Subject: Rezoning for Washington Regional Medical Center (RZN 06-2140)
RECOMMENDATION
The Planning Commission recommended approval of the subject rezoning request from
R-0 and C- 1 to P- 1 on approximately 61 .5 acres of property located east of Gregg
Avenue, north of Appleby Road.
BACKGROUND
The subject property contains approximately 61 .5 acres, delineated by Gregg Avenue to
the west, Appleby Rd to the south, Futrall. Road to the north and Northhills Blvd to the
south. The property is zoned C-1 (9.5 acres) and R-0 (52 acres). The existing
Washington Region Medical Center hospital complex is developed on the property zoned .
R-O. Recently, the property to the west, zoned C- 1 in 2004 and formerly utilized for a
manufactured home park, was purchased by the applicant in anticipation of expanding
hospital facilities. The hospital is a Cultural and Recreational Facility (Use Unit 4) and is
a conditional use in both the C- I and R-0 zoning districts. Several conditional use
permit applications have been reviewed by the Planning Commission for the existing and
proposed developments on the property. At the time of the Large Scale Development
review, the Planning Commission inquired as to why this property had not been rezoned
appropriately to P- 1 for its obvious use.
The applicant requests a rezoning of the subject property from R-0 and C- 1 to P- 13
Institutional. A hospital (Use Unit 4) is a permitted use within this zoning district.
Further development of the property would, therefore, not be subject to a conditional use
permit.
DISCUSSION
This item was heard at the regular Planning Commission on July 10, 2006. The Planning
Commission voted 8-0-0 to recommend approval of this rezoning request to the City
Council.

FINDINGS OF THE STAFF
1 . A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The proposed hospital use and other uses permitted within the P-1 zoning
district are compatible with the adjacent residential and medical office
developments. The expansion of this facility will increase its services and
ability to meet the needs of many people throughout Northwest Arkansas.
Staff finds that the proposed zoning is compliant with the General Plan,
which identifies this area for office use, and expansion of the uses will
provide employment adjacent to collector and arterial streets slated for
improvement.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: This property is developed for a hospital and associated services. At this
time, a conditional use permit is required for each expansion or addition of
parking on the property. The applicant anticipates future expansions and
requests that the existing use be recognized and made a permitted use. Staff
finds that the hospital use is appropriate in this area of the City of
Fayetteville and compatible with surrounding uses. To allow expansions,
improvements, etc. of the hospital, a rezoning is justified to circumvent
additional and at times unnecessary consideration of a conditional use permit
at each juncture.
3 . A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Traffic will be evaluated with the further development of the hospital
complex. It is not anticipated that the change in zoning from C-1 and R-O to
P-1 will result in an increase in traffic danger and congestion.

Police: It is the opinion of the Fayetteville Police department that an appreciable
increase in traffic danger and congestion would not be created by this
rezoning.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning would not increase population density. The applicant's
intended use for this property is a hospital. This facility will be used by
population in surrounding municipalities, so while it will draw population
from the surrounding region for short periods of stay, the use will not create
a permanent increase in population.
Increased load on public services were taken into consideration and
recommendations from Engineering, Fire, and Police Departments are
included in this report.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (I) through (4) above, a determination as to whether the proposed

Regarding the above referenced project, I am submitting this letter to address
items number six and seven on the rezoning application as per your request.

A. Both pieces of property that are proposed to be rezoned are owned by
Washington Regional Medical Services, an Arkansas nonprofit
corporation. There are no proposed or pending property sales.
B. The reason for this proposed rezoning is to streamline the development
process for WRMC by eliminating the need for a conditional use
permit for future additions of parking and/or medical office buildings.
C. The property will relate the same as it does now to the surrounding
properties. There will be not change in the land use, traffic,
appearance, or signage due to this rezoning.
D. A 12" waterline along Appleby, an 8" waterline along Gregg, an 18"
waterline along Gregg, and many other 8" waterlines that exist on the
hospital site can serve the property with water. Various 8" sewer lines
exist on site as well that can be used to service future developments.
A. The proposed change to P -I is consistent with land use planning
objectives, principles, and policies and with land use and zoning plans.
The R -O and P -I zones are vary similar in all of the requirements that
are shown in the Fayetteville Development Code.
B. The zoning is needed at this time. By rezoning now we will be able to
reflect the new zoning on the plat that will be filed for the current
development so that all records will be up to date. Also when WRMC
decides to develop the old trailer park site, this will make it easier for
them to dramatically improve the aesthetics of the area..
C. This rezoning will cause no change in the traffic danger or congestion.
D. This rezoning will not alter the population density.

E. Since both properties are to be used for the same purpose they should
be zoned the same as well. Under the current R -O zoning of the main
hospital campus, a conditional use permit is required for any
