AN ORDINANCE VACATING AN ELECTRICAL UTILITY
EASEMENT AND GRANTING A REPLACEMENT
EASEMENT AT SWEETBRIAR PARK.
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate
public grounds or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of the
platted utility easement is not required for corporate purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby vacates and
abandons the following described electrical utility easement: U

Section 2: That the City Council of the City of Fayetteville, Arkansas hereby accepts as a
replacement easement the following described electrical utility easement:

easement is relinquished, abandoned, or Vacated and so long as such electrical power line(s) are maintained, together with
free ingress to and egress from the real estate first hereinabove described for the uses and purposes hereinabove set forth.
Grantee shall further have the right to cut, trim and control,' within said easement, the growth of trees and other vegetation
that may interfere with or threaten to endanger the operation and maintenance of said line or system. The undersigned
Grantor hereby covenants that it is lawfully seized of said lands and will forever warrant and defend the title to said lands
against all legal claims whatsoever. ,: , E,
The said Grantor is to fully use'and enjoy the'said.premises except for the purposes hereinbefore granted to the said
Grantee, which hereby agrees to bury all lines and/or cables, where feasible, to a sufficient depth so as not to interfere with
cultivation of soil, and that above ground appurtenances will be constructed flush with the surface of the ground except in
bottom lands where they shall be at a height above high water.
The Grantor agrees not to erect any buildings or structures in said permanent easement.
The Grantee shall have the right to construct additional electrical power lines upon the above described easement at
any time in the future and agrees to pay any damages as a result of such future construction as set out in this easement.
The consideration first above recited as being paid to Grantor by Grantee is in full satisfaction of every right hereby
granted. All covenants and agreements herein contained shall extend to and be binding upon the respective heirs, legal
representatives, successors and assigns of the parties hereto.
It is hereby understood and agreed that the parry securing this document in behalf of the Grantee is without authority
to make any covenant or agreement not herein expressed.

Subject: Approval of an ordinance to vacate an electrical utility easement and
grant a replacement easement at Sweetbriar Park.
RECOMMENDATION
Ordinance approving the vacation of an electrical utility easement and granting of a
replacement easement at Sweetbriar Park.
BACKGROUND
Sweetbriar Park is located on Sweetbriar Drive east of Old Wire Road and south of
Paradise Valley Golf Course. Mud Creek runs through this four acre park. There are
several existing easements in the park including electrical, drainage, water and sewer.
The 15 foot wide electrical utility easement contains high voltage underground electrical
lines encased in a conduit that runs adjacent to Mud Creek in the park. Over the years, the
creek embankment has eroded causing the underground electrical supply conduit to be
exposed.
DISCUSSION
This exposed electrical line constitutes a public hazard. Ozarks Electric has requested a
reconfiguration of the existing easement so that these lines can be properly bored and
buried. Ozarks Electric has fenced off this area from the public. The proposed
reconfiguration would effectively create a more linear easement and allow for proper and
safe burial of this line. Locations of the current and replacement easements are included
on the attached easement graphic. Also attached is a memo from Gregg McGee with
Ozarks Electric describing the hazardous nature of this situation and the urgency for City
Council to consider this item at the August 2151 meeting. If approved, the ordinance
needs to become effective immediately in order to properly take care of this issue.

Mr. Coles,
Ozarks Electric has an immediate need to resolve an erosion problem at Mud
Creek that has exposed Ozarks Electric's underground electric lines. Although
this line is protected by duct and should not expose the general public to
immediate danger, it is conceivable that this could easily become a hazard. Over
the past thirteen years the creek has gradually shifted to the west approximately
twenty five feet, which has taken a portion of the easement that the City of
Fayetteville granted us May 3, 1994. This is obviously posing safety concerns
that we need to get resolved immediately. Unfortunately this line is the only
robust feed for this residential area to carry summer peaking loads.
To complicating the matter even more, this line has been damaged by
contractors installing a concrete water valve at the edge of our easement. As a
result, the area around Sweetbriar Subdivision is now being feed from a circuit
that has marginal capacity to feed these residential subdivisions. We are very
concerned that if this situation is not remedied in the very short term, extended
outages could potentially result.
In order to make repairs on the damaged line and resolve the exposed electric
lines in the Mud Creek, it is imperative that Ozarks Electric be granted a revision
on our existing easement, The revised easement will be less obtrusive to the
property because it is at the east property boundary. The current easement that
we propose to vacate runs along the center of this parcel.
We request that this easement modification be given immediate consideration so
that public safety and electrical reliability can be maintained for these City of
Fayetteville citizens.
