ORDINANCE NO. 4705 AN ORDINANCE APPROVING VAC 05- 1454 SUBMITTED BY MARLA AND ROBERT HARGUS FOR AN ALLEY LOCATED EAST OF HILL AVENUE WITHIN DOWELL' S ADDITION AS DESCRIBED ON THE ATTACHED MAP AND LEGAL DESCRIPTION WHEREAS, the City Council has the authority under A.C.A. § 14-54- 104 to vacate public grounds or portions thereof which are not required for corporate purposes; and WHEREAS, the City Council has determined that the following described alley is not required for corporate purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Sectionl : The City of Fayetteville, Arkansas releases, vacates, and abandons all its rights, together with the rights of the public generally, in and to the alley designated as follows: See Exhibit "A" attached hereto and made a part hereof. Section 2 : A copy of the ordinance duly certified by the city clerk shall be filed in the office of the recorder of the county and recorded in the deed records of the county. Section 3 : That this Vacation approval is subject to the conditions of approval listed in the staff report and Planning Commission recommendation as described in Exhibit "B" attached hereto and made a part hereof. Hill Ave. The property is zoned RMF-24, Residential Multi Family, 24 units per acre, and contains lots 1 , 2, 5, 6, and 9 of Dowell 's Addition. The request is to vacate approximately 0. 138 acres of an alley adjacent to the subject property. Findings: Property description: The subject property is located within Dowell's Addition east . of Hill Avenue, south of 6th Street. There is an existing 20' alley running north and south, at the center of the block between Hill and Government Avenues and parallels Hill Avenue to %the' east. - The applicants own property on either side of this alley and utilize. their . property for single family use. Background: The 20' alley was dedicated at the time the property was subdivided into Dowell's Addition. The southern portion of the alley was vacated by Ordinance 4161 per the request of the Regional National Cemetery Improvement Corporation ib:199.9,.-> Therefore, the alley currently provides no connectivity. Request: The applicants request to vacate approximately 300' of an existing 20' wide alley. Property adjacent to either side of the alley and under common ownership ,will be considered an undivided parcel for the purposes development per Chapter16432 B.(2). These properties will have access by way of Hill Avenue and existing alleys to the north and east. The applicant has submitted the required notification forms to the utility companies and to the City. DISCUSSION Notification was provided to all appropriate utility representatives and adjoining property owners. No objections were submitted. Conditions as requested and pertinent to the subject request are included as a condition of approval. The Planning Commission voted 7-0- 1 to forward this item to the City Council with a recommendation for approval of the vacation request at the regular meeting of April 25, 2005.
