AN ORDINANCE AMENDING CHAPTER 177, LANDSCAPE
REGULATIONS, OF THE UNIFIED DEVELOPMENT CODE TO
REQUIRE MINIMUM WIDTH OF TREE WELLS TO BE 3 FEET
AND MINIMUM AREA OF 15 SQUARE FEET WHEN
UTILIZING URBAN TREE WELLS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 : That Chapter 177.05 (B)(3): Landscape Regulations, of the Code of
Fayetteville, is hereby amended to read as follows:
177.05 Street Tree Planting Standards
(B)(3) Street Tree Planting Plan Requirements for Urban
Streetscapes.
c) Trees shall be planted within urban tree
wells. The minimum width of an urban tree
well shall be three feet (3 '); the minimum area
shall be 15 square feet. This option is only
permitted to allow trees planted within wide
sidewalks, in a downtown/urban fashion. Size
and shape of urban tree well shall be approved
by the Urban Forester.

RECOMMENDATION
Planning Staff and the Urban Forester recommend approval of an ordinance amending
the Unified Development Code, Ch. 177 Landscape Regulations, which would revise the
size of the required width of an urban tree well.
BACKGROUND
The City Council on September 05, 2006 adopted Ordinance No. 4917, which created
Chapter 177, Landscape Regulations, a consolidated landscape code. One of the new
proposals adopted in this ordinance was to address the planting of trees within urban
conditions, specifically where buildings are adjacent to a wider sidewalk, which is
adjacent to the street, much like Downtown Fayetteville is developed today. In the initial
code, staff recommended the minimum width of the tree well to be four-foot, with a
minimum area of 16 square feet. This requirement would not allow for grates of a
different shape, such as rectangle. Staff finds that there are situations where a grate of a
different shape would be beneficial for pedestrian access and/or aesthetics. It is the
recommendation of staff that Chapter 177 be amended to require a minimum width of a
tree well to be three-foot, with a minimum area of 15 square feet. This would allow tree
wells at a minimum to measure three by five feet, four by four feet, or larger. The Urban
Forester is in support of this amendment finding that adequate surface area will still he
provided for the tree and finding that the area of structural soil would not be affected.
The size and shape of the urban tree well would be assessed with every development and
a recommendation by the Urban Forster will be made for the appropriate specification in
that area.
DISCUSSION
City Council approval of an ordinance amendment to Chapter 177 of the Unified
Development Code, Landscape Regulations, on the minimum width and square footage
of an urban tree well.

177.05 Street Tree Planting Standards
(B)
(3) Street Tree Planting Plan Requirements for Urban Streetscapes. Submittals for all proposed
developments that incorporate an urban streetscape, in which wide (eight feet or greater)
pedestrian sidewalks are adjacent to the curb and building replace those development
patterns mentioned above, shall include a street tree planting plan at the time of
development submittal.
(a) A minimum of one (1 ) two-inch caliper, large species tree per 30 linear feet of
street frontage or every 10 parking spaces, whichever provides the most trees,
shall be planted with this option.
(b) Location of trees shall be approved by the Urban Forester to ensure adequate
spacing, access and visibility is maintained. To meet this goal for the public
health, safety and welfare, the spacing of trees may be varied with approval of
the Urban Forester.
(c) Trees shall be planted within urban tree wells. The minimum width of an urban
tree well shall be tear feeE (4) three feet (T); the minimum area shall be X15
square feet. This option is only permitted to allow trees planted within wide
sidewalks, in a downtown/urban fashion. ,Size and shape of urban tree well shall
be approved by the Urban_Forester.
(d) Tree wells shall be covered with either a tree grate or some form of permeable
pavers, (brick or stone), to be approved by the Urban Forester.
(e) Structural soil or similar treatment shall be utilized with this option (see
Landscape Manual for specifications).
(f) Street tree planting plans utilizing this option shall follow the construction
procedures and details as outlined in the Landscape Manual.
(g) Development applications approved for the use of Urban Tree Wells shall not be
required to also provide the landscape area exclusive of the right-of-way.

FEET AND MINIMUM AREA TO BE FIFTEEN SQUARE FEET
WHEN UTILIZING URBAN TREE WELLS .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 : That § 177.05 (B)(3) : Landscape Regulations, of the Code of Fayetteville, is
hereby repealed in its entirety and a new § 177.05 (B)(3) is hereby enacted in its stead as follows:
§177.05 Street Tree Planting Standards
"(13)(3) Street Tree Planting Plan Requirements for Urban Streetscapes.
(c) Trees shall be planted within urban tree wells. The minimum width ofan urban
tree well shall be three feet; the minimum area shall be fifteen square feet. This option is only
permitted to allow trees planted within wide sidewalks, in a downtown/urban fashion. Size and shape
of urban tree well shall be approved by the Urban Forester. "
