AN ORDINANCE AMENDING CHAPTER 51 , WATER AND
SEWERS, OF THE CODE OF FAYETTEVILLE, TO ADJUST
MONTHLY SEWER RATES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 . That § 51 . 137(A)( 1 ), Table E-1, Code of Fayetteville is hereby repeated, and the
following is inserted in its stead:
51 .137 Monthly Sewer Rates
(A) Monthly sewer rates. All monthly sewer charges shall be calculated from the customer's monthly water usage.
The following monthly rates are hereby fixed as rates to be charged for sewer services:

RECOMMENDATION
City Administration recommends approval of an ordinance changing the volume based rates for sewer
service for customers outside the City of Fayetteville from $7. 16/ 1 ,000 gallons to $4.66/1 ,000 gallons,
and an announcement of a public hearing discussing this rate change on April 3, 2007, during the City
Council meeting.
BACKGROUND
The City of Fayetteville, based on agreements with Farmington and Greenland, and in accordance with
applicable state codes and industry standards, establishes rates based on the cost of service. For rates
outside of the city limits of Fayetteville, these rates include a provision for a return on investment. In
2003, Black and Veatch conducted a rate study for the City of Fayetteville that established the rate
structure that was enacted at that time and is in place today.
State codes dictate a schedule and sequence of events for any change in sewer rates. These require that
the rate change ordinance be read, a public hearing be scheduled and announced, the ordinance be
published, and the public hearing take place at least ten days after the initial reading and publication of
the ordinance. The rate ordinance can be approved any time after the public hearing.
Farmington and Greenland have established additional sewer charges of $0. 17/ 1 ,000 gallons and
$0.40/ 1 ,000 gallons respectively for sewer service in their cities. These funds are remitted to the
respective cities, and are independent of this change in sewer rates.
DISCUSSION
Contract negotiations with the City of Farmington included discussion of sewer rates for customers in
that City. Through agreement between the negotiating teams from both Cities, the volume based sewer
rates for customers outside the City of Fayetteville are being changed from the current rate of $7. 16 per
1 ,000 gallons to a rate of $4.66 per 1 ,000 gallons. Only volume based rates will be changed; the
monthly sewer service charge based on meter size shall remain the same. This rate change has no
impact on customers inside the City of Fayetteville.
BUDGETIMPACT
This rate change will not result in any increased costs to the City of Fayetteville. It will result in a
reduction of approximately $330,000 From budgeted revenues for 2007.
