AN ORDINANCE REZONING THAT PROPERTY
DESCRIBED IN REZONING PETITION RZN 06-2199, FOR
APPROXIMATELY 88 INDIVIDUAL PROPERTIES,
LOCATED SOUTH OF EIGHTEENTH STREET, EAST OF I-
540, AND WEST OF RAZORBACK ROAD FROM RMF-24,
RESIDENTIAL MULTI-FAMILY, 24 UNITS PER ACRE TO
RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 : That the zone classification of the following described property is hereby
changed as follows:
From RMF-24, Residential Multi-Family, 24 units
per acre to RSF-4, Residential Single Family, 4
units per acre, as shown on Exhibit "A" attached
and map labeled Exhibit "B" attached hereto and
made a part hereof.
Section 2: That the official zoning map of the City of Fayetteville, Arkansas is
hereby amended to reflect the zoning change provided in Section 1 above.

RECOMMENDATION
Planning Staff recommends approval of an ordinance rezoning 88 parcels of land from
RMF-24, Residential Multi-family-24 units per acre, to RSF-4, Residential Single-
family-4 units per acre.
BACKGROUND
The subject properties are located west of Razorback Rd. south of Eighteenth St. and east
of 1-540. This neighborhood was platted primarily with quarter acre lots and is single
family in nature. All of the property owners requesting the rezoning are currently zoned
RMF-24. A total of 88 contiguous parcels are requesting the rezoning and have signed
the petition. The neighborhood proposes this rezoning in order to ensure that any
potential future development will be compatible in land use, scale and mass within the
context of the existing neighborhood. Staff is not recommending rezoning any of the
parcels that objected to this request.
DISCUSSION
This item was heard at the regular Planning Commission meeting on August 28, 2006.
The Planning Commission voted 9-0-0 to forward this item to the City Council with a
recommendation for approval .

I am writing on behalf of the property owners in the Red Arrow Neighborhood in
southwest Fayetteville. We desire that our zoning designation with the City be more
reflective of the way the properties have actually been built.
These properties consist primarily of single family homes built on lots around a quarter
acre in size. This is an older neighborhood that remains affordable and attractive to
young owners as well as older, long-time residents. Owners, landlords, and tenants all
take a great deal of pride in our homes.

part of this report.

BACKGROUND:
Properly description:
The subject properties are located
west of Razorback Rd.
south of
Eighteenth St. and east
of 1-540. This neighborhood was
platted primarily with
quarter acre lots
and is single family in nature. All of the property owners requesting the rezoning are currently
zoned RMF-24. A total of 88 contiguous parcels are requesting the rezoning and have signed the
petition. Staff is not recommending rezoning any of the parcels that objected to this request.
Proposal: The neighborhood proposes this rezoning in order to ensure that any potential future
development will be compatible in land use, scale and mass within the context of the existing
neighborhood. The applicants request a rezoning of the subject property from RMF-24,
Residential Multi Family Residential 24 Units / Acre, to RSF-4, Residential Single Family —4
units per acre. -
Recommendation: Staff recommends approval of the rezoning request based on findings stated
herein. Any potential future development of these properties will be compatible with the
residential developments surrounding the property.

Streets: Currently the properties are accessed by a number of City streets including;
Eighteenth St., Aswood Ave., Arrowhead St., and Custer Ln. No street
improvements are required for this rezoning request.
Water: Public water is available to the properties located in this rezoning application.
Sewer: Sanitary sewer is available to these properties. Any future development would
require that sewer infrastructure be installed to service such development.
Police: This rezoning will not substantially alter the population density or create an
undesirable increase on police services nor will it create an appreciable increase in
traffic danger and congestion in the area.
Fire: N/A
LAND USE PLAN:
The Future Land Use Plan designates

compatible with the surrounding properties.
FINDINGS OF THE STAFF
A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The proposed rezoning is consistent with land use planning objectives and
policies and is compatible with zoning and use of adjacent properties.
Surrounding properties are residential in nature.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The proposed zoning is justified in order to promote orderly and consistent
development patterns making use of existing infrastructure. It will provide
the potential for the development of comparable uses in close proximity to
the existing single family residences.
3. A determination as to whether the proposed -zoning would create or appreciably increase
traffic danger and congestion.
Finding: Access to these properties is provided by numerous City streets and any
future development will not appreciably increase the traffic danger and
congestion on these streets.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning would decrease the potential for significant population
density increases allowed in the RA'IF-24 zoning district.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses
permitted under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning
even though there are reasons under b (1) through (4) above why
the proposed zoning is not desirable. .
