Section 2. That the approvals and conditions for R-PZD 05- 1797 (Bungalows at Cato Springs) as passed and approved by the City Council on December 20, 2005 with Ordinance No. 4809 shall be modified with the revisions to the Master Development Plan and project booklet as described and depicted herein (Exhibit "A"), and to include the following additional condition of approval: • The Bungalows at Cato Springs shall be limited to a maximum of 31 single family lots and residential units. Section 3. That this ordinance shall take effect and be in full force at such time as all of the requirements of the Planned Zoning District have been met. Section 4. That the Planned Zoning District ordinance and official zoning map of the City of Fayetteville, Arkansas, is hereby amended to reflect the zoning change provided in Section 1 above. BACKGROUND The approved PZD for Bungalows at Cato Springs (R-PZD 05- 1797) is a single-family development on 5.52 acres located on the north side of Cato Springs Road, west of Cline Avenue. The City Council approved this PZD on December 12, 2005 for zoning and land use approval only. The PZD concept depicted a cul-de-sac along the northern border of the property, although there was a condition that connectivity to the north would be evaluated at the time of development. The preliminary plat (PPL 06-2011 ) for development on the site was approved by the Planning Commission on May 8, 2006. As part of this approval the cul-de-sac was required to be removed and replaced with a street stub-out. The stub-out eliminated Planning Area 1 which included lots around the cul-de- sac. As a result of this change the applicant proposes minor modifications to the Master Development Plan and zoning criteria. The changes include removing Planning Area 1 and associated zoning criteria around the original cul-de-sac area, and extending the surrounding Planning Areas (PA-2 and PA-3) to the northern border of the site. The zoning criteria change would result in a slight increase in the number of smaller lots. The total number of lots would remain at 31 , the same number of lots approved by the Planning Commission as part of the preliminary plat. Exhibits and modified zoning criteria are attached to this report depicting the proposed changes. BUDGET IMPACT None. The original PZD Master Development Plan anticipated the termination of the Central Entry Drive in a cul-de-sac surrounded by larger lots. These larger lots being located within Planning Area I (PA -1). During the preliminary plat process, it was determined that a street stub -out to the north would be a requirement of approval of the subdivision —thus removing the cul-de-sac and associated PA -1. This request, if approved, will allow both the extension of PA -2 and PA -3 to follow the Central Entry Drive to the northern property line and Lot 17 to be divided into two lots. As recently approved by the City Council, an applicant has the option of presenting a Master Development Plan — Planned Zoning District without development -level plans. This action would effectively rezone the property based on the conceptual plans and information provided. However, it does not give development approval. The applicant is required to return through the preliminary plat process in order for the Planning Commission to confirm that the development plans presented are compliant with the zoning and Master Development Plans approved by the City Council. Detention shall be provided to meet City of Fayetteville requirements, unless at the time of development the City Engineer approves otherwise, in accordance with City ordinance and policy. 7. Parkland dedication requirements shall be met at the time of development. This may include dedication of land, fees -in -lieu, or a combination thereof. 8. Public water and sewer lines shall be extended as required by city ordinance at the time of development. 9. All overhead electric lines 12kv.and under shall be relocated underground. All proposed utilities shall be located underground. 10. Development on the subject property shall comply with City Fayetteville ordinances at the time of submittal of development plans. 11. The western 1.5 acres proposed to be dedicated to the City as park/trail, should be designated as a separate planning area (PA -4), with appropriate zoning criteria for the anticipated park and recreational uses (Use Units 1, 3, and 4). 12. Building separation shall meet all applicable building codes, and may result in a greater separation requirement than the proposed minimum five feet. 13. Screening or natural vegetation shall be provided along the west and east property lines to reduce the impact of the alley and parking areas on adjacent properties. Specific screening will be recommended at the time of development. 14. Rear setbacks along public alleys shall be measured from the centerline of the alley; based on the plans provided, and a 25' rear setback from centerline of the public alley appears to be adequate. Please address the plats/booklet accordingly. 15. Tree preservation plans shall be submitted at the time of development meeting city of Fayetteville criteria. The minimum percent canopy for PZDs is 25%. Staff calls attention to the fact that while conceptually the Master Plan presented meets the goals and intent of the Master Development Plan PZD, much of the interior canopy is being removed if submitted as currently proposed, and would not meet with staffs approval. Further, the applicant noted in the booklet that the majority of tree preservation areas would be located in the 1.5 -acre preservation/trail area proposed to be dedicated to the City as parkland. Parkland cannot count as preserved tree canopy per City ordinance.
