AN ORDINANCE AMENDING A RESIDENTIAL PLANNED
ZONING DISTRICT ENTITLED R-PZD 05- 1734, PARADISE
POINT, LOCATED WEST OF CROSSOVER ROAD (HWY 265),
CONTAINING APPROXIMATELY 1 .55 ACRES, TO REFLECT
REVISED DENSITY AND LAND AREA PER DWELLING
REQUIREMENTS AS DESCRIBED AND DEPICTED HEREIN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF.FAYETTEVILLE,
ARKANSAS: , f
Section 1 . That the change in density from 7.8 units per acre to 10.4 units per acre is
hereby approved and reflected in the Planned Zoning District approval zoning criteria for R-PZD 05-
1734, as shown in Exhibit "B" attached hereto and made a part hereof.

Section 2. That the change in land area per dwelling unit from 5,625 square feet per 2-
bedroom unit to 2,810 square feet`per 1 -bedroom unit and 5,620 square feet per 2-bedroom unit is
hereby approved and reflected in the Planned Zoning District approval zoning criteria for R-PZD 05-
1734, as shown in Exhibit `B" attached hereto and made a part hereof.

Section 3 . That the approvals and conditions for R-PZD 05- 1734 (Paradise Point) as
passed and approved by the City Council on January 03, 2006 with Ordinance #4813 and amended
on March 21 , 2006 with Ordinance #4846 shall not be modified in any way with the exception of the
revisions to the density and land use per dwelling unit as described and depicted herein.
Section 4. That this ordinance shall take effect and be in full force at such time as all of
the requirements of the Planned Zoning District have been met.
Section 5. That the Planned Zoning District ordinance and official zoning map of the
City of Fayetteville, Arkansas, is hereby amended to reflect the zoning change provided in Section I
and 2 above.

06-1976)
RECOMMENDATION
Planning Staff recommends approval of an ordinance amending Residential Planned
Zoning District (R-PZD 05- 1734) for Paradise Point. The amendment would modify the
density from 7.8 units per acre to 10.4 units per acre and allow the addition of four units
to the proposed structure.
BACKGROUND
The subject property consists of approximately 1 .55 acres located west of Crossover
Road and south of the UAMS Campus. On November 28, 2005, the Planning
Commission voted 9-0-0 to recommend forwarding a rezoning and large scale
development approval for a mixed use development within a unique R-PZD zoning
district to the City Council . The City Council approved the R-PZD on January 3, 2006
with all conditions and recommendations made by the Planning Commission.
The zoning criteria for the property permits a density of 7.8 units per acre and a land area
per dwelling unit of 5,625 square feet (for 2 bedroom units). The applicant was granted
approval to construct 12 units with 2 bedrooms per unit, which complies with the density
and land area requirements within the unique zoning criteria for this project. Grading of
the property is in process and the applicant is in the process of finalizing building permit
plans. The applicant proposes to increase the total number of units from 12 to 16 by
converting 4 2-bedroom units to 8 1 -bedroom units. The number of bedrooms, ratio of
residential to commercial space, and the building foot print will not change. As a result
of the modified density, the land area per dwelling unit requirement will also change.

DISCUSSION
Staff recommends approval of the modified density and land area per dwelling unit
requirements. The total number of bedr000ms will not change. The increase in number
of units will not negatively affect the traffic, parking ratios, or the mixed-use nature of
the development.
