Adjourn • • GROUP: ADVERTISING & PROMOTION COMMISSION DATE: April 27, 1998 PRESENT: Curtis Shipley, Joe Fennel, Fred Hanna, Alex Jerde, Kit Williams, and Marilyn Snapp ABSENT: Carl Maguire and Jim Waselues A special meeting of the Advertising and Promotion Commission was called to order at the City Hall Room 326 at 2:00 p.m. by Chairman Joe Fennel for the purpose of discussion of the Town Center. Discussion centered around the following topics: LOCATION — Williams said the Commission needed to look at the Bradberry property and if that doesn't work, an alternate site could be explored such as the parking lot behind the Campbell Bell building. BRADBERRY PROPERTY — Fennel read a letter from Mr. Bradberry (a copy is attached). Shipley commended the letter as reasonable and indicates a desire to proceed. Hanna questioned what nominal rent might be. Ann Henry, a member of the audience, asked Kit Williams to take the lead to enlarge Jerry Rose's authority to broaden the base of negotiations with Bradberry. Bruce Dunn also indicated broad base negotiations with Bradberry and Jerry Rose. John Lewis requested that the Commission not lose site of the "big picture" because a lot of people wanted this. Returns to the city will be many fold. Rick Osborne agreed with Lewis. He said the Hilton deck was downsized from 5 levels because some said we'd never fill three." • PARKING — Shipley indicated that Bradber y's parking should be replaced. He indicated that the city council should try to negotiate a least first and pursue that option before buying. He asked if there was anything that the Commission could do to get the council to reconsider their decision to only purchase the land. Maguire indicated that a clearer definition of nominal rent. COST — Richard Alderman said that we can build a good building for the amount of money we have available (7 million). The city could participate especially in the areas of streets, sidewalks, and gardens. Shipley asked that it be determined if the city can participate or not. If so, to what extent? We need the help of the city like on Dickson Street. We need to do the project right on the front end. All of our marbles are on the table. We would like to be able to put back in the cost savings options which we deleted to get within the budget. He indicated that we should submit the like to the city council and get an idea of where they stand. Kit Williams indicated that when he suggested participation in the project, the city wanted no part of it. Bootise Ackerman, a member of the audience, said the timing now for the project is optimal and encouraged the Commission to move the project forward.. We feel we are not unreasonable in insisting that the City live up to its representations to us. We continue to support the Town Center, and we will do everything we can to provide a lease that is less costly to the City, accomplishes their purposes for a Plaza, and still protects our property. Our concerns have not changed and are simply that we be allowed to retain ownership of • our property by means of a long term lease with conditions protecting our investment. Basically, those conditions provide that ( 1 ) the tie-ins to our buildings are done in a proper and cohesive manner so that our property is not adversely affected, (2) our current 32 parking spaces adjacent to our leased offices are replaced under the Plaza, (Original plans provided this but current plans do not. Also, it is interesting to note that including these spaces would cost approximately $300,000—the lowest incremental cost per parking space in tire entire project ! ) (3) the City pay us nominal rent over the life of the lease, and (4) alternate parking for our tenants be provided during construction. You can readily see our concerns. The above has been promised to us from the very beginning (approximately two years ago) in exchange for our support of the Town Center. We are still at a loss as to why this cant be accomplished. This is not a hard-line stand, but simply what has been discussed and negotiated all along. • Page 2 April 21 , 1998 • We do not want to delay this project. Our greatest fear is that we will be drawn into some type of litigation, which will be very costly for the City, for ourselves, and of great damage to the project. Our legal staff, headed by Jack Butt, has advised us that our concerns are real and valid, and to condemn our property and build the Center, as currently planned, could result in substantial damages to us which, with the concurrent costs, would cost the City several times the capitalized price of leasing the property. Also, it would undoubtedly lake several years to resolve this matter. A final court ruling in our favor could result in costly consequences for the City. We pray this does not occur. Although the A & P Commission has currently put this project on hold until this and other matters can be resolved, we ask for your continued support and help as we attempt to get our message across to the concerned citizens of Fayetteville. Please do not hesitate to share this information with other interested parties.
