HomeMy WebLinkAboutOrdinance 5023 ORDINANCE NO, 5023 AN ORDINANCE TO REPEAL §33 . 111 OF THE FAYETTEVILLE CODE, TO ENACT A REPLACEMENT §33 . 111 REMOVAL OF PLANNING COMMISSIONERS, AND TO ENACT A NEW SUBSECTION (C) IN §33 .018 PARKS AND RECREATION ADVISORY BOARD WHEREAS, the previous requirement of courteous behavior and familiarity with staff reports should be reenacted into the Fayetteville Code; and WHEREAS, the provision requiring 70% attendance of regular Park and Recreation Advisory Board meetings should be moved to §33 .018 Parks and Recreation Advisory Board rather than remain located within the code sections dealing with the Planning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby repeals §33 . 111 Attendance Requirement for Members of the Parks and Recreation Advisory Board and Planning Commission in its entirety and enacts a replacement §33. 111 Removal of Planning Commissioners as attached as Exhibit A. Section 2 : That the City Council of the City of Fayetteville, Arkansas hereby enacts subsection 33 .018 (C) Attendance requirements for members of the Parks and Recreation Advisory Board as shown below: "(C) Attendance requirements for members of the Parks and Recreation Advisory Board. 1 . Any members of the Parks and Recreation Advisory Board who fails to attend at least 70% of all meetings (regularly scheduled and specially called) within the member's yearly periods of service shall immediately tender his or her letter of resignation and that position shall be deemed vacant." "2. Any board member who has been required to tender a letter of resignation may present extenuating circumstances within the letter of resignation and request that the resignation not be accepted by the City Council. If the letter of resignation is not accepted by the City Council, the position shall not be deemed vacant and the member shall be reinstated to complete the normal term of appointment." By a vote of two-thirds of the City Council, any Planning Commissioner may be removed from the office for cause. Cause shall include, but not be limited to, the following: (A) Chronic discourteous behavior to other commissioners, staff, or members -of the public. ?„ (B) Ongoing lack of .familiarity with staff- prepared material. (C) Any member of the Planning Commission who fails to attend at least 70% of all meetings (regularly scheduled and specially called) within the member's yearly periods of service shall immediately tender his or her letter of resignation and that position shall be deemed vacant. (D) Any commission member who has been required to tender a letter of resignation may present extenuating circumstances within the letter of resignation and request that the resignation not be accepted by the City Council. If the letter of resignation is not accepted by the City Council, the position shall not be deemed vacant and the member shall be reinstated to complete the normal term of appointment. (E) Planning Commissioners must attend at least 60% of Agenda setting sessions and tours unless that commissioner is currently on the Subdivision Committee. If job requirements do not permit • a member to attend agenda meetings or tours prior to 5:00 P.M., the meetings and tours will be scheduled for after normal working hours or such member shall be excused from the requirements of attending the agenda meetings and tours. (F) Planning Commissioners shall serve on the Subdivision Committee for one-third of their service on the Planning Commission when requested by the Chairman of the Planning Commission. (G) During the second quarter of each year, Planning Staff shall designate and all Planning Commissioners shall attend one evening training and review session to ensure the legal and proper functioning of the Planning Commission.
