RECOMMENDATION
The Planning Commission recommended in favor of rezoning the subject property of
approximately 1 .5 acres, located west of Genevieve Street, from R-A to RSF-4.
BACKGROUND
The subject property contains approximately 1 .5 acres and is located west of Genevieve
Street and Sundance Meadows Subdivision. The property is zoned R-A, Residential
Agricultural, and is developed for one duplex. In 1982, property from Rupple Road to
Double Springs Road was annexed into the City of Fayetteville. The property was zoned
R-A, and through time individual parcels of land have been rezoned and developed into
residential subdivisions, such as Sundance Meadows and Legacy Pointe. The subject
property and surrounding property have remained R-A though the lot sizes and uses do
not conform to the requirements of this zoning district.
The applicant proposes that the property be rezoned from R-A to RSF-4. Rezoning the
property will bring the lot into compliance, but the existing duplex will remain a
nonconforming use until a conditional use permit is approved to allow a two-family
dwelling on the lot. A higher density zoning district such as RT- 12 or RMF-6 would
permit the duplex by.right, but a single-family zoning district would be more. appropriate _
in this location.
DISCUSSION
This item was heard at the regular Planning Commission on December 11 , 2006. The
Planning Commission voted 8-0-0 to recommend approval of this rezoning request to the
City Council.

BACKGROUND:
Property description: The subject property contains approximately 1 .5 acres. The property is
located west of Genevieve Street and Sundance Meadows Subdivision. The property is zoned.R-.:
A. Residential Agricultural, and is developed for one duplex. With 1 .5 acres of lot area and
approximately 241 ' of lot width, the property does not conform to the bulk and area requirements
of the R-A zoning district (see Table 1 ). In 1982, property from Rupple Road to Double Springs
Road was annexed into the City of Fayetteville. The property was zoned R-A, and through time,
individual parcels of land have been rezoned and developed into subdivisions. The subject
property and surrounding property have remained R-A though the lot sizes and uses do not
conform to the requirements of this zoning district.
Proposal: The applicant proposes that the property be rezoned from R-A to RSF-4. Although the
rezoning will bring the lot into compliance, the duplex will remain a nonconfdrming use until a
conditional use permit is approved to allow a two-family dwelling on the lot. A higher density

zoning district (RT- 12 or RMF) would permit the duplex by right. The applicant has met with staff
on several occasions and determined that a single-family zoning district would be more appropriate
in this location. After receiving rezoning approval, it is the applicant's intent to subdivide the
property into three or four lots, including one or two tandem lots, and obtain conditional use permit
approval for the existing duplex and an additional duplex. This application, however, is only for
consideration of rezoning the property from R-A to RSF-4 and not development approval.
Recommendation: Staff recommends approval of the rezoning request. Future changes or
additional development on this site will be regulated by the city allowing for a uniform and
consistent development pattern.

INFRASTRUCTURE:
Streets: The site has access to Genevieve Street. Genevieve. Street is an unimproved 2-
lane roadway in this location. Improvements to the adjacent streets will be
evaluated at the time of development.
Water: Public water is located adjacent to the site. There is a 2" waterline along
Genevieve. Water service will need to be upgraded, to the property at the time .of.
development.
Sewer: Sanitary sewer is available adjacent to the site. There is a 6" sewer main along
Genevieve Street. Improvements to the sewer system may be required dependent
upon the demand placed by the development. The capacity of the existing main
will need to be studied at the time of development. This property is located in the
Hamestring Creek lift station drainage basin.
Drainage: Standard improvements and requirements for drainage will be required for the
development.

Fire:
• These 1 .5 acres is covered by Engine 7 at 835 Rupple Road.
• It is 2. 1 miles from the station with an expected response time of 5.25 minutes.
The Fire Department anticipates 1 (1 EMS — 0 Fire/Other) calls for service per year
once the development is completed and maximum build-out has occurred.
• There is no Measured Hydrant Flow recorded in this area.
• The service impact of this development will typically take eighteen months after the
development is started, and the units begin to be occupied, to occur.
• There should be no adverse effects on our call volume or response time to this
development.
Police: It is the opinion of the Fayetteville Police Department that this rezoning will not
substantially alter the population density or create an undesirable increase in the
load on police services. The rezoning will not create an appreciable increase in
traffic danger and congestion.
INTERIM FUTURE LAND USE PLAN: Residential. Rezoning this property to RSF-4 is
consistent with the interim land use plan and compatible with surrounding land uses in the area.
FINDINGS OF THE STAFF
1 . A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The proposed RSF-4 zoning for a Single family residential use is compatible
with developed subdivisions within the vicinity of the property. Although the
immediately adjacent property is zoned R-A, the lot sizes and uses are more
appropriate within the RSF-4 zoning district. Rezoning the property will
allow for additional development and promote the goal of infill identified in
City Plan 2025,
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: At this time, the ,property is nonconforming within the R-A zoning district.
The owner has requested a rezoning at this time to 'bring the lot into
compliance with bulk and area regulations and pursue subdivision of the
property to provide additional residential housing in the area. As
infrastructure is extended to areas surrounding this property and developed
at densities of approximately 4 units per acre, it is reasonable to consider
rezoning those remaining R-A properties to allow infill where appropriate.

3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Should the applicant pursue subdivision and development of the property,
additional traffic will be added to Genevieve Street, an unimproved public
street. At this time, Genevieve Street dead -ends to the south and intersects
Tackett Road to the north. Tackett Road intersects with 54th Street, and
both of these streets were improved with the development of Sundance
Meadow Subdivision. Development of Legacy Pointe Phase 5, located south
of the property, has been approved with the requirement that Genevieve
Street extend south and become a through street. The Fayetteville Police
Department finds that rezoning this property will not result in an
appreciable increase in the level of traffic danger and congestion in the area.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning would increase population density. Under an R -A,
Residential Agricultural designation, with a minimum lot area requirement
of 1 unit per 2 acres, the 1.5 -acre tract cannot be developed. With the
proposed RSF-4 designation, a maximum 6 dwelling units would be
permitted. There are two existing dwelling units on the property resulting in
a maximum increase of four residential units. Rezoning the property
increases the, possible number of residential units and population than that
which would be allowed in the WA zoning district, but is consistent with land
use, zoning, and development patterns in the immediate vicinity.
Increased load on public services were taken into consideration and
recommendations from Engineering, Fire, and Police Departments are
included in this report.
5. If there are.reasons why the, proposed zoning should not be approved in view.of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning
even though there are reasons under b (1) through (4) above why
the proposed zoning is not desirable.

I am requesting to rezone the property from the current zoning of RA to RSF-4.
RA does not allow for the property to be split into separate parcels. This property
once rezoned will comply with the current uses of the surrounding properties by
matching current adjoining properties zoning and fits into the 2025 land zone
recommendations, This rezoning will not cause further traffic congestion and will
only increase the appearance of the area. There is full sewer and water avai table

7. The current use of this property is a duplex on an acre and a half lot. For this area
to conform with the current use it has to be in a zoning class which allows for
multiple family homes. Lam requesting RSF-4 so that I might obtain a
conditional use to maintain the current street's residential conditions. There are

two additional duplexes on Genevieve. One that is on the north side and one to
the south side of the properly. Financially single-family homes would not be a
good investment because of the adjoining properties. Also, RA zoning inside the
city of Fayetteville's limits is not an adequate zoning. So without asking for It! -
12 or RT-24 that is required to meet a conforming status on the current lot it will
be able to conform with a conditional use in RSF-4. It is the belief of the current
planners and myself that a RTI 2 or RT-24 would be a high planning density and
therefore isn't just. It is not my intent to request either of those two zonings or to
request more than two conditional uses on this property. I have spoken with the
current planners to he advised as to what use will best suit Fayetteville's long
range plans and to allow for me to keep the largest amount of property on the
back half of the lot which to someday build a lifelong home.
If this property is zoned to a RSF-4 it will allow fora lot split and Twill be able
To have the three to four lots that I am looking to obtain. It will meet the 2025
plan and it won't cause any more congestion to the existing road infrastructure.
