AN ORDINANCF. '1-0 AMEND § 150. 12 PENALTY OF THE:
UNIFIED DEVELOPMENT CODE. OF THE CODE OF
FAYETTEVILLE TO REFER BACK TO § 10.99 GENERAL
PENALTY OF THE CODE Ol- FAYE:fTF.VII.I.E
WHEREAS. § 150. 12 Penalty of the Unified DeNclopmcnt Code contains no language
except for the title. and
WHEREAS, to avoid any question or issue about whether the provisions of § 10.99
General Penalty are applicable to violations of the Unified Development Code, § 150. 1 ? should
contain clear and express language.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEV ILLF., ARKANSAS :
Section 1 : That the City Council of the Cit) of Fayetteville. Arkansas hereby enacts
§ 150. 12 Penalty of the Unified Development Code of the Code of Fayetteville as follows:
§ 150. 12 Penalty
I nless specifically provided otherwise in the particular chapter or
code section, §10.99 General Penalty of the Code of Fayetteville

During a re� ie \\ of some new Planning Ordinance> ( Accessory 1 )\telling
Units, 'Oulti- farni ' y Design Standards), xke looked at the general penalt% section for
the i;nified Development Code ( 0150. 12) which should work in conjunction
with § 10 .99 General Penalty of the Code of Fayetteville . Unfortunately,
there was noting except the title "Penalty ' and an editor 's reference to
§ 10.99. Cleary- the intent \\•as that 010.99 cover the entire Code of
Fayetteville of which the Unified Development Code is a hart .
However, since penalty provisions in particular and all zoning,
regulations in general are interpreted against the Citi-, 1 believe %\ e should
avoid am• question by placing; language in 0150 . 12 c\ pressl' referring; to
the General Penalty Section as controlling; for the UDC. That is what this
ordinance does.
