The meeting was called to order by Commissioner Coy Kaylor at
2 : 00 p . m . at the Chamber of Commerce office .
MONTHLY REPORTS :
MINUTES
It was moved by Waselues , second by Fennel that the minutes
of the October 4 meeting be approved . Motion carried .
�F FINANCIAL
Ben Mayes presented the financial report . HMR collections
were $ 77 , 619 in October , an increase of 1 . 608 over 1994
collections . Total year to date collections are
$ 766 , 350 an increase of 7 . 17 $ . October expenditures were
$ 81 , 924 . Year to date expenditures $ 619 , 490 .
Moved by Jerde , second by Fennel to approve the financial
report . Motion carried . Discussion followed regarding late
payment of HMR taxes and an ordinance to collect late taxes
with fines for late payment .
ACTIVITY REPORT
Marilyn Johnson reviewed October activities of Convention
Visitor Development . Inquiry responses year to date total
35 , 273 . Advertising inquiries continue to increase over
1994 ; however , relocation inquiries continue to be down for
this quarter .
Motion by Fennel , second by Jerde to approve the Convention
Visitor Report . Motion carried .

AGENCY REPORT
Brad Ruth and Susan Stirewalt presented media recommendations
for 1996 .
Motion by Fennel , second by Hanna to approve the Agency
report and 1996 media placement recommendations . Motion
carried .
OLD BUSINESS :
APPROVAL OF CONTRACT WITH WITTENBURG , DELONY & DAVIDSON
Motion was made by Fennel , second by Jerde to approve a
contract between the Advertising and Promotion Commission and
Wittenburg , Delony & Davidson for schematic design
( $ 48 , 262 . 50 ) and feasibility study ( $ 45 , 000 . 00 ) for Exhibit
Hall /Town Center . Motion carried .
APPROVAL OF 1996 BUDGET APPROPRIATIONS
Following discussion , motion by Fennel to approve 1996 budget
appropriations , second by Waselues . Motion carried .
NEW BUSINESS : None
ANNOUNCEMENTS :
Joe Fennel announced that as of 11 : 00 a . m . John McDonnell and
the U of A had won another national championship .
There will be no meeting of the A & P Commission in December .
There being no further business , the meeting was adjourned .

RE: 1995 Budget Rollforwards
Two projects are contained in the 1995 Advertising & Promotion Commission Budget which will
not be completed in 1995 and are requested to be rolled forward into 1996 and made a part of
the 1996 Budget. Both of the projects were included in the estimated 1995 expenditures when
the 1996 budget was prepared . The two items are as follows :

Girls Softball Fields
An engineering contract in the amount of $35 ,000 was approved in mid-1995 with Perry
Butcher & Associates to provide for the design and construction observation of the softball
fields. It is anticipated that bids will be let on the project in the Spring of 1996 .
City Entranceway Enhancements
This project has been hampered by turnover and inadequate City staff time due to higher
priority projects . The City ' s 1996 budget contains funding to hire a Trailways/Sidewalks
Coordinator, which we anticipate will assist in bringing this project to fruition.

As of November 13 , 1995, $22,231 . 97 has been spent out of the $25,000 you
allocated to the Lake Fayetteville Project.
Since my last update to you dated September 12, 1994 (see attached) the
following work has been completed:
1 . Parking Lot. Joint project between City of Fayetteville (performed
work) and Marine Fuel Tax Division, State of Arkansas. (provided funding).
2. Decks and walkways have been completed for the two (2) additional
fishing piers. We are awaiting funding by Arkansas ' Game and• Fish for balance
of materials for completion. Approx • $ 12,000.
3 . Fencing'on north side of parking lot completed.
Scheduled for Spring and Summer of 1996 completion':
1 . Two (2) additional fishing piers.
2. Bait house and office expansion.
Scheduled for beginning construction Fall of 1996:
1 . Pavilion
2. Trailer Park and Camping Facility
3 . Public Restrooms .
The strong support of the Lake Fayetteville Project by your committee is greatly
appreciated. Your support has allowed us to preserve this great natural resource
and develop it into an outstanding recreational facility for all who live and travel

. AGREEMENT TO EXERCISE THE OPTION TO RENEW THE AGREEMENT
BETWEEN THE ADVERTISING AND PROMOTION COMMISSION OF
FAYETTEVILLE, ARKANSAS AND THE FAYETTEVILLE CHAMBER OF
COMMERCE DATED 4 JANUARY 1993
WHEREAS, the Agreement made and entered into between the Advertising and
Promotion Commission of Fayetteville, Arkansas, hereinafter, called "A & P" and the
Fayetteville Chamber of Commerce, a nonprofit corporation, hereinafter called "Chamber" ,
dated 1 January 1993 provides that said agreement terminates on December 31 , 1993 with the
"A & P " having the option to renew yearly for three (3) additional one ( 1 ) year terms; and
WHEREAS , the "A & P" wishes to exercise said option and extend the term of said
agreement for an additional one year period.
NOW, THEREFORE, IN CONSIDERATION OF THE COVENANTS AND
CONDITIONS stated herein, and in consideration of the mutual benefits which will accrue to
each of the parties hereof, as well as the general citizenry of Fayetteville and its environs, the
parties have agreed and do hereby agree as follows:
. 1.0 Renewal. The "A & P" hereby exercises the option of renewal contained in the
Agreement between the "A & P " and the "Chamber" dated 4 January 1993 for a one (1) year
period commencing on the 1st day of January, 1996 and terminating on December 31 , 1996 .
2.0 Funding. Subject to the terms and conditions set forth in this agreement and the
agreement dated 4 January 1993 , the "A & P" shall compensate the "Chamber" for services
rendered as follows :
For the Period January 1 , 1996 to December 31 , 1996 compensation shall be in an
amount up to but not to exceed One Hundred Thousand Dollars ($100,000.00), subject to the
"A & P's" approval of the yearly budget. Said compensation is to be paid in three (3)
installments. The first installment, in an amount up to but not to exceed Fifty Thousand Dollars
($50,000.00), shall be paid on or about the fifteenth day of January . The second installment,
in an amount up to but not to exceed Twenty-five Thousand Dollars ($25 ,000.00) , shall be paid
on or about the fifteenth day of April. The third and final installment, in an amount up to and

3 . The event is the AAAA State basketball tournament ( quarter and
semi - final rounds ) , featuring the final sixteen boys and girls
basketball teams from the four geographic regions of Arkansas .

6 . This annual event is staged at a sight selected by the Arkansas
Activities Association ' s executive committee .
7 . The tournament draws from the four geographic areas of the
state . Based upon the conservative estimate of 100 visitors
per participating team per day , the total visitor draw would be
2000 . Three of the four geographic areas participating would
more than likely stay overnight . Thus , if a team from East
Arkansas wins on Thursday they would probably stay Friday and
Saturday if they continue to win . Also , we would expect the
number of visitors per team to increase as their teams advance .
8 . We have two of the top three basketball arenas in the state of
Arkansas and incomparable hotel and restaurant facilities .
This is an opportunity to display our city ' s offerings and to
produce a tournament that will make these visitors want to
return .
9 . This sporting event is well advertised and promoted by the
sports media .
10 , We have an active and competitive media atmosphere here in
Northwest Arkansas but the state - wide nature of the event
• and the fact that all the major population areas of the state
will be present insures complete and thorough coverage of the
event all over the state .

11 . The only marketing we will conduct is the production and sale
of the game program . Otherwise , the Arkansas Activity
Association will handle marketing of the event .
12 . We are requesting $ 2000 to cover the rental of barnhill arena .
The Arkansas Activities Association receives %100 of the gate
and % 85 of T - shirt sales . The UofA receives %100 of
concessions . The only revenue source for the school is from
game ,program sales and % 15 of T - shirt sales . However , we must
provide ticket sellers , ticket takers , security , ushers , time
keepers , and - book --keepers for •the tournament .- - The school can-
not afford a loss of revenue from hosting the event and the
facility rental fee is our largest single cost.
The school stands to gain an edge in home court advantage and of
course the prestige of hosting the event . However , the city of
Fayetteville will receive the major financial benefit . An
additional incentive to our hosting this tournament is to
demonstrate to the Arkansas Activities Association that we are
capable of running a first class event . This should enhance our
position when we bid for the championship tournament beginning next
year .

I am writing to express my opposition to the enactment of the sign ordinance
limiting off-premises billboards or informational signs on the state and federal highways
in Washington County. My reasons include the following:
1 . Certainly the right of a property owner to negotiate long-term leases on his
property for billboards is a constitutionally-protected property right. The new Highway
• 71 is the best example of persons who actually own property along the road who have
been damaged, have suffered condemnation of their ownership rights, and will be left
with little other than new noise and gas fumes from the road. Ninety percent of the
property along the highway is inaccessible by exit ramps, and for that reason, the land
will be extremely devalued. I do not think there are going to be too many billboards
established along the highway since the marketplace will take care of that.
2. On the positive side, I think businesses and institutions in the cities, such
as the Airport Museum, the Tourism Railroad, Historic Downtown Fayetteville,
individual downtown businesses and those along old Highway 71 , will need additional
advertising in order to inform the traveling public of their existence and location, thereby '
being able to prosper from those persons who will be using the new road to avoid traffic
in Fayetteville and Springdale.
3 . With the construction of the new airport facility in Benton County,
Fayetteville, Springdale, and Washington County will see a dramatic decrease in
economic activity which has been generated by the Fayetteville Airport. This has been
estimated to be as much as $40-$50 Million per year. These monies will be transferred
to Benton County and eliminated from Washington County because 90 % of the
enplanements and deplanements involve a short sales trip to Wal-Mart and

return. All of Wal-Mart's business will accrue to Bentonville, with some to Rogers. The
sales taxes which previously had been derived by Fayetteville, Springdale and Washington
County from these travelers will no longer be collected.
4. I think there will have to be a great deal of effort by advertising associations
and individual businesses off the new highway to attempt to develop new business from
the highway traffic. As I understand it, many of the buses destined for Branson from
Texas, Louisiana and Oklahoma will be using the new highway rather than I-40 and then
_Highway 7 from Russellville north to Harrison and Branson. Currently, very few of the
g `charter services come through Fayetteville, Springdale or Washington County, but prefer,
rather, to go through Russellville. This is important because there may be as many as
1 ,500,000 people from East Texas who travel to Branson every year. There will be no
way for these people to know about services in Washington County, Fayetteville or
Springdale unless the use of billboards is permitted along the new highway. If we don't
get the additional business from the new highway, then we can predict that tax receipts
will dramatically decrease for all governmental entities, and retail and service businesses
will fail to prosper.
To summarize, I believe we can expect many of the businesses along Highway 71 -
B in Fayetteville and Springdale (especially motels and restaurants) to be adversely
impacted when the new road comes in, the new airport in Benton County is completed,
and Drake Field is abandoned .
Representing myself as a property owner, I object to the establishment of this
ordinance. It is not in the best interest of the property owner; it is not in the best interest
of the economy of Washington County; it is not in the best interest of government; and
it is not in the best interest of individual businesses. In addition, enacting an ordinance
prohibiting these billboards will be a disservice to the traveling public along the highways
who otherwise could obtain needed, useful information in order to plan their trips and
enjoy their travels.
Please keep me apprised of any hearing date or further discussion that you might
have on this ordinance.
