center
Progress on Project
Richard Alderman reported that the contractor had finished the concrete levels of the
Town Center and was starting on the exhibit hall. The contractor was slowed because of
weather.

• Naming the Rooms
Moved by Jerde, second by Gilliam to approve naming Town Center rooms as follows:
Razorback Room — all three sections ( 120 x 120)
Ozark Room — (66 x 120)
Dogwood Room - (52 x 62)
Mockingbird Room — (33 x 48)
Director' s Room — (22 x 17)
Diamond Room — ( 16 x 13)
Motion carried.
Topping Out Ceremony
Topping out ceremony is tentatively scheduled for November 30 pending meeting with
contractor to insure that progress will lend itself to that date.
Logo for Town Center
Commissioners reviewed logos, provided input and will be presented more choices.
Draft Ordinance revising HMR collections
Shipley moved to table until more information is received. Motion carried.
Joe Fennel asked the city to research ways to collect the HMR tax from those restaurants
• behind in paying the HMR taxes that they had collected. Marilyn will work with Steve to
look into ways of tightening the process. Steve will investigate state collection of the tax.

FAYETTEVILLE (ORDINANCE NO 2310, AS AMENDED),
TRANSIENT OCCUPANCY TAX, LEVY OF TAX TO ADD
DELIS , DRIVE-IN RESTAURANTS , CARRY-OUT
RESTAURANTS, CONCESSION STANDS, CONVENIENCE
STORES, GROCERY STORE RESTAURANTS AND SIMILAR
BUSINESSES TO THE LIST OF BUSINESSES TO WHICH THE
CITY'S GROSS RECEIPT TAX OF 1 % (HOTEL, MOTEL AND
RESTAURANT TAX) APPLIES (A.C.A.§26-75-601 ET SEQ);
ADDING OFF-PREMISES CONSUMPTION BUSINESSES,TO ::
THE LIST OF BUSINESSES SO TAXED AND ;EXCLUDING
FROM TAXATION GROSS RECEIPTS OR GROSS PROCEEDS
OF ORGANIZATIONS QUALIFIED UNDER §501 (c)(3) OF THE
FEDERAL INTERNAL REVENUE CODE.
WHEREAS, the current gross receipts tax of 1 % on Hotel, Motels and Restaurants
(A.C.A. §26-75-601 et seq.) established by Ordinance No. 2310, as amended (HMR tax) levys the
tax only upon restaurants, cafes, cafeterias and all other establishments engaged in the business of
selling prepared food for consumption on the premises of such establishment in the city, and;
• WHEREAS, the City wishes to also apply the HMR tax to delis, drive-in restaurants, carry-
out restaurants, concession stands, convenience stores, grocery store restaurants and similar
businesses and all taxable businesses selling prepared food for on or off premises consumption as
allowed by A.C.A. §26-75-602 and;
WHEREAS, the City -wishes to exclude from HMR taxation the gross receipts on gross
proceeds of organizations qualified under §501 (c)(3) of the federal Internal Revenue Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1 . That §35.20 of the Code of Fayetteville, Tax, Levy of Tax, is hereby
repealed and the following inserted in its stead:
§35.20 Levy of Tax. There is hereby levied, a tax of 1 % (the tax) upon
the gross receipts or gross proceeds from the renting, leasing, or otherwise

portion of the gross receipts or gross proceeds received by restaurants, cafes,

(c) As provided in Act No . 185 , the provisions of Act . No .
386 of 1941 , as amended , together with the rules and regulations

Section 2 . There is hereby created the City Advertising and
Promotion. Fund , to which fund there shall be credited all callections
of the tax .
Section 3 . The City Advertising and Promotion Fund shall be
used , in the manner determined by the City Advertising and Pro-
.motion Co=nission , exclusively for the advertisement and promotion
of the City and its environs and/or for the construction , main-
tenance , repair and operation of a convention center , including
the pledge of revenues therein to the payment of bonds issued

Section 4 .. (a) There is hereby created the City AdvertisinS
and Promotion Commission ( the " Commission" ) . The Commission shall
have the powers and duties prescribed by Act No . 185 , as now or

AMENDMENT TO THE AGREEMENT BETWEEN THE ADVERTISING AND
PROMOTION COMMISSION OF FAYETTEVILLE, ARKANSAS AND
THE FAYETTEVILLE CHAMBER OF COMMERCE DATED JANUARY 4, 1993
WHEREAS, the Advertising and Promotion Commission of Fayetteville, Arkansas, hereinafter
called "A & P" and the Fayetteville Chamber of Commerce, a nonprofit corporation,
hereinafter called "Chamber", entered into a contract on January 4, 1993 , to combine and
coordinate efforts to provide and support an effective Convention & Visitor Development
Program for Fayetteville; and
WHEREAS, the parties desire to amend the contract to provide for one additional
renewal term for the year 2001 .
• NOW, THEREFORE, IN CONSIDERATION OF THE COVENANTS AND
CONDITIONS set forth herein, and in consideration of the mutual benefits which will accrue
to each of the parties, hereof, as well as to general citizenry of Fayetteville and its environs, the
parties have agreed and do hereby agree as follows:
1 . TERM: The last paragraph of the contract between the A & P and the Chamber
dated January 4, 1993 is hereby deleted and the following shall be inserted in its
stead:
IT IS AGREED between the parties that this agreement is not assignable. This
agreement shall commence on January 1 , 1993 and shall terminate on December 31 ,
1993, with the A & P having the option to renew yearly for eight (8) additional one (1 )
•
• year terms. Notice of intent to renew shall be subject to the A & P Commission's
approval of the yearly budget.
RENEWAL: The A & P exercises the option of renewal contained in the
Agreement between the A & P and the Chamber dated January 4, 1993, as hereby
amended for a one ( 1 ) year period commencing on January 1 , 2001 , and terminating on
December 31 , 2001 .
2. FUNDING: Paragraph 2. 0 Funding, of the contract between the A & P and the
Chamber dated January 4, 1993 , is hereby deleted and the following shall be
inserted in its stead.
2. 0 Funding.—Subject to the terms and conditions set forth in this agreement, the
A& P shall compensate the Chamber for services rendered as follows:
• For the period January 1 , 2001 , to December 31 , 2001 , compensation shall be in the
amount up to but not to exceed One Hundred Thousand Dollars ($ 100,000. 00),
subject to the A & P's approval of the yearly budget. Said compensation is to be
paid in three (3) installments. The first installment, in an amount up to but not to
exceed Fifty Thousand Dollars ($50,000. 00) shall be paid on or about the fifteenth
day of January. The second installment, in an amount up to but not to exceed
Twenty-five Thousand Dollars ($25,000.00) shall be paid on or about the fifteenth
day of April. The third and final installment, in an amount up to and not to exceed
Twenty-five Thousand ($25,000.00) Dollars shall be paid on or about the fifteenth
day of July. Any monies that are not expended for documented authorized
expenditures shall revert back to the A & P.

• 3 . RE-ADOPTION OF TERMS OF AGREEMENT DATED JANUARY 4, 1993 .
With the exception of the changes set forth herein, the agreement between the A &
P and the Chamber dated January 4, 1993 is hereby re-adopted and agreed to by the
parties and is attached hereto and made a part hereof as if set forth herein, word for
word.

Advertising & Promotion Commission
• Benefits/ Impacts of the State collecting HMR taxes for Fayetteville:
Stephen Davis contacted the Arkansas Department of Finance and Administration
(ADFA) to find out how much the ADFA would charge to collect the HMR taxes and
was informed that ADFA does not collect HMR taxes for any local jurisdiction.
What is the impact of shortening the time period between nonpayment of HMR taxes and turning
the collection over to City Prosecutor?
The City sends letters to establishments requesting payment of the taxes owed until they
are delinquent four months. The establishment is then referred to the City Prosecutor for
further collection action. Each establishment that pays delinquent HMR taxes also pays a
5% per month penalty up to 35% of the total taxes owed.
The impact on the City Prosecutor's office would be to increase the work load of the City
Prosecutor's staff. A number of establishments that are delinquent at least one month pay
before being referred to the City Prosecutor.
