BACKGROUND The 0.75-acre property is located on the north side of 150' Street in south Fayetteville, less than % mile east of Razorback Road. The property contains a church .building and is zoned RMF-24. Surrounding properties are residential. The request is to rezone the subject property from RMF-24, Residential Multi-Family 24 Units/Acre to C-2, Thoroughfare Commercial, in order to allow the various uses requested. The property contains a church building and is zoned RMF-24. As depicted on Table 1, the property is surrounded by residential property. Request. The request is to rezone the subject property from RMF-24, Residential Multi-Family 24 Units/Acre to C-2, Thoroughfare Commercial, in order to allow the various uses requested. The request is subject to a Bill of Assurance offered by the applicant, however, that limits the uses on the property to those associated with the art gallery, studio, cafe.and art supply retail sales. Public Comment. Staff has received a few phone calls.from adjacent property owners inquiring about the rezoning. One property owner did not object to the rezoning, and another one objected stating that only residential uses should be allowed on the property. INFRASTRUCTURE: Streets: Currently the site has access, to 15a' Street. 15'h Street is a four lane state highway. Improvements to the adjacent streets will be evaluated in rough proportionality to development on the property. Water: Public water is located adjacent to the site. There is an 8" waterline along the south side of 15a' Street. Water service will need to be extended to the property and through the property at the time of development. Sewer: Sanitary sewer is available adjacent to the site. There is a 6" sewer main along the south side of 15`x' Street. Sewer service will need to be extended property at the time of development. Improvements to the sewer system may be required dependent upon the demand placed by the development. The capacity of the existing main will need to be studied at the time of development. Fire: The subject property is located 1.5 miles from Fire Station # 6 at 900 S. Hollywood. Fire response time is approximately 3.5 minutes. Police: It is the opinion of the Fayetteville Police Department that this rezoning will not substantially alter the population density nor will it create an undesirable increase on police services. LAND USE PLAN: The City Plan 2025 along with the Interim Future Land Use Plan Map and Sector map were adopted by the City Council on July 17, 2006. The Interim Future Land Use Map designates this site for Residential Use. This entire area of l5" Street is identified on the Sector Map as an Infill Growth Sector. The Guiding Policies in the City Plan 2025 classify Infill Growth Sector as falling under the policies for Mixed Uses. Mixed Use areas are defined as areas where residential, commercial, agricultural, and some industrial uses may be appropriate. Rezoning this property to C- 2 could allow some potentially objectionable uses in an area that is almost exclusively residential. Rezoning the property to C-2 with the assurances offered by the applicant, however, utilizes the property in a manner that is consistent with the land use plan and long-range planning objectives for this area of the City, and provides a level of acceptable compatibility within a residential area. FINDINGS OF THE STAFF 1. A determination of the degree to which. the proposed zoning is consistent with land use ,. . planning objectives, principles, andpolicies and with land use and zoning plans. Finding: The property is identified for residential use on the Interim Future Land Use Plan, and is an Infill Growth Sector. The Infill Growth Sector overlay falls under the Future Land Use Guiding Policies for Mixed Use Area (City Plan 2025, Section 12.1.3). The Guiding Policies for Mixed Use Areas discusses that mixed uses should be integrated where appropriate. The proposed rezoning to C-2 in an area that is principally residential is generally not consistent with future land use planning objectives, principles, and policies for Residential Areas and Infill Growth Sectors. The property is entirely surrounded by ' residential use in the RMF-24 zoning district. A C-2 zoning in the midst of • RMF-24 zoning and residential development would allow a variety of uses that could be incompatible• with, and potentially objectionable to, the established residential uses in the area. A straight rezoning as proposed. without a bill of assurance or other committed uses appropriate to and compatible with residential neighborhood uses could result in uses allowed in the C-2 zoning district that are not appropriate in this residential area. Staff finds the proposed renovation of the existing church for use as an art gallery as proposed by the applicant to bean appropriate and compatible use at K. 1Reporu120061PC Reports) II-13-06LRZ.N 06-2320 (Garner).doc I. a. this location; a straight rezoning of the property to C-2 is not recommended. Staff has discussed these concerns with the applicant, who subsequently has offered a limiting bill of assurance that ties the future use of the property to an art gallery, auditorium/stage for drama/music, art studio for workshops/teaching, art supply sales, cafe and complementary retail sales (arts, crafts, books, unique gifts). This option of rezoning is much preferred in this particular case, in that it ensures a level of compatibility with the neighborhood. The uses listed are low impact, low intensity types of use, and should not create a high noise, refuse, light, traffic or other detrimental impact on surrounding• properties. 2. - A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: The.proposed zoning to C-2 for the uses proposed is justified. The applicant's • stated intent is to rezone the property to allow for an art gallery and other • associated uses. These uses, while generally low in intensity, are located within several use units found only within the C-2 zoning district as uses by right. Subject to the bill of assurance, the C-2 zoning district will provide a means by which these uses can.be achieved on the property for a beneficial reuse of the existing church. 3. A determination as to whether the, proposed zoning would create or appreciably increase traffic danger and congestion. :. Finding: The size of the subject property will limit a great increase in traffic danger.and congestion, due to the size.of development generated by 0.75 acres. However,.. traffic volumes in this area are fairly high, and increasing. Planning.of any future development or.re-development on this site must address safe access and cross access concerns. At the time of development, improvement to this street and ingress/egress will be evaluated carefully. Additionally, based on the uses proposed within the property, parking and landscaping requirements will be evaluated and improvements. required where necessary. Police — it is the opinion of the Fayetteville Police Department that this rezoning will not create an appreciable increase in traffic danger and congestion in the area. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: The proposed zoning would not substantially alter the population density in the area, based on the C-2 zoning requested. Fire — Response time to the subject property (actual drive time) is approximately 3.5 minutes (approximately I.5miles) from station #6. Engineering - Public water is adjacent to the site. There is an 8" waterline along 15'h Street Sanitary sewer is adjacent to the site. There is a 6" sewer main along 15th Street. The site has access to 15" Street. 15th Street is a state highway (16) which is a principal arterial in the City's Master Street Plan. The Arkansas Highway Transportation Department will be widening this roadway this year to a 5 - lane highway. 5. If there are reasons why the proposed zoning should not be approved in view of considerations underb (1) through (4) above, a determination as to whether the proposed zoning is justified and/or.necessitated by peculiar circumstances such as: a.. It would be impractical to use the land for any of the uses.permitted.. under its existing zoning classifications; b. There are extenuating circumstances which justify the rezoning even though there are reasons under b (1) through (4) above: why the. proposed zoning is not desirable. Finding: As discussed under Finding No. 1, staff does not find that the uses proposed on the site as described by the applicant to be inappropriate. These:uses include: art gallery, auditorium/stage.for drama/plays, art studio for work and teaching,. eating. place/cafe,. 2nd 'sale, of art.supplies... These uses. when .designed. and. planned appropriately with the established. residential uses in the area would meet several of the guiding policies for Mixed Use Areas. Providing assurances to limit the uses on the site eliminates the potential for incompatible uses neither desired by the applicant, nor supported by staff. Staff recommends denial of a_ request for a straight C-2 zoning; however, the Bill of Assurance offered satisfies the concerns of rezoning the area, by providing assurances of the uses that will be permitted on the property, thereby limiting them to uses that will not detrimentally impact adjacent properties. You could rezone the property to C-1 (Neighborhood Commercial) which would allow 12, 13,.and 15 as a permitted use, and Use Unit 4 as a conditional use (see attached).
