161.26 District RSF-8, Residential Single-Family - 8 units/acre
(A) Purpose. The RSF-8 Residential District is designed to bring historic platted
development into conformity and to allow for the development of new single
family residential areas with similar lot size, density, and land use as the
historical neighborhoods in the downtown area.

Subject: Approval of an ordinance to adopt a new residential zoning district, RSF-8, 8
units / acre.
RECOMMENDATION
Planning Staff recommends approval of an ordinance amendment to the Unified
Development Code adopting a new residential zoning district, RSF-8, Residential Single
Family Historic - 8 units/acre.
BACKGROUND
Many of the older areas in the City of Fayetteville were platted prior to World War II and
before the advent of today' s automobile culture and 2,000 to 5,000 sq. ft. homes.
Necessarily, these areas required smaller lots and they were typically developed in a
compact pedestrian oriented neighborhood pattern. Many lots in the City were platted 40
to 60 feet wide and 100 to 130 feet deep. Homes, outbuildings, and driveways were then
placed on lots with consideration to slope, street orientation, and the topography.
The current ordinances that we utilize to regulate development are based in the suburban
development patterns that dominated the last half century. Our current codes require
larger lots, deeper setbacks, street front access, etc., which ensures that new development,
for the most part, will reflect these suburban patterns.
Historic platted lots must have variances granted in most cases to allow for single family
residential infill development. Additionally, existing homes often have to request setback
variances in order to add additional living space, outbuildings, porches, etc. Adoption of
this new zoning district will allow property owners to bring their properties into
compliance without using a variance procedure, and it will encourage the infill
development of single family homes in a traditional land use pattern.
DISCUSSION
The Planning Commission considered this UDC amendment on July 25, 2005, on which
they voted 9-0-0 in favor of the recommended amendment. Subsequent discussions with
the neighborhood that intends to use this zoning district in a rezoning application have
expressed concern regarding utilizing a build to line. Therefore, Planning Staff has

amended the RSF-8 zoning district by requiring a 15 ft. setback line as opposed to the 15
to 25 ft. build to line that was originally suggested.
The Ordinance Review Committee discussed this item on September 15, 2005 and voted
unanimously to forward it to the City Council with an amendment to the buildable area of
the lot. The RSF-8 zoning district amendment reads: The area occupied by all buildings
shall not exceed 50% of the total lot area, except when a detached garage exists or is
proposed then, the area occupied by all buildings shall not exceed 60% of the total lot
area.

DEVELOPMENT CODE, OF THE CODE OF
FAYETTEVILLE, TO PROVIDE A NEW RESIDENTIAL
ZONING DISTRICT.
WHEREAS, many of the historical residential neighborhoods in
Fayetteville were platted prior to current zoning ordinances; and,
WHEREAS, these residential neighborhoods are therefore considered
non-conforming in regards to bulk, area, and setback requirements; and,
WHEREAS, the City of Fayetteville desires to preserve these
neighborhoods in their present residential conditions; and,
WHEREAS, the City of Fayetteville recognizes that future residential
developments are likely to be built in a historical or New Urbanist pattern,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
