Warrick, AICP, Zoning and Development Administrator Date: December 03, 2004 Subject: Annexation for Doris Roberts (ANX 04-1222) RECOMMENDATION Planning Staff recommends approval of the requested annexation for Doris Roberts, a 47.13-acre tract located on Roberts Road east of Fayetteville. This action will incorporate the 47.18-acre tract of land contiguous with the city limits into the City of Fayetteville. BACKGROUND The subject property contains approximately 47.13 acres of agricultural property located south of Huntsville Road, south and east of Roberts Road/Goff Farm Road. It is surrounded on the north and east by land in the Planning Area, on the south by land zoned RSF-4, and property to the east both in the Planning Area, zoned R-A, and zoned RSF-4. Floodway and floodplain from a West Fork of the White River tributary is located on the easternmost portion of the site. Numerous single family developments are under construction in the nearby vicinity, immediately south and west of the property. The applicant requests annexation of the property into the City of Fayetteville. A rezoning request has also been submitted, for RSF-4 zoning. The applicant intends to develop a single family residential subdivision within the City of Fayetteville. Staff recommends approval of the proposed annexation. The subject property is adjacent to the City limits, will create an appropriate City boundary, and the future development of single family residential is consistent with adjoining developments both in terms of density and compatibility. This item was heard at the regular Planning Commission on November 22, 2004. Discussion involved both the need for street improvements for surrounding streets and roads in the area at the time of development and emergency response time which should decrease if the Fire Station/Tyson Property is approved by the City Council. Other single family subdivisions are developing in the area and are located within the city limits, to which emergency service personnel already respond. The Planning Commission voted 6- 0 in favor of the annexation. Bridgedale Subdivision is located just north and west of the property, and the remaining surrounding property is developed with single family homes and agricultural land. Floodway and floodplain from a West Fork of the White River tributary is located on the easternmost portion of the site. Approximately 5.45 acres is approved to be dedicated for a city park along the West Fork, with the remaining land area to be developed in the future. Request: The request is to annex the subject property into the City of Fayetteville. Related Issues: When property is annexed into the City, it is annexed as R-A, Residential Agricultural. If the annexation is recommended for approval to City Council, the applicant would like to rezone the 47.13 acres to RSF-4, Residential Single Family, 4 Units per Acre. The rezoning request, RZN 04-1280, is an accompanying item to this annexation request. Property that is developed and/or subdivided in the Planning Area of the City of Fayetteville, outside of the city limits, does not allow for the enforcement of many regulations required within the City. When property that is consistent with the General Plan 2020 and the City's guiding policy of annexation is incorporated into the city and developed, a uniform and consistent standard of development includes the following: • Compatibility in land use and development standards Ability to plan future capital improvements • Ability to require the same level of infrastructure improvements required for new development within these areas as required within the City Less confusion for public safety - police and fire — who responds Police Protection Fire Protection Trash Service • Sewer service Water service • Street standards (curb and gutter) and construction specifications • Sidewalks, based on the Master Street Plan • Street lights • Grading and Drainage review • Detention • Zoning Regulations (setbacks, bulk and area requirements, land use) Code enforcement • Tree Preservation Parks land dedication Without appropriate annexation, developers of property in the Planning Area are offered water service from the City of Fayetteville, but have none of the other regulatory responsibilities for development. Many of the public services offered to citizens of Fayetteville in adjacent properties are not offered to those beyond the city limits. In some cases, new subdivisions adjacent to one another have very different street construction, creating problems with transition and the establishment of an efficient network of infrastructure. However, other requirements such as parks, detention, grading and drainage, zoning/land use and tree preservation are not within the City's ability to control. Should the annexation request be approved, future changes or additional development on this site will be regulated by the city allowing for a more uniform and consistent development pattern. These improvements will include right-of-way dedication, pavement, curb and gutter, storm drainage and sidewalks. Roberts Road to the north will need to be improved to a 20' minimum paved surface. Specific street improvements will be evaluated based on the development proposed, to meet ordinance requirements. Water: The site currently does have access to public water. The nearest water main is a 6" main to the north along Goff Farm Road and Roberts Road. Water service will need to be extended within the property at the time of development. Sewer: The site currently does not have access to sanitary sewer. An off -site sewer main extension will be required to serve this development. There is a 6" sewer main to the north, and an 8" main to the west in the Stonebridge Meadows Subdivision. A capacity analysis of the sewer lines downstream of the site shall be conducted prior to development. Fire: The subject property is located 3.4 miles from Fire Station #5. Normal driving time is 8-9 minutes. The property is located 2.5 miles from the future Fire Station #3. Normal driving time is 5-6 minutes. Police: It is the opinion of the Fayetteville Police Department that this annexation will not substantially alter the population density and thereby undesirably increase the load on police services. FINDINGS: 11.6 ANNEXATION GUIDING POLICIES BOUNDARIES 11.6.a Annex existing islands and peninsulas and do not annex areas that would create an island or peninsula. Finding: The requested annexation will not create an island of unincorporated property; The City limits extend further south and west of the subject property in this vicinity. 11.6.b Proposed annexation area must be adjacent, or contiguous, to city limits. Finding: The proposed annexation area is adjacent to the city limits along its west and south boundaries. 11.6.c Areas should either include or exclude entire subdivisions or neighborhoods, not divide. Finding: This area does not divide neighborhoods. A new subdivision is under construction to the south (Stonebridge Meadows II/111); the portion of this subdivision along the south border of the subject property is designated as parks land and potential land for a future elementary school. 11.6.d Boundaries for annexed areas should follow natural corridors. Finding: Proposed boundaries follow property lines. 11.6.e Timing of services within annexation areas should be considered. Finding: Current conditions result in a response time of 8 to 9 minutes for fire protection from Fire Station #5 and 5 to 6 minutes from the future Fire Station #3. The property has access to a 6" water main to the west. An extension of the water main will be required to provide water supply and fire protection within any development on this property. The City Council at its Nov. 16 meeting voted 7-1 in favor of the purchase of the Tyson Facility on Huntsville Road for emergency service purposes. Imminent plans include a new fire station to serve this area of town, a funded and planned project. K. ENVIRONMENTALLY SENSITIVE AREAS 11.6. f Annex environmentally sensitive areas that could be impacted by development and utilize appropriate development regulations to protect those areas. Finding: Floodplain and floodway associated with the West Fork of the White River is located along the eastern and south boundary of the property. This site's conditions will be best addressed through application of the City's stormwater, grading, and drainage regulations. EMERGENCY AND PUBLIC SERVICES 11.6.g Public services must be able to be provided efficiently in newly annexed areas. Finding: Water and sewer lines are accessible in the near vicinity. The police department reports that current levels of service would not be compromised and that coverage in this area can be provided for this request, though the impact from a sum total of increase in population density has caused an increase in service calls. Fire service may also be provided to the site with current and projected fire stations. 11.6.h Annexed areas should receive the same level of service of areas already in the city limits. Finding: Fire and police service are to be provided to this area with the same level of response and service as other developments in this area. Sewer and water improvements to the area in general will be provided for with the development of the property in question.: . 11.6.i The ability to provide public services should be evaluated in terms of equipment, training of personnel, number of units and response time. Finding: These factors were taken into consideration in the responses and recommendations from public service providers included in this report. INFRASTRUCTURE AND UTILITIES 11.6.j Areas currently served by utilities and other public services should be annexed. Finding: Water, fire and police protection are currently provided in this area. It is the opinion of the Fayetteville Police Department that this annexation and rezoning will not substantially alter the population density and thereby undesirably increase the load on police services or create and appreciable increase in traffic danger and congestion in the area. Individually, each of these annexations and rezonings do not necessarily substantially alter the population density, nor do they create and appreciable increase in traffic danger and congestion. The sum total presented over the years, however, has had a substantial impact on the demand for police services and has caused an appreciable increase in traffic congestion.
