RECOMMENDATION
Planning Staff recommends approval of an ordinance annexing the unincorporated area
bounded by the City of Fayetteville and the City of Farmington as authorized by A.C.A . §
14-40-501 , which contains 488.98 acres.
BACKGROUND
Currently, the City of Fayetteville borders 82 percent of the South Rupple Road Island
while the City of Farmington borders 18 percent.
Annexing this unincorporated area will allow for the following:
• Compatibility in land use and development standards
• Ability to plan and construct future City capital improvements
• Ability to require the same level of infrastructure improvements required for new
development within these areas as required within the City
The following City services (including but not limited to) will be availabe after
annexation.
• Trash service
• Police protection
• Fire protection
• Sewer service if available—any extensions of public or private lines to serve these
areas will be the responsibility of the property owner/developer
• Curbside recycling and yard waste pick-up.

Certified letters informing property owners of the City' s intent to annex were mailed
November 18, 2005.
DISCUSSION
This property could be annexed into the City of Farmington through a referendum
process in the future. Staff recommends annexation to ensure planned and managed
future growth and potential sales tax revenue; this property is in close proximity to
current capital improvement projects and contains future capital improvement projects
(i.e. Rupple Road, Fire Station #7, Boys and Girls Club, a new school, etc.).

to 6'h and from 61h to Wedington, due to the construction of Rupple Road.
Fire Station 7- Access to W. 6'h St.
Persons living, or shopping in an area southwest of 1540 and 6'h Street will have access to
Fayetteville Boys Club, the proposed sites for the new elementary and middle schools, and
Holcomb Elementary and Holt Middle School.
Will create a more natural western border of jurisdiction according to the map.

Subject: Annexation proposal for South Rupple Road
This property currently borders Station 7 and Station 6's coverage area. Station 7 on
Rupple Road will cover the North section of this property with an anticipated response
time of 2.25 minutes to the beginning of the development. Station 6 on S Hollywood will
cover the South section of this property with an anticipated response time of 2.75 minutes
to the beginning of the development. Since there is no joining roads through this
property it is not possible to anticipate the response time to the entire property, but it will
fall well within the 6 minute goal the fire department has for both stations.
Our goal of assembling all responding units to the scene of a moderate risk assignment
within 10 minutes, 90% of the time, will also be met. Both Station 2 and Station 1 have
an anticipated response time of 8 minutes.
If the entire 480 acres was annexed and re-zoned at R-4 (4 units/acre), we would
anticipate this area to produce 440 runs (173 fire/other and 267 EMS). The service
impact of this development will typically take eighteen months, after the development is
started, to occur.

AN ORDINANCE TO ANNEX INTO THE CITY OF
FAYETTEVILLE, ARKANSAS SEVERAL PARCELS COMPLETELY
SURROUNDED BY THE INCORPORATED LIMITS OF
FAYETTEVILLE AND THE CITY OF FARMINGTON,
ARKANSAS.
WHEREAS, the annexation policy of the City of Fayetteville adopted by
the City Council is to annex those parcels of land which have become completely
surrounded by incorporated city limits; and
WHEREAS, pursuant to A.C.A § 14-40-501 (a)(2), because the
incorporated limits of Farmington and Fayetteville have completely surrounded
the land described in Exhibits A & B and because Fayetteville has the greater
distance of city limits adjoining the unincorporated area's perimeter, the City of
Fayetteville has the statutory right to annex this land if it complies with one of
the five requirements of A.C.A § 14-40-302; and
WHEREAS, after annexation into the City of Fayetteville, the inhabitants
of those lands will be afforded the same services of police and fire protection and
solid waste collection as current citizens of Fayetteville enjoy; and
WHEREAS, all the lands identified in Exhibit A (map) and Exhibit B (legal
description) comply with at least one of the five requirements for annexation
stated in A.C.A . § 14-40-302; and
WHEREAS, at the time of the adoption of this ordinance, the highest and
best use of these lands is NOT for agricultural or horticultural purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas
hereby annexes into the City of Fayetteville, Arkansas the lands identified in
Exhibit A (map) and Exhibit B (legal description).
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby amends the official map of the City of Fayetteville to reflect the change
provided in Section 1 above.
Section 3. That the City Council of the City of Fayetteville, Arkansas
hereby assigns the zoning of these lands to be RSF-1 , Residential Single Family,
one unit per acre.
Section 4. That the City Council of the City of Fayetteville, Arkansas
hereby assigns these lands to Ward 4.
