Section 1. That a tax is hereby levied on the real and personal property within
the City of Fayetteville, Arkansas, for the year 2004, to be collected in 2005, for the
following purposes at the following rates:

copies of this ordinance in the office of the County Recorder, County Clerk, County
Assessor, and the County Tax Collector for Washington County, Arkansas.

SUBJECT: 2004 Millage Levy
Recommendation:
City staff recommends that City Council approve the millage levy ordinance approving the 0.4 mils
for the Policemen's Pension and Relief Fund, 0.4 mils for the Firemen's Pension and Relief Fund,
and 1.0 mils for the Fayetteville Public Library.
In addition, City staff recommends that City Council consider reviewing the need for the additional
2.20 mils needed for 2005 General Fund operations. The additional 1.80 mil may not be needed
during 2006/2007 due to Fayetteville Public Library going for citizen approval for additional millage
in 2005.
Background:
Each year the City must approve an ordinance to renew the levy of ad valorem taxes on real and
personal property within the City. This request will provide for such levy on property assessed
during 2004.
The total assessed value of real and personal property located within the city limits of Fayetteville, as
of October 6, 2004, is approximately $852 million. The assessed valuation is before the Washington
County Board of Equalization has made all the changes to the County Assessors Abstract. Based on
the preliminary assessments, the growth in real estate assessments is approximately 12.12%. The
change in assessed real estate value is due to newly discovered, newly constructed property 7.71%.
Based on information received as of November 23, 2004 from the Washington County Assessor's
Office, the City of Fayetteville will not be subject to a millage rollback under Amendment 59. The
growth in real estate assessments of 12.12% is offset by newly constructed property and does not
trigger a rollback situation.

Discussion:
A millage levy ordinance must be approved by City Council in order for the City to continue to
collect property taxes for the Policemen's Pension and Relief Fund and the Firemen's Pension and
Relief Fund. The millage levy for the Policemen's Pension and Relief Fund is 0.4 mils for real
property and 0.4 mils on personal property. The millage levy for the Firemen's Pension and Relief
Fund is 0.4 mils for real property and 0.4 mils on personal property.
In addition, a millage levy must be approved for the operation of the Fayetteville Public Library that
was approved by the voters on October 1, 2002. The millage levy for the Fayetteville Public Library
is 1.0 mils for real property and 1.0 mils on personal property.
City Council has the option of approving the assessment of up to 5 mils on real and personal
property. City Council may choose to exercise its option to levy some or all these discretionary 5
mils to provide a financial cushion to General Fund to offset the budget shortfalls as a result of lower
than projected sales tax collections.
The estimated impact on the City in General Fund, for 2005 as a result of current sales tax
projections and other expense increases is a budget shortfall of around $1.7 million. Approximately
2.10 mils would be needed to offset this loss for 2005.

Budget Impact:
Based on current adjustments and estimates, the 2005 Proposed Budget for General Fund has a
shortfall of $1,672,394. If the additional 2.10 mils are not approved, then the funding will come
from General Fund reserves. In addition to the 2005 Proposed Budget for General Fund, projected
2006 will have a shortfall of $1,246,866 and projected 2007 will have a surplus of $521,497. The
2006 and 2007 projections do not contain any additional personnel and any payrange adjustments
that could be made in 2006.
Conclusion:
The millage levy must be at Washington County, in December to be included in their consolidated
levy ordinance. The City approved Resolution 158-04 which approves the Washington County
Quorum Court to file an extension of up to sixty (60) days with the State of Arkansas' Assessment
Coordination Division for the levy of millage taxes. The extension is needed due to the possible
rollback of taxes due to reappraisals.

The millage revenue reflected above is based on the Washington County Preliminary Summary
Report of County Assessments for the Year 2004 dated October 6, 2004 and excludes real and
personal property for Utilities. The City Council can approve up to 5.0 mils for operations. The
table assumes a 95% collection rate. Total real and personal property assessments for 2004
amount to approximately $825 million excluding real estate and personal property for utilities.

Millaae Tax Levy Extension: A resolution to request that the Washington County Judge and
the Washington County Clerk apply to the Director of the Assessment Coordination Division of
the PSC for a sixty day extension of the date to levy millage.
Steve Davis: Under Arkansas Amendment 59 a rollback situation is triggered when your total
assessments exceed 10% year over year. Our real estate assessments based on the preliminary
report received from the County Assessors office reflects a 14.75% increase in real estate values.
In the same letter where the County Assessor transmitted that information to us the Assessors
office indicated that personal property would likely approach the 2003 levels and we have a
potential for a rollback situation but we will not know that for sure until November. We are
requesting under the provisions of the apable statues that we get a waiver to levy our millage
ordinance until November until the County Assessors office has the time to determine whether
we have a roll back situation or not.

A RESOLUTION TO REQUEST THAT THE WASHINGTON
COUNTY JUDGE AND THE WASHINGTON COUNTY
CLERK APPLY TO THE DIRECTOR OF THE ASSESSMENT
COORDINATION DIVISION OF THE PSC FOR A SIXTY
DAY EXTENSION OF THE DATE TO LEVY MILLAGE
WHEREAS, the Countywide reappraisal may require a rollback of millage rates
this year; and
WHEREAS, the City of Fayetteville is still waiting for the final decision as to
whether and how much municipal millage for the city library and police and fire pension,
boards may have to be rolled back pursuant to Amendment 59 of the Arkansas
Constitution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:

The City Council passed the Millage as stated in the ordinance .4 Police Pension, .4 Fire Pension and 1.0
for the Library. Please get with the Mayor or Steve Davis before sending the information to the County
Clerk. The Mayor was going to talk to the County Judge about getting another extension before
submitting this millage. If the extension is granted by the County the Council would then have another
meeting to reconsider the millage they passed tonight before it is submitted to the County.
