AR Bette Stamps Circuit Clerk File200640034956 ORDINANCE NO. 4909 AN ORDINANCE APPROVING VAC 06-2138 SUBMITTED BY ALAN REID FOR PROPERTY LOCATED AT 1182 SUMMERSBY, VACATING A 39 SQUARE FOOT PORTION OF THE UTILITY EASEMENT LOCATED WITHIN THE SUBJECT PROPERTY 4 WHEREAS, the City Council has the authority under A.C.A. § 14-54- 104 to vacate public grounds or portions thereof which are not required for corporate purposes; and WHEREAS, the City Council has determined that the following described portion of the platted utility easement is not required for corporate purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby vacates and abandons the following described utility easement: See Exhibit "A" attached hereto and made a part hereof. Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the map attached hereto and labeled Exhibit `B" shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the County. Section 3 : That this vacation approval is subject to the conditions of approval listed in the staff report and Planning Commission recommendations for the City of Fayetteville, and shall not be in effect until all conditions are met therein. Pate, Director of Current Planning !� Date: July 12, 2006 Subject: Easement Vacation for Corral (VAC 06-2138) RECOMMENDATION Planning Staff recommends approval of an ordinance vacating a portion of a 25 ' general utility easement located within the residential lot at 1 l82 Summersby Drive. BACKGROUND The subject property is a small portion (39 square feet) of an existing 25-foot .utility easement traversing east-west along the southern property line of a single-family . lot located at 1182 Summersby Drive. This property is identified as :Lot :' 46 ;in :the Summersby Subdivision. A roof overhang on the southern side of the house encroaches into the utility easement. This portion of the easement is not being used by;any utility providers. This item was heard at the July 5, 2006 Board of Adjustment meeting for a variance request to allow for the overhang in the building setback. The variance request was unanimously approved. , . The overall 25 ' easement was originally platted on this developed property for general utility use. Utility representatives have no objections to the requested vacation. The request is to vacate approximately 39 square feet of the existing utility easement. DISCUSSION Notification was provided to all appropriate utility representatives and to the City. This item was heard on consent at the regular Planning Commission on July 10, 2006. The Planning Commission voted 8-0-0 to recommend this vacation request to the City Council. BUDGET IMPACT None.
