AN ORDINANCE TO WAIVE THE ONE YEAR
EXPIRATION OF THE PRELIMINARY PLAT
APPROVED FOR LEGACY POINTE PHASE 5
AND TO GRANT A ONE YEAR EXTENSION
WHEREAS, § 166.20 of the Unified Development Code allows for extensions of
preliminary plats prior to their normal expiration after one year; and
WHEREAS, Legacy Pointe Phase 5 was not able to complete all of its infrastructure
prior to the first year period and failed to timely request an extension from the Planning
Commission; and
WHEREAS, it would be unduly costly in time as well as developer's employees and City
Staff work hours to require the developers to resubmit a new (and identical) Preliminary Plat and
go through the entire approval process again.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby waives the
requirement of § 166.20 of the U.D.C. concerning completion of the Preliminary Plat
requirements within one year or request to the Planning Commission for an extension within this
year period which expired on May 26, 2007, and determines that good cause exists to grant a one
year extension of the existing Preliminary Plat, PPL 06-2054, Legacy Pointe Phase 5, as if the
request had been submitted timely to the Planning Commission.
PASSED and APPROVED this 3rd day of July, 2007.
