RECOMMENDATION
Planning Staff and the Urban Forester recommend approval of an ordinance amending
the Unified Development Code, Ch. 177 Landscape Regulations, which would revise the
width of sidewalk required from 10 feet in width to eight feet in width when utilized with
Urban Tree Wells.
BACKGROUND
The City Council on September 05, 2006 adopted Ordinance No. 4917, which created
Chapter 177, Landscape Regulations, a consolidated landscape code. One of the new
proposals adopted in this ordinance was to address the planting of trees within urban
conditions, specifically where buildings are adjacent to a wider sidewalk, which is
adjacent to the street, much like Downtown Fayetteville is developed today. In the initial
code, staff recommended minimum 10-foot sidewalks to accommodate both urban tree
wells (specifically designed tree pits with amended, structural soil and tree grates) and
adequate sidewalk clearance for passersby. In a review of accessible clearance
requirements and the application of this regulation to several projects, it has become
apparent that 10 feet of sidewalk is not necessary in most situations. Consequently, the
Planning Commission has reviewed and approved several variances from that
requirement. Staff recommends reducing this minimum width to eight feet„which allows:
for the four-foot tree grate and four feet of free and clear sidewalk width; A.D.A. requires
only three feet, however staff finds four feet to be more accommodating to a higher
density of pedestrian traffic, and specifically to those with disabilities. This would reduce
the amount of variances being requested, and enable development to occur that also
meets the needs of pedestrians.
DISCUSSION
The Planning Commission voted unanimously to forward this ordinance amendment to
the City Council with a recommendation for approval on March 12, 2007.

AN ORDINANCE AMENDING CHAPTER 177, LANDSCAPE

REGULATIONS, OF THE UNIFIED DEVELOPMENT CODE TO
REQUIRE MINIMUM EIGHT-FOOT WIDE SIDEWALKS WHEN
UTILIZED IN CONJUNCTION WITH URBAN TREE WELLS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That Chapter 177.05 (13)(3): Landscape Regulations, of the Code of Fayetteville, is hereby
repealed, and the following is inserted in its stead:
177.05 Street Tree Planting Standards
(B)(3) . Optional Street Tree Planting Plan for Urban Streetscapes.
"The Street Tree Planting Plans of subsections ( 1 ) and (2) may be replaced by an urban streetscape
including sidewalks at least eight feet wide from curb to building. At the time of developmental submittal, the
proposed urban streetscape shall include a street tree planting plan in compliance with the following
requirements:
"(a) A minimum of one ( ] ) two-inch caliper, large species tree per 30 linear feet of street frontage
or every 10 parking spaces, whichever provides the most trees, shall be planted with this
option.
"(b) Location of trees shall be approved by the Urban Forester to ensure that adequate spacing,
access and visibility are maintained. The spacing of trees may be varied with approval of the
Urban Forester.
"(c) Trees shall be planted within urban tree wells. The minimum width of an urban tree well shall
be four feet (4'); the minimum area shall be 16 square feet. Four feet of unobstructed sidewalk
shall be maintained. This option is only permitted to allow trees to be planted within wide
sidewalks in a downtown/urban fashion .
"(d) Tree wells shall be covered with either a tree grate or some form of permeable pavers, (block
or stone), to be approved by the Urban Forester.
"(e) Structural soil or similar treatment shall be utilized with this option (see Landscape Manual
for specifications).
"(1) Street tree planting plans utilizing this option shall follow the construction procedures and
details as outlined in the Landscape Manual.
"(g) Development applications approved for the use of Urban Tree Wells shall not be required to
provide additional landscaped area exclusive of the right-of-way."

(3) Street Tree Planting Plan Requirements for Urban Streetscapes. Submittals for all proposed
developments that incorporate an urban streetscape, in which wide (Ogjight feet or greater)
pedestrian sidewalks are adjacent to the curb and building replace those development
patterns mentioned above, shall include a street tree planting plan at the time of
development submittal.
(a) A minimum of one (1 ) two-inch caliper, large species tree per 30 linear feet of
street frontage or every 10 parking spaces, whichever provides the most trees,
shall be planted with this option.
(b) Location of trees shall be approved by the Urban Forester to ensure adequate

health, safety and welfare, the spacing of trees may be varied with approval of
the Urban Forester.

Chapter 377.05 (B) Landscape Regulation of the Unified Development Code addresses a
minimum sidewalk width when utilizing urban tree wells. This width is currently defined as
io feet. Many of our urban designs will be utilizing this new street tree option. Staff
requests to amend the current Chapter to allow for the minimum to be 8 feet in width. This
smaller sidewalk is more commonly used and would still allow for adequate tree growth and
pedestrian traffic.
Clarification is also needed for the typical 15-25 foot greenspace requirement adjacent to
right of way. An additional letter (g) would be added to clear any confusion on the issue.
When utilizing the Urban Streetscape option for Street Tree Standards, :an additional
amount of greenspace would not be required. It is our intent to have. a wide sidewalk
adjacent to the curb and building to allow for frontage closer to the street.

This option is only available after approval from the Urban Forester. To ensure the health
of the tree, several requirements need to be met when placing trees in urban plantings:
> structural soil shall be used
> the bottom of the well should be open to allow the root system to develop
> the well should be a minimum 4' x 4' or 6' x 6'
> trees should be planted so as the root ball is even with the bottom of the paving
> before the grates are placed, 3-4 inches of mulch must be filled in above the tree
> the tree grate design chosen shall allow for expansion of the tree and have 1/4 inch
slot openings to discourage trash from falling underneath-contact Urban Forester
> irrigation is required either in the form of drippers or a hose bib within ioo' O.C.
Below is an example of the planting specifications for tree wells. A similar type diagram
would need to be included on the landscape plan and construction plans for the Urban
Forester to review.

Structural Soil
Structural soil was first developed by Cornell University. This mixture allows engineers to
get the compaction required for sidewalks, roadways, and/or parking lots but still allows
porosity for tree roots. Using structural soil in plantings minimizes if not eliminates the
problems trees in urban conditions face with compaction and lack of planting space. It is
important that the ratio of these two components is correct otherwise the product will not
work as designed. Structural soil must be obtained from a licensed and qualified producer
to ensure quality control. Preferably the soil should be used to a depth of 34 inches below
the surface and should extend as far as allowable. Because of the unique compactable
capability the soil can be used from the fronts of business all the way to the curb line. The
more area you allow for the expansion of roots the better quality of street tree you will
obtain. Irrigation, like in all landscaped beds, is very important. The amount of space in
these pits that will allow water to infiltrate is minimal. With the heat and pollution found in
urban conditions these trees need ample water to maintain a healthy canopy. A 3-4 inch.
layer of mulch should also be utilized if grates are being used. The mulch will help hold in
moisture for the tree and discourage weeds from sprouting.
