Home My WebLink AboutOrdinance 4853 ORDINANCE NO. 4853 AN ORDINANCE TO APPROVE AN AMENDED INTERLOCAL AGREEMENT SO THAT LOWELL CAN JOIN AS A MEMBER OF THE OZARK TRANSIT AUTHORITY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby approves the attached Amended Interlocal Agreement Providing For The Addition Of The City Of Lowell, Arkansas, As A Member Of The Ozark Transit Authority and authorizes Mayor Coody to execute this agreement. SONDRASMITH, City Clerk' .� KareniOzarkTramitLow IlAgreement.doc 02/06/06 AN AMENDED INTERLOCAL AGREEMENT PROVIDING FOR THE ADDITION OF THE CITY OF LOWELL, ARKANSAS, AS A MEMBER OF THE OZARK TRANSIT AUTHORITY WHEREAS, the Ozark Transit Authority is currently made up of the counties of Washington, Benton, Madison, and Carroll and the cities of Fayetteville, Springdale, Bentonville, and Rogers; and, WHEREAS, the City of Lowell, Arkansas, desires to become a participating member of said Authority. NOW, THEREFORE, IT IS AGREED: ARTICLE L The City of Lowell, Arkansas, is admitted as a member of the Ozark Transit Authority. ARTICLE 2. The mayor or his designee, as authorized by the bylaws of the Authority, shall be a member of the Board of Directors. ARTICLE 3. None of the entities herein maybe financially or otherwise obligated except upon specific approval of its governing body. ARTICLE 4. All other aspects of the previous interlocal agreement remain in full force and effect unless some specifically stated otherwise herein. WHEREAS, pursuant to Ordinance No. 2002-19 the Quorum Court authorized the County Judge to sign an Interlocal Agreement making Washington County a part of the Ozark Transit Authority along with the counties of Madison, Benton and Carroll and the Cities of Fayetteville, Springdale, Bentonville, and Rogers; and , WHEREAS, the City of Lowell desires to become a participating member of said Authority; and , WHEREAS, A.C.A. 14-334-103 mandates that before the City of Lowell can participate in the Authority, it must enter into an Interlocal Agreement with the other participating entities. NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF WASHINGTON COUNTY, ARKANSAS: ARTICLE 1 . The County Judge is authorized to sign an Interlocal Agreement with the City of Lowell and the other participating entities making the City of Lowell a member of the Authority. ARTICLE 2. As stated in the previous ordinance and interlocal agreement no participating entity may be financially or otherwise obligated except upon specific approval of it's respective governing bodies. ARTICLE 3. The Amended Interlocal Agreement is attached hereto and incorporated herein as if set out word for word and the County Judge is authorized to sign such.
