AN ORDINANCE AMENDING TITLE XV: UNIFIED DEVELOPMENT
CODE OF THE CITY OF FAYETTEVILLE, TO AMEND CHAPTER 166:
DEVELOPMENT AND CHAPTER 171 : STREETS AND SIDEWALKS IN
ORDER TO CODIFY TRAIL EASEMENT ACQUISTION POLICY AND
TO ADOPT TRAIL CONSTRUCTION STANDARDS.
WHEREAS, the City of Fayetteville Alternative Transportation and Trails (FATT)
Plan was adopted in 2003 ; and
WHEREAS, the City of Fayetteville recognizes that the FATT Plan should be
periodically updated; and
WHEREAS, the City of Fayetteville recognizes that trail easement acquisition policy
should be codified in the Unified Development Code; and
WHEREAS, the City of Fayetteville recognizes that trail construction standards
should be adopted to ensure consistent trail quality,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby amends
the Unified Development Code § 166.05(C)(7)(b) by adding the following language and
renumbering the remainder of the section appropriately:
166.05(C)(7)(b) "The developer may be required to grant a multi-use trail easement
for trails shown on the Master Transportation Plan that abut or intersect the large
scale development or preliminary plat, if it is determined that the improvements bear
a rational nexus and rough proportionality to the needs created by the development."
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby renames
the Unified Development Code § 171 . 13 Sidewalk and Driveway Specifications as follows:

RECOMMENDATION
Staff recommends approval of the proposed amendments to Chapters 166 and 171 of the
UDC. This item was heard at the August 10, 2009 Planning Commission meeting and
forwarded to the City Council with a unanimous recommendation for approval (7-0-0).
BACKGROUND
The City of Fayetteville first adopted the Fayetteville Alternative Transportation and
Trail (FATT) Master Plan in 2003 . After a full review of this plan staff scheduled an
update for 2009. The Strategic Planning and Internal Consulting Department, GIS
Division, Transportation Division, Engineering Division and the Trail Coordinator
worked together to complete this comprehensive update.
The objective of the FATT Plan update is to develop a comprehensive trail policy that
addresses trail easement acquisitions for both multi-family residential and commercial
developments, update and adopt an amended Master Trail Map, amend the Master Street
Plan section of City Plan 2025 to recognize the trail system as a transportation
component, and codify trail development standards in the Unified Development Code.
Specifically, this item addresses amendments made to the Unified Development Code in
order to codify trail easement acquisition and trail development standards.
DISCUSSION
Staff presented the proposed FATT Plan update to the Trail and Sidewalk Task Force at
their July 8, 2009 meeting where it was forwarded unanimously. On August 3, 2009 the
Parks and Recreation Board reviewed the FATT Plan update and it was forwarded to the
Planning Commission with a unanimous vote of 7-0 recommending approval . The
Planning Commission reviewed the FATT Plan update at its' August 10, 2009 meeting
and forwarded the proposal unanimously to the City Council with a recommendation of
approval .
