AN ORDINANCE WAIVING THE AUTOMATIC ANNUAL PRICE
INCREASE FOR RESIDENTIAL TRASH SERVICE FOR FISCAL YEAR
2010; AND AMENDING A PORTION OF CHAPTER 50: GARBAGE AND
TRASH OF THE FAYETTEVILLE CODE OF ORDINANCES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas, hereby waives §
50.40 (A) (4) of the Fayetteville Code of Ordinances, and cancels the Annual Price Increase for
Residential Trash Service for Fiscal Year 2010.
Section 2. That § 50.40 Rates for Services, of the Fayetteville Code of Ordinances is
hereby repealed, and the language set forth in the attached Exhibit A is adopted in its stead.

RECOMMENDATION
City Administration recommends approval of an ordinance waiving the automatic annual price adjustment
for residential trash and updating and correcting the solid waste rate ordinance, specifically rescinding and
replacing Section 50.40 of the Fayetteville Code of Ordinances.
BACKGROUND
Solid waste rates were established in 2000 based on the DMG Maximus (DMG) rate study. When
reviewing the rate section of the ordinance, staff realized that there were several items unintentionally
omitted at that time, and several other items not updated since.
Additionally, ordinance 4765 allows for annual adjustments of the residential trash rate equal to the
consumer price index. This adjustment has been waived for both 2008 and 2009.
DISCUSSION
The following corrections are reflected in the proposed ordinance (attached):
- In 2000, no rate was formally set for cardboard recycling, although the rate of 50% of normal
dumpster costs is being charged.
- Container rental charges were not included in the ordinance.
- No rate was set for small business commercial recycling. This program has been in a trial basis,
with no charge to the commercial customer, since approximately 2000.. A number of additional businesses
have been on a waiting list to receive this service, but it could not be increased until a rate was formally
established. The actual cost of service is the same as residential recycling, so the residential rate, as
identified in the 2009 R. W. Beck Recycling Study, is being applied. Customers in this program have
reduced trash volume, creating a potential savings in their trash rate if they use a smaller trash container or
have a reduced pick up frequency.
Commercial solid waste rates have not changed since 2000. Staff intends to perform a rate study in 2010 to
evaluate all solid waste rates.
BUDGETIMPACT
This rate ordinance will create a slight revenue increase due to the extension of the existing residential
recycling rate to small commercial customers.
