AN ORDINANCE WAIVING THE REQUIREMENTS OF FORMAL COMPETITIVE
BIDDING AND APPROVING A CONTRACT BETWEEN THE CITY OF
FAYETTEVILLE, ARKANSAS AND WAYEST IN THE AMOUNT OF $47,500.00 TO
PROVIDE REPLACEMENT BUNKER GEAR (COAT AND PANTS) TO THE
FAYETTEVILLE FIRE DEPARTMENT
WHEREAS, the Fayetteville Fire Department is in need of replacement bunker gear (coat and pants)
for its firefighters, and;
WHEREAS, Wayest has previously provided bunker gear to the Fayetteville Fire Department, and;
WHEREAS, Morning Pride bunker gear previously supplied by Wayest has excellent quality,
replaceable components, and has provided excellent thermal protection to Fayetteville firefighters by reducing
the instances and severity of burns sustained by firefighters, and;
WHEREAS, competitive bidding for bunker gear meeting the standards of existing city equipment in
this exceptional situation is not feasible or practical.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby waives the requirements
of formal competitive bidding and approves a contract between the City of Fayetteville, Arkansas and Wayest
in the amount of $47,500.00 to provide replacement bunker gear (coat and pants) to the Fayetteville Fire
Department.

Request that the competitive bid process be waived in order to purchase replacement bunker gear (coat and pants)
from a manufacturer that did not submit the lowest bid. The gear being requested is the same gear that the
Department curmetly uses. The Department partnered with Springdale Fire and Bentonville Fire on bid specifications
in order to gain a better price.

RE: Bunker Gear Bid
RECOMMENDATION:
The Department would like to request that the "Competitive Bid" process be waived in order to
purchase replacement bunker gear that matches the current gear issued to personnel.
BACKGROUND:
Bunker Gear. Protective gear worn by firefighters to protect them from heat and abrasive
debris during fire suppression and emergency scene activities.
The Department has worked with the Springdale Fire Department and the Bentonville Fire
Department in order to develop a cooperative bunker gear bid. The bid was answered by four
manufacturers. One of the manufacturers (Morning Pride) is the company that produces the
gear that is worn today. The gear meets all of the specifications that the bid set forth. The
other three manufacturers either did not meet all of the specifications, or substituted a different
option in their bid specifications. The gear that is worn today has excellent quality and has
served the Department well. The gear is durable and is "fitted" to the individual firefighter:
The gear also has replaceable knee pads which is a plus. The knee area receives a lot of wear
and thermal damage during the course of suppression operations. The other two manufacturers
do not offer this — which results in retiring the gear or trying to repair it multiple times. The
Morning Pride gear has afforded the firefighters excellent thermal protection which has
reduced the number and severity of burns sustained by our firefighters.
The Morning Pfide gear came in third on price - approximately $220.00 more than one
manufacturer and $ 164.60 more than the other manufacturer (one manufacturer was $ 134.00
higher than Morning Pride). However, the Department is confident that this difference is
negligible when the points of maintaining the same gear, reliability, durability, and overall
safety are factored in.
BUDGET EMPACT•
The money for the bunker gear ($47,500.00) will come from the Department's Uniform
Budget. This has been planned for and will leave money in the account for other necessary
expenditures.
