WHEREAS, the City Council Ordinance Review Committee recommended increases for use of city lakes and boat docks; and WHEREAS, the Parks and Recreation Advisory Board recommended a modified version of the increase in user fees for City Council approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby repeals § 97.070 (B)(1 ) and (C) to be replaced as shown below: "§ 97.070 (B) Permits for fishing and boating "( 1 ) Permits: (a) Season boating and fishing permit (65 and older) $40.00 (b) Season boating and fishing permit (16-64) $50.00 (c) Daily boating and fishing permit (65 and older) $ 5.00 (d) Daily boating and fishing permit ( 16-64) $ 6.00 (e) Season bank or dock fishing permit (65 and older) $20.00 (f) Season bank or dock fishing permit (16-64) $30.00 (g) Daily bank or dock fishing permit (65 and older) $ 2.00 (h) Daily bank or dock fishing permit (16-64) $ 3 .00 (i) Daily fishing permit (under 16 with permitted adult) Free." Number of citizens on the lake boat stall waiting list is as follows: Lake Sequoyah: There are 65 boat stalls of which 20 are not currently rented. There are no citizens on a waiting list. Lake Fayetteville: There are 43 boat stalls with a waiting list of 29 citizens. Number of boat stalls that are currently rented to citizens that are not using the lake. RECOMMENDATION Jim Black, who has been the Lake Fayetteville Boatdock Operator for the past seventeen years, made the follow recommendations for the Lake Recreation Fees. The Corp's boating/fishing fee is $4 per day plus a car entry fee of $3. The combination would simplify the fees charged and eliminate the practice of • . paying for a boat, and later deciding to fish without a permit. The fee would be the same for all types of boats including fishing boats, canoes and kayaks. The final change would be to combine the Season Boating and Fishing Permit with the Annual Stall Rental Fee. This would eliminate the current problem of collecting these permit fees and would be less complicated to monitor. Jim Black recommends a citizen should use their boat at least 10 times a year in order to keep their boat stall. This could be a policy for Lake Fayetteville only because at Lake Sequoyah there are currently 20 stalls not rented and the City is at least receiving the revenue for stall rental even though it is used for storage. Attached is the Parks and Recreation Lake Revenue table that includes the Ordinance Review, Parks and Recreation Advisory Board (DRAB), and the Boat Dock Contractor's recommendations. The Boat Dock Contractor's recommendation would charge $6 daily for boating and fishing and $50 for season boating and fishing; whereas, PRAB recommendation would charge $9 daily for boating and fishing and $80 for season boating and fishing. With the Boat Dock Contractor's recommendation, boating is offered only as a combination fee with fishing as opposed to having both options. General/City Commit Lake Fens Revised • . RECOMMENDATION Parks and Recreation Advisory Board (PRAB) recommends City Council to amend Ordinance 4168, increasing Lake Recreation Fees at Lake Fayetteville and Lake • Sequoyah. Further, Parks and Recreation Staff recommends amending this ordinance assigning the Mayor, or his/her designee, to review these fees on an annual basis determining the annual permit/rental fees according to the Fee Policy. BACKGROUND In February 2005, Parks and Recreation Staff met with the Ordinance Review Committee concerning fee based services offered by the Parks and Recreation Division. Among the fee based services evaluated was the lake revenues. The conclusion of the Ordinance Review Committee was to increase the stall rental fees, leaving the daily and season fees the same. At the March 7, 2005 Parks and Recreation Advisory Board (PRAB) meeting, PRAB tabled the decision to increase lake fees in order to encourage public input. One month later at the April 4, 2005 meeting, PRAB listened to several concerned citizens who expressed their dislike of the 100% increase of the boat stalls. PRAB recognized the need for an increase in user fees, but preferred to spread the increase across the entire user group, instead of only to participants renting stalls. First, the Lake Recreation fees will be increased. This increase, as proposed and passed by PRAB, will increase lake revenues by approximately $31 ,000 per year. In 2004, Lake Revenues were $47,805. If participation numbers remain equal to the 2004 numbers, revenues at the new rates will be $79,050. The fees would become effective January 1 , 2006. The last increase in fees at the lakes was on June 1, 1999. Second, if Council approves, the decision to delegate the determination of fees will be assigned to the Mayor or his/her designee. This will be consistent with current practices on park facility rental and swimming pool fees. Annually, PRAB and Staff will review the fees to be consistent with the City's Fee Policy. Lake Recreation Fee Proposal: Connie Edmonston Edmonston reported that after extensive study on Park's fee-based services the iOrdinance Review Committee has requested an increase in boat stall rental fees. Mauritson asked if the increase would make up the deficit of the costs versus fees . Edmonston said that Staff's choice would be to have gradual increases over a few years rather than a large increase at one time. Bailey said public input should be solicited to determine how they feel . • ` Davidson stated that the benchmarking that's been done Is not on comparable property because we have city lakes and the only nearby comparison is Beaver Lake. Bailey said he had tried to look at other states lakes and there's no comparison to go j' by. He suggested focusing on paying the bills due to lack of an average to compare Fayetteville's costs. i Maruitson suggested discussion be tabled to collect input and asked if a notice to the public will be posted at both Lake Fayetteville and Lake Sequoyah. Edmonston confirmed that would be the case...a notice would be posted. i Bailey moved to table the proposal for 30 day public input, Mauritson seconded, The motion was approved 7-0-0 with Mauritson, Bailey, Davidson, Harrison, Pawlik-Holmes, Langsner and Marley voting `yes', and Hill absent for the vote. Scout Troop 116 sponsored by Lake Sequoyah Church was in attendance as part of a badge requirement to attend a board meeting . 3. Lake Recreation Fees: Tabled from March 7, 2005 PRAB Meeting Connie Edmonston said the Lake Recreation Fees issue had been tabled from the March Board meeting in order to allow for public input. She stated that several phone calls had been received raising concern about the amount of increase in the original recommended increase. She said an alternate plan has been developed by Parks Staff that will provide for smaller fee increases. Harrison voiced concern about the original recommended increase for seniors. The increase will cause hardship for seniors on fixed incomes. He suggested the i alternate plan is an acceptable alternative. i Bailey said he is uncomfortable with the alternative plan due to the shortfall to cover expenses and pointed out that many cities charge as much as double the charges currently in place at Fayetteville lakes. Bob Reynolds, a citizen, stated that most people fishing at Lake Fayetteville are 65 and older and he believes the alternative will serve as a starting point with increases phased in over time. Bobby Farrell, a citizen , said he favors the alternative noting that the highest percentage of users of the lakes are senior citizens on fixed incomes and therefore would be most heavily impacted by the increase. He said he favors the alternative plan . Wendell Johnson, a citizen, said he uses Lake Sequoyah and noted 90% of fishermen on Lake Sequoyah are 65 or older. He said he's not against an Increase but wanted to point out that the comparison with Beaver Lake may not be appropriate due to the size of boats on the city's lakes being much smaller than the boats on Beaver Lake . i • April 4, 2005 / 1 i B. 1 Amend 97.070 Recreational Activities at Lakes Fayetteville, Sequoyah and Wilson i Page 10 of 14 Glen Riggins, a citizen, noted that the condition of the facilities at Lake Sequoyah Is poor. He also pointed out that the use of the walking trails has no charge so questioned the increase of fishing fees . Bailey suggested 100% Increase as proposed in the original plan for non-seniors and the alternative plan for seniors only. Mauritson noted that stall rentals are increased by 100% at Lake Sequoyah while Lake Fayetteville would be increased only 50% . He asked if that increase can be made equitable. Edmonston explained that Lake Sequoyah is in need of more repairs and work than Lake Fayetteville. She also reported that the Ordinance Review Committee is revisiting all city fees charged . They are reviewing to make sure all fees recoup 75% of the cost to run the facilities. PRAB Motion : Mauritson moved to accept staff recommendation of Alternative Revenue Enhancement plan (shown below). I The motion was seconded by Davidson. The motion was approved 6-0-0 with Mauritson, Bailey, Langsner, • Davidson, Harrison, Hill and Marley voting `yes' and Pawlik-Holmes absent for the vote.
