S ORDINANCE NO. 4803 AN ORDINANCE TO AMEND § 51.137 OF THE CODE OF FAYETTEVILLE TO LOWER THE SEWER RATE CHARGED TO ELKINS, ARKANSAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. Background/Discussion Fayetteville City Council approved Ordinance 4536 on December 30, 2003 implementing rate adjustments beginning February 9, 2004, after December 31 , 2004 and after December 31 , 2005 for all retail and wholesale customers of the Fayetteville sewer system. This request consists of two parts: Part 1 : Adjust the rate per 1 ,000 gallons for Elkins in compliance with the 2005 Sewer Services contract between Fayetteville and Elkins; and, Part 2 : Postpone the scheduled rate increase from December 31 , 2005 to begin after April 30, 2006. The purpose for Part 1 is compliance with a negotiated contract. The purpose of Part 2 is to enable the City to reduce monthly cost to Citizens during this heating season. The recently completed hurricane season has negatively impacted heating fuel, electric and natural gas prices nationwide. Required Procedural Actions Arkansas Code in 14-235-223 requires municipalities to: 1 . Introduce the ordinance that fixes the rates or charges; 2. Publish a notice for a public hearing one time in a newspaper published in the City; 1:\Water & Sewer\Rate Ordinance_2003\Agenda Memo Chapter 51 Revisions _2006 Rate Adjustment Postponement.doc 0 0 3 . Notice is to be published at least 10 days before the public hearing; and, 4. Pass and implement the ordinance. This section of the Arkansas Code provides that if the rate adjustment is substantially pro-rata notice is not required nor is a public hearing is required. Budget Impact The impact to the sewer revenue budget for this adjustment is approximately $209,000 with the volume charges and estimated sewer service charge reduction (fixed fees) of approximately $ 100,000 exclusive of the impact of the Elkins contract for a total of $309,000. Rates and charges for services Lien. (a)(1) The council of the municipality shall have power, and it shall be its duty, by ordinance to establish and maintain just and equitable rates or charges for the use of and the service rendered by the works, to be paid by each user of the sewerage system of the municipality. (2) The council may change and readjust the rates or charges from time to time to such extent as will not render insecure the rights of the holders of revenue bonds or violate any sinking fund agreement, or other lawful agreement, with such bondholders. (b) The rates or charges shall be sufficient in each year for the payment of the proper and reasonable expense of operation, repair, replacements, and maintenance of the works and for the payment of the sums required in this subchapter to be paid into the sinking fund. (c) Revenues collected pursuant to this section shall be deemed the revenues of the works. (d)(1)(A) No rates or charges shall be established until after a public hearing, at which all the users of the works and owners of property served or to be served by them and others interested shall have opportunity to be heard concerning the proposed rates or charges. (B) After introduction of the ordinance fixing the rates or charges, and before the ordinance is finally enacted, notice of the hearing, setting forth the proposed schedule of the rates or charges, shall be given by one (1) publication in a newspaper published in the municipality if there is such a newspaper, but otherwise in a newspaper having general circulation in the municipality, at least ten (10) days before the date fixed in the notice for the hearing, which may be adjourned from time to time. (2) After the hearing the ordinance establishing rates or charges, either as originally introduced or as modified and amended, shall be passed and put into effect. (e) A copy of the schedule of the rates and charges established shall be kept on file in the office of the sewer committee having charge of the operation of the works, and also in the office of the municipal clerk or recorder, and shall be open to inspection by all parties interested. (f)(1) The rates or charges so established for any class of users or property served shall be extended to cover any additional premises thereafter served which fall within the same class, without the necessity of any hearing or notice. (2)(A) Any change or readjustment of the rates or charges may be made in the same manner as the rates or charges were originally established as provided in this section. (B) If the change or readjustment is made substantially pro rata as to all classes of service, no hearing or notice shall be required. (g) The aggregate of the rates or charges shall always be sufficient for the expense of operation, repair, and maintenance and for the sinking fund payments.
