AN ORDINANCE TO AMEND THE UNIFIED
DEVELOPMENT CODE BY AMENDING THE DEFINITION
OF "COMPANY FLAG" IN SECTION 151 .01
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby amends the
definition of "Company Flag" in the Definitions portion of the Unified Development Code
§ 151 .01 by repealing it in its entirety and replacing it with the following definition.
"Company Flag. Signs. A flag identifying a business or
organization by use of the name of the business or organization
where the flag is displayed. The flag must have the same
proportional dimensions as the United States Flag, be installed
upon standard flag pole allowing flags to be raised and lowered,
and be flown only in conjunction with either the United States Flag
or Arkansas State Flag or both. The company flag must be flown
lower than the government flag, cannot exceed the size of the
government flag and in no case can exceed six feet in length." R

RE: "Company Flag"
"Windblown signs" are prohibited by our Sign Ordinance with the
exception of "company flag." Although "company flag" is defined, this
definition does not expressly state that the flag must be in the same
dimensional format of the Stars and Stripes, Arkansas State Flag, etc.
A recent businessman believed his windblown sign should be
considered a "company flag." To avoid any such confusion in the future, I
believe the definition of "company flag" should be made more explicit. It
should also be limited in size to what we normally see when "Old Glory" or
the Arkansas State Flag are displayed. I do not think anyone would like to
see giant "company flags" the size of the American Flag at the Fayetteville
Auto Park.
I am not even certain why the "company flag" exception to
windblown signs was inserted into the Sign Ordinance. However, the new
definition of "company flag" should ensure this exception will not adversely
affect the aesthetic rationale of the Sign Ordinance.
