WHEREAS, the City Council has the authority under A.C.A. § 14-54- 104 to vacate public
grounds or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of the
platted utility easement is not required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby vacates and
abandons the following described utility easement:
See Exhibit "A" attached hereto and made a part hereof.
Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the map
attached hereto and labeled Exhibit `B" shall be filed in the office of the Recorder of the County and
recorded in the Deed Records of the County.
Section 3 : That this vacation approval is subject to the conditions of approval listed in the
staff report and Planning Commission recommendations for the City of Fayetteville, and shall not be
in effect until all conditions are met therein.

RECOMMENDATION
Planning Staff recommends approval of an ordinance vacating a portion of a 25 ' general
utility easement located within the residential lot at 1 l82 Summersby Drive.
BACKGROUND
The subject property is a small portion (39 square feet) of an existing 25-foot .utility
easement traversing east-west along the southern property line of a single-family . lot
located at 1182 Summersby Drive. This property is identified as :Lot :' 46 ;in :the
Summersby Subdivision. A roof overhang on the southern side of the house encroaches
into the utility easement. This portion of the easement is not being used by;any utility
providers. This item was heard at the July 5, 2006 Board of Adjustment meeting for a
variance request to allow for the overhang in the building setback. The variance request
was unanimously approved. , .
The overall 25 ' easement was originally platted on this developed property for general
utility use. Utility representatives have no objections to the requested vacation.
The request is to vacate approximately 39 square feet of the existing utility easement.
DISCUSSION
Notification was provided to all appropriate utility representatives and to the City. This
item was heard on consent at the regular Planning Commission on July 10, 2006. The
Planning Commission voted 8-0-0 to recommend this vacation request to the City
Council.

We, the undersigned, being all the owners of the real estate abutting the easement herein sought to
be abandoned and vacated, lying in Lot 46, Summersby Subdivision, City of Fayetteville, Arkansas, a
municipal corporation, petition to vacate a portion of an easement which is described as follows:
A PART OF LOT NUMBERED FORTY-SIX (46), SUMMERSBY SUBDIVISION, FAYETTEVI.LE,
ARKANSAS, AS PER PLAT ON FILE IN THE OFFICE OF THE CIRCUIT CLERK AND EX -OFFICIO
RECORDER OF WASHINGTON COUNTY, ARKANSAS, BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT
FORTY-SIX (46), SAID POINT BEING AN EXISTING IRON REBAR; THENCE N33°53'59"E 25.00
FEET ALONG THE EAST LINE OF SAID LOT FORTY-SIX (46) TO THE BUILDING SETBACK
LINE; THENCE LEAVING THE EAST LINE OF SAID LOT FORTY-SIX (46), N56°06'01"W 22.89

( under A.C.A. § 14.54-104 to vacate public grounds or portions thereof which are not required for cor-
porate purposes; and
WHEREAS, the City Council has determined that the following described portion of the platted utl-
