AN ORDINANCE AMENDING § 34.25, OF THE CODE OF
FAYETTEVILLE, REGARDING THE SALE OF CITY-OWNED
SUPPLIES, EQUIPMENT, OR MATERIALS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 . That § 34.25, Code of Fayetteville is hereby repealed and the
following is inserted in its stead:
§ 34.25 Sales
(A)The purchasing agent may sell or exchange any city-owned
supplies, equipment, or materials if such have a fair market value
of less than $2,500.00 through a quote process. Vehicles and heavy
equipment are excluded from this process.
(B) Such supplies, equipment, or materials which have a fair market
value of $2,500.00 or more may be sold by the purchasing agent by
public auction or by contract sale after formal competitive bids for
the purchase therefore have been solicited by advertisement and by
other means and such bids have been received and opened.
The City Council may waive the requirements for public auction or
formal competitive bids for sales of personal property in
exceptional situations where such procedures are deemed not
feasible nor practical.

Subj : Ordinance 34.25 Sales
Recommendation
Change to Ordinance 34.25 approving limit be changed from $600 to $2,500 and require
City Council approval to waive requirements for public auction or formal competitive
bids for sale of personal property in exceptional situations where such procedures are
deemed not feasible nor practical.
Background
For several years now it has been a problem to dispose of small personal property. There
have been instances when it was more cost effective to negotiate a purchase on small
dollar items than to pay the cost of disposing of it.
Discussion
Approval to increase the limit would allow us to dispose of items with a value of $2,500
in a more economical manner. In the past we contracted with an auction house to sell
items with low market value, but the amount the item brought at auction was far
exceeded by the cost of labor to store, move and transport to auction. The auction
company we were contracting with asked us not to bring a lot of the items we were taking
to them because they weren't selling and weren't worth their time.
