AN ORDINANCE TO AMEND THE CODE OF FAYETTEVILLE BY
ENACTING § 114.03 FIRST THURSDAY FAYETTEVILLE TO
AUTHORIZE THE FAYETTEVILLE CONVENTION AND VISITORS
BUREAU TO CONTROL THE PUBLIC PARKING SPACES ON BOTH SIDES
OF EAST STREET ON THE SQUARE AND TO CLOSE EAST STREET TO
TRAFFIC FROM 4:00 P.M. UNTIL 10:00 P.M. ON THE FIRST THURSDAY
OF THE MONTH
WHEREAS, First Thursday Fayetteville has been authorized by special event permits to
use all public parking spaces on both sides of East Street between Center and Mountain and close
East Street at that location on the first Thursdays of August, September, October and November
of 2009; and
WHEREAS, First Thursday Fayetteville has been very successful in providing many
citizens opportunities to view and purchase art and share the evening downtown environment
during the initial four First Thursday events; and
WHEREAS, it is preferable to establish by ordinance rather than monthly special event
permit the authority to conduct First Thursday Fayetteville on a monthly basis.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby amends the
Fayetteville Code by enacting a new § 114.03 First Thursday Fayetteville as shown below:
" 114.03 First Thursday Fayetteville.
"(A) Establishment, hours and dates. First Thursday Fayetteville is
hereby established. This monthly event shall run on the first Thursday of
every month from April through November during the hours of 4 P.M.
through 10 P.M.

"(B) Location, parking restrictions and administration. First Thursday
Fayetteville shall be located and have control over the public parking
spaces along both sides of East Avenue during its hours of operation. The
Fayetteville Convention and Visitors Bureau shall administer First
Thursday Fayetteville and shall be empowered to remove or request the
ticketing of vehicles parked within the East Street allocated area during
the 4:00 P.M. to 10:00 P.M. operating hours. The Bureau shall also be
empowered to close East Street between Mountain and Center Streets to
vehicular traffic during the First Thursday Fayetteville event.
"(C) Articles permitted to be sold. Only objects of art or craft produced
and sold by a local artist or craftsperson may be sold at the First Thursday
Fayetteville event. The Fayetteville Convention and Visitors Bureau is
empowered to assign precise locations for any vendors wishing to display
or sell their personally created art or craft work.
"(D) Sanitation. At the close of a vendor' s operation (no later than 10:00
P.M.), the vendor shall clean the immediate area around the vendor' s
operation and ensure that all trash and debris are removed and properly
discarded."

Subject: First Thursday Fayetteville management
PROPOSAL:
City Administration is requesting an ordinance to amend Chapter 114 of the Fayetteville Code ' to authorize the
Fayetteville Convention and Visitor' s Bureau to manage East Street between Mountain and Center Streets and
parking spaces on the both east and west sides of this section of East Street for the First Thursday Fayetteville
monthly cultural arts event.
RECOMMENDATION:
During the 2009 Fayetteville Forward 2009 Summit, citizens identified a need for a monthly cultural arts event
in Fayetteville to support growth of Fayetteville's creative economy. The First Thursday Fayetteville event
began as a volunteer collaboration between art galleries in the downtown area, the City Administration staff, the
Convention and Visitor' s Bureau, and downtown merchants during the summer of 2009. The initial First
Thursday Fayetteville event was held on August 6, 2009 and continued on the first Thursday of September,
October, and November 2009.
Review of the planning and management of the 2009 events revealled a need for an entity, other than the City
Administration, be authorized to manage the event activities, vendors, and outdoor space in order for this
monthly cultural arts event to be successful.
City staff recommend the Convention and Visitor' s Bureau be authorized to manage the portion of East Street
between Mountain and Center Streets and parking spaces on the east and west sides of this section of East Street
(Exhibit 1 ) on the first Thursday of each month, April through November, to begin at 4:00 p.m. and end at
10:00 P.M.
