AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND
TO AWARD A CONSTRUCTION CONTRACT IN THE
AMOUNT OF $43,315.00 PLUS A $5,000.00 PROJECT
CONTINGENCY TO SWEETSER CONSTRUCTION, INC. TO
REPLACE THE EXISTING DRAINAGE STRUCTURE UNDER
CENTER STREET AND COMPLETELY REPAIR THE STREET
AND APPURTENANCES
WHEREAS, it was recently discovered that an old, stone arch supporting Center Street
over a creek has partially fallen in endangering the street and traffic and requiring closure of the
street; and
WHEREAS, the need for very prompt replacement of this drainage structure and repair
of the vital road connection precludes the opportunity for normal competitive bidding.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby determines
and declares that an emergency situation has arisen because of the immediate need to repair and
reopen Center Street such that normal competitive bidding is neither feasible nor practical.
Therefore, the City Council hereby waives normal competitive bidding and approves the lowest
qualified bid (submitted under an abbreviated bidding process) by Sweetser Construction, Inc. ;n
the amount of $43 ,315 .00, plus a contingency of $5,000.00. °�.�R"/TR %�

for
Repair of Center Street Drainage Structure
The City of Fayetteville has recently become aware of washout areas under Center Street that could
potentially compromise the integrity of the road surface causing failure. The street has been closed
and will remain closed until the drainage structure has been replaced and the roadway reconstructed.
The Contractor's signature below indicates that he has made a field inspection of the existing failure
with the City Engineer and has fiilly assessed the amount of labor, equipment, and materials
required to provide a complete "tum key" repair for the lump sum dollar value submitted below.
Contractor shall schedule his work to re-open the street as top priority within 2 weeks. All other
work including the culvert tie-in not under the roadway shall be totally complete within 6 weeks
from the first day of construction.
The following is a brief list of work items anticipated to complete this project:
• Remove and dispose (R&D) pavement, curb & gutter, sidewalk, sanitary manhole, drop
inlet, natural stone culvert, concrete slab, tree, etc. Temporarily remove and then reinstall a
private chain link fence and metal posts.
• Excavate & install new 10'x10' precast box culvert over gravel bedding (remove shale rock,
if necessary to fit box). Precast box shall be cut to provide opening for new drop inlet.
• Cast-in-place concrete transitions with reinforcing steel (min. #5 bars @ 12" o.c. each way)
to connect precast box to existing concrete culverts on each end (drill and epoxy rebar).
• All fill material under roadway shall be compacted Class 7 base, and then 6" of 4000 psi
concrete pavement with 2" of asphalt surfacing. Existing excavated dirt can be used as fill
outside of roadway.
• Install new concrete curb & gutter, concrete sidewalk, drop inlet, topsoil, seed and mulch
• Work around, support or relocate existing utilities. Any City water or sewer conflicts will
be resolved by City forces.
• All work shall meet City of Fayetteville Standard Specifications.
• Contractor shall be responsible for all standard construction safety, e.g. excavations as
required by 29 CFR 1926 Subpart P, Occupational Safety and Health Standards.
This list is by no means all inclusive. Contractor understands that this work is being accomplished
under an emergency situation. Contractor shall provide all items needed to complete the work and
return the roadway and surrounding site to its pre-existing condition.

RECOMMENDATION :
Approval of a resolution awarding a lump sum contract with Sweetser Construction, Inc.
in the amount of $ 43,315 .00 for a complete "turn-key" replacement of the existing
drainage structure under Center Street including the complete repair of the street and
appurtenances, approving a project contingency in the amount of $ 5,000.00, and
approval of a bid waiver in order to accept the lowest price quote.
BACKGROUND :
The City of Fayetteville has recently become aware of a large washout area under Center
Street that could potentially compromise the integrity of the road surface causing failure.
The street has been closed and will remain closed until the drainage structure has been
replaced and the roadway reconstructed.
DISCUSSION :
Since this work needs to be initiated immediately, Engineering is requesting that the City
Council approve a bid waiver to accept quotes from 3 local contractors equipped to
accomplishment this work in a timely manner. Contractor shall schedule his work to
re-open the street as top priority within 2 weeks. All other work including the culvert
tie-in not under the roadway shall be totally complete within 6 weeks from the first day of
construction.
BUDGETIMPACT:
This project will be paid from funds available in Other Drainage Improvements, Bridge
& Drainage Improvements within the Sales Tax Capital Improvement Fund .
