WHEREAS, the City Council has the authority under A.C.A. § 14-54- 104 to vacate
public grounds or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of the
platted right-of-way is not required for corporate purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby vacates and
abandons the following described portion of right-of-way:
See Exhibit "B" attached hereto and made a part hereof.
Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the
map attached hereto and labeled Exhibit "A" shall be filed in the office of the Recorder of the
County and recorded in the Deed Records of the County.
Section 3 : That this vacation approval is subject to the Condition of Approval as follows,
and shall not be in effect until this condition is met.
1 . The applicant shall dedicate right-of-way for the location of the existing McCollum
Avenue to the east of the right-of-way being vacated as shown on the attached map.

RECOMMENDATION
Staff and the Planning Commission recommend approval of an ordinance vacating a
portion of public right-of-way at the intersection of McCollum Avenue and Willoughby
Road.
BACKGROUND
The subject property is located at the southwest corner of the Willoughby
Road/McCollum Avenue intersection, east of Hwy 71B. In 2002, the City's
Transportation Division utilized off-site escrow funds from Scurlock Industries (Tri-State
Precast) to improve the McCollum Avenue intersection, realigning it with Willoughby to
a 90 degree angle and paving the surface. Existing right-of-way shown in the attached
maps indicates the previous location of the Willoughby Road/McCollum Avenue
intersection, which was at an angle. The applicant is requesting to vacate a portion
(approximately 0.072 acre) of the right-of-way located at the northeast comer of the
subject property, where the road is no longer located. In exchange for this vacation, the
applicant owns most of the property on which the road actually is now located, and is
willing to dedicate that portion to the City. Vacation of this small, triangular portion of
right-of-way will help with development of the property, related to building setbacks.
DISCUSSION
Notification was provided to the City with no objections to the requested right-of-way
vacation. This item was heard at the regular Planning Commission meeting on November
24, 2008 and forwarded by vote of 7-0- 1 , with Commissioner Trumbo recusing, on the
consent agenda to recommend this vacation request to the City Council.

imagery indicates that sometime between 2000 and 2003 McCollum Avenue was
redirected to intersect with Willoughby at a 90 degree angle. Existing right-of-way shown

Avenue intersection.
Request: The applicant is requesting to vacate a portion (approximately 0.072 acre) of

We, the undersigned, being all the owners of the real estate abutting the right of way hereinafter
sought to be abandoned and vacated, lying in the City of Fayetteville, Arkansas, a municipal
corporation, petition to vacate a right of way, which is described as follows:
Legal Description:
A part of the SE '/< of the NW I/4 of Section 33, T -16-N, R -30-W, Washington County, Arkansas,
more particularly described as follows: Commencing at a point which is N 88°10'39" W, 25.00
feet from the SE.corner of said 40 acre tract; thence N 02°26'54" E, 119.79 feet to the point of
beginning along the Right -of -Way of McCollum Avenue; thence along said Right -of -Way N 34
°40'48"W 138.71 feet to a point along the Right -of Way of State Highway 156; thence along
said Right -of Way S 85 °57'33" E, 57.68 feet; thence leaving said Right -of -Way S 11° 00'13" E,
112.06 feet to the point of beginning, containing 0.072 acres, more or less. Subject to all
easements and Rights -of Way of record, if any.
That the abutting real estate affected by said abandonment of the right of way at the intersection
of S. McCollum and W. Willoughby, lying in the City of Fayetteville used by the public for a .
period of many years, and that the public interest and welfare would not be adversely affected by
the abandonment of the portion of the above described right of way.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above
described real estate, subject, however, to the existing utility easements and sewer easements as
required, and that the above described real estate be used for their respective benefit and purpose
as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting property
owners as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City
of Fayetteville, Arkansas, abandon and vacate the above described real estate, subject to said
