HomeMy WebLinkAboutOrdinance 5065 Y ORDINANCE NO, SQ65 AN ORDINANCE WAIVING THE REQUIREMENTS OF §34.23, (PURCHASES AND CONTRACTS NOT IN EXCESS OF $20000.00), OF THE FAYETTEVILLE CODE OF ORDINANCES AND APPROVING A CONTRACT WITH THE ILLINOIS RIVER WATERSHED PARTNERSHIP (IRWP) IN THE AMOUNT OF $ 109000.00 FOR WATERSHED EDUCATION AND PLANNING SERVICES. WHEREAS, the Illinois River Watershed Partnership (IRWP) possesses unique expertise and resources ideally suited to meet the City of Fayetteville's need for Watershed Education and Planning Services as part of the Stormwater Management Program, Phase II; and WHEREAS, the Illinois River Watershed Partnership (IRWP) can perform this work at a significant savings to the citizens of Fayetteville. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby waives the requirements of §34.23, (Purchases and Contracts Not in Excess of $20,000.00), of the Fayetteville Code of Ordinances and approves a contract with the Illinois River Watershed Partnership (IRWP) in the amount of $ 10,000.00 for watershed education and planning services, and authorizes Mayor Coody to execute this contract. WHEREAS, The Illinois River Watershed Partnership, Inc. is a non-profit corporation whose mission is to improve the health of the Illinois River through the implementation of best management practices, water quality monitoring, public education, community outreach and ecosystem restoration; and WHEREAS, The City of Fayetteville has responsibilities to educate its citizens about these water quality and restoration issues through mandates of the Clean Water Act and has budgeted funds for such education activities. NOW, THEREFORE, the Illinois River Watershed Partnership and the City of Fayetteville agree as follows: 1 . The City of Fayetteville agrees to purchase educational, ecosystem monitoring and restoration, and community outreach services for its citizens from the Illinois River Watershed Partnership, Inc. for the sum of Ten Thousand Dollars ($ 10,000.00). 2. The Illinois River Watershed Partnership agrees to furnish a year long, extensive community outreach and educational services program to Fayetteville's citizens during the period of October 2, 2007 through October 1 , 2008, and further to provide implementation of and education about best management practices for stormwater management and ecosystem restoration in the Illinois River watershed. 3. The Illinois River Watershed Partnership agrees to provide two semi-annual written reports about its programs and activities to the Fayetteville City Council with the first report due on April 8, 2008, and the second due on September 30, 2008 . BACKGROUND According to their website, the Illinois River Watershed Partnership (IRWP) formed when "a diverse group of Northwest Arkansas leaders organized an Upper Illinois River Summit in September 2005 with 65 watershed stakeholders committing to personal action and agreeing that public education is the number one priority to improve and protect water quality in the Illinois River." The IRWP officially formed in December 2005 as a non-profit organization with a board that is representative of the various stakeholders in the watershed including government, business, agriculture, conservation, construction/development, and academia. The organization has a number of objectives including: • Increase public awareness of the Illinois River as a water resource Cooperate with the scientific community to identify water quality impacts, causes and sources Educate the public about their contribution to these sources • Collaboratively identify environmentally viable and economically feasible practices to effectively control those sources • Work with the membership and the general public to implement water quality improvement and watershed restoration projects that will reduce these identified sources The Board has also established a number of goals that will enable them to achieve their long- s. term vision which is, "the Illinois River and its tributaries will be a fully functioning ecosystem, where ecological protection, conservation and economically productive uses support diverse aquatic and riparian communities, meet all state and federal water quality standards, promote economic sustainability and provide recreational opportunities." The group' s stated goals include: • Develop a comprehensive educational program that will increase public awareness of the Illinois River as a water resource and a general membership • The Illinois River Watershed Partnership's ultimate goal is to develop, implement and complement a watershed management plan for the entire Illinois River Basin • The goal of watershed management is to plan and work toward an environmentally and economically healthy watershed that benefits all stakeholders • Engages stakeholders in activities to implement water quality improvement and watershed restoration in projects that will reduce identified sources DISCUSSION Over the last year the IRWP has implemented and is currently maintaining an ongoing education campaign in the watershed which has spillover effects for other watersheds in the media market. The Partnership is currently in negotiations with TetraTech, Inc. to finalize a scope of work and contract for Phase I of a watershed management plan for the Upper Illinois River (Arkansas only). A large portion of the City of Fayetteville contributes storm water flows into the Illinois River Watershed including Clear Creek, Hamestring Creek, and Owl Creek. The City of Fayetteville stands to receive great benefit from the watershed education campaign and the watershed management process. This would be the second year the City entered into contract with the IRWP. The last contract was also for $ 10,000 for watershed education and planning services. BUDGET IMPACT The City of Fayetteville currently has $320,426 remaining that has been allocated for the phase II r Storm Water Management Program for these types of projects. ORDINANCE NO.
