WHEREAS, the current Taxicab ordinance incorrectly requires Taxi Drivers to possess Commercial Drivers Licenses; and, WHEREAS, the State of Arkansas does not issue Commercial Drivers Licenses for the purpose of driving a taxicab; and, WHEREAS, it is therefore impossible for the Fayetteville Police Department to issue Taxi Driver Permits under the current requirements. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That § 117.37 (C), Code of Fayetteville is hereby repealed, and the following is inserted in its stead: (C) Before any application is finally passed upon by the Chief of Police, or his duly- appointed representative, the applicant shall be required to present a current Arkansas Drivers License, with the appropriate endorsement allowing the transport of passengers for hire. Section 2 Emergency Clause. That the City Council of the City of Fayetteville, Arkansas, hereby finds the clarification of the requirements to obtain a Taxi Drivers Permit is necessary to ensure that taxi operators are able to continue providing for the transportation needs of the citizens of the City of Fayetteville, and because of such, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from the date of its passage and approval.
