NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section l : That the City Council of the City of Fayetteville, Arkansas hereby amends § 161 .26 District P-1 Institutional (B) Uses. ( 1 ) Permitted Uses, by adding and inserting Use Unit 5 : Government Facilities as the third use by right in P- 1 zones as shown on Exhibit A attached. Date: October 11 , 2007 Subject: An ordinance to amend Chapter 161 : Zoning Regulations, Section 161 .26 (13)( 1 ) District P- 1 Institutional, of the UDC to add Use Unit 5 Government Facilities as a permitted use within the P- 1 zoning district (ADM 07-2762). RECOMMENDATION Planning Staff and the Planning Commission recommend approval of an ordinance amending Section 161 .26 (13)( 1 ) District P- 1 Institutional, of the UDC to add Use Unit 5 Government Facilities as a permitted use within the P- 1 zoning district. BACKGROUND The City Council recently amended Chapter 162 of the UDC to remove duplicate references of uses within several use units. Staff has recently discovered the need to add Use Unit 5 Government Facilities to the P- 1 Zoning District. The P- 1 zoning district designation is "designed to protect and facilitate use of property owned by larger public institutions and church related organizations." The description of Use Unit 5 is to allow main facilities of government agencies and permits the following uses: city or county jail, courts of law, fire station governmental agencies and offices, library, police station, post office, and detention home. DISCUSSION On October 8, 2007 the Planning Commission voted 6-0-0 in favor of forwarding this amendment to the City Council. BUDGET IMPACT None.
