Pate, Director of Current PlanningO` Date: February 12, 2008 Subject: Rezoning for 42 City Parks (RZN 07-2856) to P-1, Institutional Planning staff and the Planning Commission recommended to approve rezoning approximately 591 acres in 42 city parks from the various underlying zoning districts to P-1, Institutional. BACKGROUND The subject property consists of 42 city parks on 591 acres throughout the City of Fayetteville. The underlying zoning for the City's parks and parklands ranges from :. .. Residential -Agricultural to General Industrial (I-2), with a majority located within the:..,,,.:::' Residential Single -Family -4 Units per Acre (RSF-4), and Residential Multi -Family --24.. Units per Acre (RMF-24) zoning districts. A guiding policy of the Parks and Recreation 10 -Year Master Plan is to "upgrade existing and provide additional community and neighborhood parks". An implementation strategy: ; +i • .^ of the guiding policy is to "develop design standards that address safety, maintenance, signage and aesthetic issues". As the subject properties are currently zoned, the Unified Development Code in many cases requires that the Planning Commission approve a conditional use permit request to upgrade community and neighborhood parks. Chapter 161.26 (A) of the UDC states that the Institutional District is. designed to protect and.. facilitate the use 'of property owned by larger public institutions and church related organizations and will allow cultural and recreational facilities as permitted uses. This zoning classification will present a uniform planning process for the development and maintenance of the City's parks and parkland, and will help to provide residents with further assurances that designated parkland within their neighborhoods is zoned appropriately. Not all city parks are being rezoned. Several of the largest parks that contain lakes — Lake Fayetteville, Lake Wilson, and Lake Sequoyah — are among a few not included with the rezoning request. City Council Meeting of March 4, 2008 Agenda Item Number DISCUSSION This item was considered at the regular Planning Commission meeting on January 28, 2008. The request is to rezone 42 city parks to P-1, Institutional. Planner: Dara Sanders BACKGROUND: Property Description and Background: The subject property consists of 42 city parks throughout the City of Fayetteville. The underlying zoning for the City's parks and parklands ranges from Residential -Agricultural to General Industrial (I-2) to Residential Planned Zoning Districts_(R-PZD), with a majority located within the Residential Single -Family -4 Units per Acre (RSF-4) and Residential Multi -Family -24 Units per Acre (RMF-24). The applicant proposes to rezone the properties listed in Appendix I to Institutional Use (P-1). In 2002, the City Council approved the Parks and Recreation 10 -Year Master Plan. A guiding policy of the Master Plan is to "upgrade existing and provide additional community and neighborhood parks". An implementation strategy of the guiding policy is to "develop design standards that address safety, maintenance, signage and aesthetic issues". As the subject properties are currently zoned, the Unified Development Code requires that the Planning Commission approve a conditional use permit request to upgrade community and, neighborhood parks. Chapter 161.26 (A) states that the Institutional District is designed to'protectand facilitate the use.of propertyowned by larger public. institutions and church related organizations and will allow cultural and recreational facilities as permitted uses. This zoning classification will better guide the development and maintenance of the City's parks and parkland. Request: The applicant requests to rezone the 42 city parks listed in Appendix I from the various current zoning districts to Institutional Use (P-1). Public Comment: Staff has not received public comment. INFRASTRUCTURE: Streets: All sites have access to public rights -of -way. Street improvements will be evaluated for each park in the case of future development. Water: Public water is available to a majority of the sites, if not all. Service extension will be determined for each park at the time of the development. Sewer: Sanitary sewer is available to a majority of the sites, if not all. Service extension will be determined for each park at the time of the development. Drainage: Standard improvements and requirements for drainage will be determined for each park at the time of development. Fire: As these properties are within the Fayetteville city limits, the Fayetteville Fire Department will respond to all calls for service. Based upon past calls for service, we anticipate 0-1 call for each park. The rezoning will not affect response times or calls for service. Police: It is the opinion of the Fayetteville Police Department that this rezoning will not substantially alter the population density, create an undesirable' increase in load on police services, or create an undesirable increase in traffic danger and congestion. CITY'PLAN 2025 FUTURE LAND USE PLAN: The City Plan 2025 Future Land Use Plan designates these sites as City Neighborhood Area, Residential Neighborhood Area, Urban Center Area, and Natural Area. Staff finds that, due to the wide range of land uses, which consist primarily of residential uses, and the• city-wide recreational need, the P-1 is appropriate for the proposed properties.and would be compatible with the existing and planned land uses in the immediate vicinity. In addition, as the park properties are all owned by the City, the future use and improvements will be to the benefit of the surrounding • neighborhoods. The City Plan 2025, Goal 25 as adopted by the City Council states, "We will assemble an,enduring u. green network". This goal'su'ppdrts the natural environment and recreational opportunities that contribute to our community character and quality of life. Staff finds that rezoning the proposed parks to the P-1 zoning district is consistent with the City's policies and goals, as well as the 10 -year Parks Plan. A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: The properties are designated asCity Neighborhood Area, Residential Neighborhood Area, Urban Center Area, and Natural Area. in the City Plan 2025 Future Land Use Plan. The proposed P -I zoning is consistent with the • City's land use planning objectives,principles and policies to provide and nurture a network of neighborhood parks, major parks, and recreational facilities throughout the community: The surrounding land uses of the majority are established single and multiple family residences. The proposed P -I zoning would be compatible with the existing and planned land uses and zonings, as it is designed to protect and • facilitate cultural and recreational facilities and impose regulations in'harmony' v; c: with the residential uses these facilities are intended to serve. 2. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: Staff finds the proposed zoning is justified. The proposed P -I zoning will release the City -owned recreational use from the unnecessary and at times adverse regulations and limitations of the existing underlying residential, commercial, industrial, and planned zoning districts and will provide uniform standards that more appropriately address and regulate the existing public recreational use of the subject properties. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: The existing use of the properties currently results in pedestrian and vehicular traffic. It is expected that a rezoning from the various zoning districts to P-1 will not create an increase in traffic. The proposed zoning would not result in traffic danger and congestion. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: The proposed zoning will not create undesirable impacts to public services, instead. Increased load on public services were taken into consideration and recommendations from Engineering, Fire, and Police Departments are included in this report. 5. If there are reasons why the proposed zoning should not be approved in view of considerations under b (1) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a. It would be impractical to use the land for'any of the uses permitted under its existing zoning classifications; Finding: These parcels have been developed and utilized as parkland for many years. Rezoning will resolve each park's non -conforming status and allow, by right, the necessary signage, possible expansion, and improvement to each property. Therefore, it is more practical and appropriate to re -zone the property to P-1 than to continue a nonconforming or a conditional use under the current zonings. The zoning for most of the City's parks and park lands ranges from Residential - Agricultural (R -A) to General Industrial (I-2). The majority of the park properties are zoned as Residential Single -Family — Four Units per Acre (RSF-4) and Residential Multi -Family — Twenty-four Units per Acre (RMF-24). The Parks and Recreation Division is requesting to rezone the properties listed on the enclosed attachments to Institutional Use (P-1). Per City Code, the Institutional District is designed to protect and facilitate use of property owned by larger public institutions and church related organizations. This zoning allows cultural and recreational facilities as permitted uses. Additionally, the zoning allows for signage at the park facilities without obtaining Conditional Use Permits. For these reasons, the Parks and Recreation Division feels that the requested zoning will be more suitable for these properties. Enclosed please find Attachments "A", "B", and "C". Attachment "A" illustrates the locations of the proposed park properties for this rezoning request. There are 44 park properties included in this request. Attachment "B" lists the park properties along with the current zoning(s) and address(es). Attachment "C" is a spreadsheet that was prepared by Ms. Kern Wimberly, one of the City's Land Agents. Ms. Wimberly performed extensive research on the.properties to determine which deeds and plats are associated with each property. Also attached to this request are individual maps of each of the park properties with the associated deeds•and county plats. loft Executive Summary Parks and Recreation Guiding Policies and Implementation Strategies Mission Statement: To meet the parks and recreational needs of all ty providing a safe and diversified park system that encourages community pride, visionary planning and operations, and environmental stewardship. Jeremy Pate, Director of Current Planning, stated that the two omitted parks are tied up in foreclosure. No public comment was received. Motion: Commissioner Myres made a motion to forward the request to City Council with a recommendation of approval with conditions as stated. Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. All business being concluded, the meeting was adjourned at 6:38 PM.
