HomeMy WebLinkAboutOrdinance 5044 ORDINANCE NO. 5044 AN ORDINANCE AMENDING TITLE XV: UNIFIED DEVELOPMENT CODE OF THE CODE OF FAYETTEVILLE TO AMEND CHAPTER 171 : STREETS AND SIDEWALKS AND CHAPTER 172: PARKING AND LOADING IN ORDER TO REDUCE THE REQUIRED DRIVEWAY WIDTHS AND REGULATE PARKING IN THE FRONT YARD AREA OF RESIDENTIAL DWELLING UNITS. WHEREAS, the City of Fayetteville recognizes that currently required driveway widths are often excessive, especially in areas of the City with compact and connected development patterns; and WHEREAS, the City of Fayetteville has determined that the public safety will not be adversely impacted by reducing the required width of driveways serving small parking lots with low traffic volume; and WHEREAS, the City of Fayetteville has determined that when public service vehicles do not need access to small parking lots, reduced driveway widths can accommodate typical vehicular traffic; and WHEREAS, City Plan 2025 encourages complete, compact and connected development patterns; and WHEREAS, narrow pavement width reduces impervious surface and storm water run- off, which is environmentally sensitive; and WHEREAS, parking in the front yard area of residential dwelling units can be appropriate with adequate regulations. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That Chapter 171 Streets and Sidewalks is amended by repealing § I71 . 13(B)(6) with following sections to be renumbered as necessary. Section 2. That Chapter 172 Parking and Loading is amended by repealing § 172.04(D)(2), and enacting a replacement § 172.04(D)(2) a copy of which marked Exhibit "A" is attached hereto and made a part hereof. RECOMMENDATION The Ordinance Review Committee voted to send the proposed ordinance without a recommendation to the full Council to amend the Unified Development Code to reduce the required curb radius and driveway widths for parking lots containing 8 or fewer parking spaces and regulating parking in the front yard area of a residential dwelling. BACKGROUND Existing UDC regulations concerning driveway curb radius and driveway widths are primarily designed to facilitate unrestricted traffic movements into parking areas without regard to the size of the parking lot or the amount of traffic volume likely to be generated by the development. Planning Staff has determined that this requirement in some instances is unnecessary and counterproductive to creating compact, complete and connected development patterns and locating parking behind existing buildings. Staff has drafted amendments that would create new standards for parking lots with 8 or less off- street parking spaces. The City also receives numerous complaints related to the parking of several vehicles in the front yards of residences. Planning Staff proposes adding a new section to Chapter 172 : Parking and Loading to regulate the number (4 spaces maximum) and location of vehicles parking in the front yard area of residential dwellings.
