WHEREAS, Taser International manufactures a unique and effective temporary disabling device known as a taser that can be equipped with a taser cam to document each use of the taser, and WHEREAS, the Fayetteville Police Department has used and trained with tasers since 2004 and found them effective in preventing injury to both officers and suspects who needed to be taken into custody. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby determines that because tasers are manufactured by a single source, Taser International, and provide a unique and effective way to empower our police officers to take violent or resisting suspects into custody with less chance of injury to the officer and the suspect and therefore determines that competitive bidding is not practical or feasible to obtain this needed tool and so waives the formal requirements of competitive bidding and authorizes the purchase of 45 tasers with attached taser cams in the amount of $69,967.25 from the Justice Assistance Grant funds of $70, 122.50 awarded for this project. The funds awarded to the Fayetteville Police Department are in the amount of $49,689.25 for the purchase of (45) X-26 Tasers and $20,433.25 for the purchase of (45) TaserCams. The funds budgeted for these purchases total $70, 122.50. This purchase would be made through TEECO Safety, Inc. The bid from TEECO Safety is $44,770.50 for the X-26 Taser purchase and $18,537.75 for the TaserCam purchase, plus shipping and handling of $735.00. Tax included, brings the cost of this request to $69,967.25. Background : Taser International manufactures the X-26 Taser and TaserCam . Both of these items are used in conjunction with each other. The Taser device uses electrical impulses to temporarily overwhelm the neural communications that are required for a person to perform coordinated actions. The resulting effect of the Taser when utilized on violent or combative persons is that they are unable to inflict harm upon anyone and/or themselves. Numerous law enforcement agencies, including the Fayetteville Police Department, currently use Tasers to improve tactical performance while allowing officers to more safely perform their job while minimizing risk of serious injury to themselves and the people they interact with. The TaserCam device is matched to the Taser device and is a video and audio capture device, which records both the officers actions regarding the use of the Taser as well as the subject(s) actions on whom the Taser is deployed . The intent of the TaserCam is simple: Taser use accountability and evidence collection. Discussion: The Fayetteville Police Department has utilized the X-26 Taser and TaserCams since 2004 with remarkable results. As it stands, the department's police officers must sign in and out a Taser/TaserCam at the beginning of every shift. Having far fewer Taser/TaserCams than officers, it is not uncommon for shortages of Tasers/TaserCams to occur. With these JAG-Recovery funds each officer assigned to the patrol division will be equipped with their own Taser and TaserCam . Officers having immediate access to the Taser will afford them with a less lethal option that has been demonstrated nationwide to decrease injuries and save lives. A sole source justification is requested for purchasing this equipment through TEECO Safety Inc. as they are the only regional supplier for Taser International products. Budget Impact: The $70, 122.50 for this project has been awarded to the Fayetteville Police Department through the aforementioned JAG — Recovery Act. The purpose of sole source justification is to show that competitive bidding is impractical because only one product or service provider can meet a specific need. Therefore, an equitable evaluation of comparable products or services must be made and documented by the requester who shows that rejection of other products or services is based solely on their failure to meet that need. In cases where no other comparable source can be identified, a technical description of the product requested and a listing of those companies which were considered as alternative sources must be provided. Quality can be a subjective evaluation based upon opinion. Municipal (public) procurement law requires price considerations be evaluated via competitive quoting or bidding. While all sole source justifications are subject 'to review, sole source justified purchases of $20,000.00 or more must be publicly bid or a bid waiver approved by Council.
