BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council hereby confirms the annexation to the City of
Fayetteville, Arkansas, of that property described in Exhibit "A" attached hereto and made a part
hereof.
Section 2: The official map of the City of Fayetteville, Arkansas, is hereby amended
to reflect the change provided in Section 1 above.
Section 3: That the official zoning map of the City of Fayetteville, Arkansas is
hereby amended to assign the zoning designation of R-A, Residential Agricultural to the subject
property.
Section 4: That the above -described property is hereby assigned to Ward No. Four.

ANNEXATION PETITION
For their Annexation Petition, the undersigned Petitioners state:
1. Petitioners are the owners of a majority of the real property
described in Exhibit "A" attached hereto. Said property is contiguous to and
adjoining the City of Fayetteville, Arkansas.
2. Petitioners name James N. McCord, attorney at law, as the person
authorized to act on behalf of Petitioners in this annexation proceeding. James N.

3. Attached hereto as Exhibit "B" is an accurate map of the real

Subject: Annexation request for Hays (ANX 04-1090)
RECOMMENDATION
Planning Staff recommends approval of the requested annexation for Hays. This action
will incorporate a 37.30-acre tract of land contiguous with the city limits into the City of
Fayetteville. The request is to annex the subject property into the City of Fayetteville.
BACKGROUND
Property Description: The subject 37.30 acre tract of land is located west of 54`h Street,
adjoining the extension of W. Persimmon St. as reflected on the Master Street Plan.
Adjacent to the city limits to the north and east, the configuration of land does not create
an island of unincorporated property within the City limits.
Proposal: The applicant requests annexation into the City of Fayetteville, along with the
companion rezoning request. The applicant(s) are a consortium of land owners within the
Planning Area that have collectively requested their respective properties be annexed into
the City of Fayetteville.
DISCUSSION
On June 28, 2004, the Planning Commission voted 7-2-0 to forward this item to the City
Council with a recommendation for approval of the annexation with a companion
rezoning request, Commissioners Anthes and Oster voting no.

Property description: The subject property contains approximately 37.30 acres located west of
54'h Avenue, and adjoins an extension of west Persimmon as reflected on the City's Master Street
Plan. The property is adjacent to city limits to the east and the north. This configuration does not
create an island of unincorporated property within the City limits.
Request: The request is to annex the subject property into the City of Fayetteville.

Property that is developed and/or subdivided in the Planning Area of the City of Fayetteville, outside
of the city limits, does not allow for the enforcement of many regulations required within the City.
When property that is consistent with the General Plan 2020 and the City's guiding policy of
annexation is incorporated into the city and developed, a uniform and consistent standard of
development includes the following:
• Compatibility in land use and development standards
• Ability to plan future capital improvements
• Ability to require the same level of infrastructure improvements required for new
development within these areas as required within the City
• Less confusion for public safety — police and fire — who responds

• Sidewalks, based on the Master Street Plan

Without appropriate annexation, developers of property in the Planning Area are offered water
service from the City of Fayetteville, but have none of the other regulatory responsibilities for
development. Many of the public services offered to citizens of Fayetteville in adjacent properties are
not offered to those beyond the city limits. In some cases, new subdivisions adjacent to one another
have very different street construction, creating problems with transition and the establishment of an
efficient network of infrastructure. Property that develops directly adjacent to the city limits is
required to develop within City specifications for street construction. However, other requirements
such as parks, detention, grading and drainage, zoning/land use and tree preservation are not within
the City's ability to control.
Recommendation: Staff recommends approval of the annexation request. Future changes or
additional development on this site will be regulated by the city allowing for a more uniform and
consistent development pattern.

INFRASTRUCTURE:
Streets: Currently the site has access to Persimmon Street and 54'h Avenue at the northeast
comer of the property and County Road 649 along the east property line. At the
time of development, Persimmon Street will need to be constructed through the
development. County Road 649 will need to be brought up to current standards
along the property frontage. Off -site improvements to 54 h Avenue will be
considered at the time of the development of the property.
Surrounding Master Street Plan Streets:
North: Persimmon St. (planned collector)
South: Dot Tipton Road. (unimproved collector)
East: 54`h Avenue. (unimproved collector)
West: Double Springs Road (minor arterial)
Water: The property has access to an 8" water main along Persimmon Street and 54 h
Avenue. An extension of the water main will be required to provide water supply
and fire protection within any development on this property.
Sewer: The site currently does not have access to sanitary sewer. An off -site sewer main
extension will be required to serve this development. Approval of additional units
added to the sewer system in this area will be dependant upon the remaining
capacity in the Owl Creek lift station.
Fire: The subject property is located 1.97 miles from future Fire Station #7 on Rupple
Road. Normal driving time is 4 -6.5 minutes. Water supply will be necessary for
this property to develop.
Police: It is the opinion of the Fayetteville Police Department that this annexation and
rezoning will not substantially alter the population density and thereby
undesirably increase the load on police services or create and appreciable increase
in traffic danger and congestion in the area.
LAND USE PLAN: General Plan 2020 designates this site as Residential.

BOUNDARIES
11.6.a Annex existing islands and peninsulas and do not annex areas that would create an
island or peninsula.
Finding: The requested annexation will not create an island of unincorporated property.
11.6.b Proposed annexation area must be adjacent, or contiguous, to city limits.
Finding: The proposed annexation area is adjacent to the city limits along its east and
northern property line.
11.6.c Areas should either include or exclude entire subdivisions or neighborhoods, not
divide..
Finding: This area does not consist of defined subdivisions or neighborhoods. It is
predominantly a vacant field. However, future development plans may include
the extension of a subdivision to the west.
11.6.d Boundaries for annexed areas should follow natural corridors.
Finding: Proposed boundaries follow property lines.
11.6.e Timing of services within annexation areas should be considered.
Finding: Current conditions result in a response time of 4 to 6.5 minutes for fire
protection from future Fire Station #7. The property has access to an S"
water main to the east along 54`n Avenue.
ENVIRONMENTALLY SENSITIVE AREAS
11.6. f Annex environmentally sensitive areas that could be impacted by development and
utilize appropriate development regulations to protect those areas.
Finding: Wetlands, floodplain, and steep slopes have not been identified on this property.
EMERGENCY AND PUBLIC SERVICES
11.6.g Public services must be able to be provided efficiently in newly annexed areas.

11.6.h Annexed areas should receive the same level of service of areas already in the city
limits.
Finding: Fire and police service shall be provided to this area with the same level of
response and service as other developments in this area. Sewer and water
improvements to the area will be provided for with the development of
approved preliminary plats.
11.6.i The ability to provide public services should be evaluated in terms of equipment,
training of personnel, number of units and response time.
Finding: These factors were taken into consideration in the responses and
recommendations included in this report.
INFRASTRUCTURE AND UTILITIES
11.6.j Areas currently served by utilities and other public services should be annexed.
Finding: Water, fire and police protection are currently provided in this area.

This is in response to the second notice I have gotten as an adjoining property owner regarding actions
before the Planning Commission. The first was 30 acres to my west, now 37 acres to my north, all to be
rezoned for 4 units per acre.
Please, please, urge the planners and the commission to drive to these sites over any of the roads that
will get you here. The city streets and county roads are barely two lane ... in places not even that ... and you
are considering allowing the erection of some 268 residences, with an average of probably 3 or more cars
each? Annex the land, but please do not rezone for that density unless you have surplus funds in reserve
to upgrade the roads that will be handling all those cars. We already have terrible congestion on HWY
16W, accidents on an all too regular basis, and all the other ills that come with growth that outstrips the
infrastructure and resources of the area.
Please, you are the only.protection we have ... and the last best hope for prairie wildlife that has been here
since Peter Van Winkle came to this spot of ground in the 1840s. If you don't care about the native
critters, please care about the two -legged road kill this will bring.

request is to annex the subject property into the City of Fayetteville.
RZN 04-1091: Rezoning (HAYS FAMILY DEVELOPMENT, LLLP, 475):
Submitted by JAMES MCCORD for property located at WEST OF 54th AVE
ADJOINING EXTENSION OF W. PERSIMMON ST. (AS REFLECTED ON
M.S.P.) The property is zoned R-A, Residential Agricultural, and contains
approximately 49.40 acres. The request is to rezone the subject property to RSF-4,
Residential Single-family, 4 units per acre.
Ostner: The next item on our agenda is ANX 04-1090 for Hays.
Pate: This item and the following accompanying item for RZN 04-1091 for
Hays are associated items. This property is located west of 541h Avenue
adjoining the extension of West Persimmon Street as reflected on the
Master Street Plan. The property is currently, of course, in the planning
area and contains approximately 37.30 acres for annexation request. The
applicant is requesting to annex the subject property into the City of
Fayetteville. The property is adjacent to city limits to the east and the
north. This configuration, as requested, does not create an island of
unincorporated properties into the city limits. Currently the site has access
to Persimmon Street and 541h Avenue at the northeast corner of the
property, County Road 649 along the east property line. At the time of
development Persimmon Street will need to be constructed through the
development and additionally, staff will be evaluating offsite
improvements to 541h Avenue at the time of development. Staff is
recommending approval of the annexation request. The accompanying
item, which is a rezoning request, if you would please refer to your revised
staff report that was passed out this evening. Unfortunately, an erroneous
staff report was passed out with your original packets with some different
numbers on there. Hopefully the new packet has revised all of that. This
request is to rezone the approximately 37.30 acres along with other
property that this property owner, the Hays owner, along with other
property owners are requesting to annex into the City of Fayetteville for a
total of 49.40 acres. The additional 12.10 acres is directly to the north of
this property. When property is annexed into the city it is zoned as R-A,
Residential Agricultural. The applicant is requesting that the entire 49.40
acres be rezoned to RSF-4. The proposed rezoning to RSF-4 would allow
for a maximum dwelling unit number of 197 dwelling units in this area.
That is an increase in population density from what is allowed currently.
However, the public service providers do state in the attached staff report
that this will not increase appreciably an increased traffic danger in this
area with proposed improvements with the development proposal in the
Planning Commission • •

future. Staff is also recommending approval of the association RZN 04-
1091.
Ostner: Thank you. Is the applicant present? If you could introduce yourself and
tell us about your request.
McCord: My name is Jim McCord, I'm representing J.B. Hays who is present
tonight. The annexation is for a property that is adjacent to the property
approved earlier, the Sloan property approved for annexation and
rezoning, it is immediately to the west of the Tipton/Sloan property. The
annexation conforms with all of your annexation guideline policies with
the City of Fayetteville, which Planning staff found to be the case and
therefore, recommended approval. For those reasons the applicant
requests approval of the annexation. I will address the rezoning when it is
considered. At this time we respectfully request approval of the
annexation.
Ostner: Thank you Mr. McCord. At this time I will open it up to the public.
Would anyone like to speak to this annexation issue? Seeing none, I will
close it to the public and bring it back to the Commission.
Anthes: I just want to reference comments I made five hours ago for the
Tipton/Sloan property. I don't find for environmentally sensitive areas,
nor do I find that development pressure is great in this area and those other
comments that I said earlier.
Graves: I would do the same. There were a number of comments that I made
numerating the reasons that I believed this fit the guiding policies under
the city's annexation policy with regard to the Tipton/Sloan property.
Those would be equally applicable as far as I'm concerned with this
particular parcel.
MOTION:
Shackelford: I concur and will not repeat all of my conversation either that we have had
on several of these but I think the points and conversation that we had on
the Tipton/Sloan property applies to this property as well. Based on that, I
am going to make a motion that we recommend for approval ANX 04-
1090 to City Council.
Vaught: I will second.

Roll Call: Upon the completion of roll call the motion to recommend approval of
ANX 04-1090 to the City Council was approved by a vote of 7-2-0 with
Commissioners Anthes and Ostner voting no.
Ostner: The tandem item is RZN 04-1091 for Hays.
McCord: Regarding the rezoning, Jeremy referred to some errors in the number of
acres that 1 understand have been corrected. Just for the sake of clarity,
the total acreage being requested with this rezoning is 49.40 acres. That
includes 12.10 acres on the north side of Persimmon which is already in
the City of Fayetteville. Regarding the density, RSF-4 is requested. From
a practical standpoint by the time that the streets are put in and the utility
setbacks only about three or slightly under three units per acre can be
constructed. Also, there are two houses currently on the site and there are
3.47 acres that are the other four applicant's. There will be a little over 40
acres that can be developed and so the actual number of units that could be
built with the RSF-4 density is a little over 120. That would be the true
density. Again, city staff found that the requested rezoning is consistent
with the General Plan 2020 and it conforms to the growth in the area. For
those reasons, the applicant would respectfully request RSF zoning be
recommended at this time.
Ostner: Thank you Mr. McCord. I will open it up to the public again for RZN 04-
1091. Seeing none, I will close it to the public and bring it back to the
Commission.
MOTION:
Vaught: I would say in general I agree with this. One thing I will say is that at the
time of development this is a larger project to impact 541h as well as the
possibility of Tipton/Sloan and there are going to be some offsite
improvements that are definitely warranted, or will be provided by this
project and the density I think will help support those. It is in line with the
areas around it. I will make a motion to approve RZN 04-1091 and
recommend approval by the City Council.
Trumbo: Second.
Ostner: I am going to vote against this because I believe it is too far out and I
believe zoning is an issue of how much and when. I believe that there is a
lot of land closer to town that we've recently annexed tonight that satisfies
our demand.
Vaught: I do have one question for
staff. I guess this is at

made. Do we have some kind of coordination? If these developments
come through in time before those improvements are made do we have
some coordination process for the two developers? On 541h we approved
some offsite improvements, how does that work, just for my knowledge?
Warrick: If the timing could be coordinated it would require that a Preliminary Plat,
which you approved earlier tonight be amended. It could happen if we
were able to determine that the timing was appropriate and that in fact, the
improvements would be duplicated or one would have to be destroyed to
install the other improvements. We certainly wouldn't want to see that
happen. We don't want to see developers throw money away. When we
are looking for infrastructure improvements we need to see those
improvements on the ground so that they are there to provide benefit to the
public. That is something that we certainly would look at. It really
depends on timing as to how we are able to coordinate the two projects.
Ostner: Is there further discussion?
Allen: I just want to ask Mr. McCord why if you are anticipating that you will not
be needing the RSF-4 and are going to be using RSF-3 then why would
you request that?
McCord: RSF-4 is

Applicants are requesting annexation of 37.30 acres located at the southwest
corner of the intersection of 54 Avenue. and Persimmon Street. The property lies south
of the westerly extension of Persimmon Street reflected on the Fayetteville Master Street
Plan. (See attached vicinity map.)
Facts supporting annexation are:
(1) City Planning Staff recommends approval of the annexation;
(2) The Fayetteville Planning Commission recommends approval
of the annexation;
(3) The annexation is consistent with the City's Annexation Guiding
Policies -
(a) Annexation will not create an island or peninsula of
unincorporated property;
(b) The property is contiguous to the city limits;
(c) The area will not divide a subdivision or neighborhood;
(d) The proposed boundaries follow property lines;
(e) Public services can be provided efficiently to the area-
(i) Future Fire Station will be located 1.97 miles from the
property and can provide emergency services to the
property in approximately 4-6.5 minutes;
(ii) The Fayetteville Police Department is of the opinion that
the annexation will not undesirably increase the load on
police services or create an appreciable increase in traffic
danger and congestion in the area.
(f) The area is currently served by utilities-
(i) An 8" water line is available to the property from 5e Ave.;
(ii) A 6" sewer line runs along 54m Ave. north of the property
and can be extended by the developer when development
occurs. (The recent city-wide wastewater capacity study
does not conclude that development in this area should be
be put on hold. When development of this property is
proposed, the capacity of the Own Creek lift station will
be examined.)
(g) The property is a larger annexation with reasonable
boundaries avoiding the creation of islands or peninsulas.
Applicants request rezoning from R-A to Rsf-4 for the 37.30 acres proposed for
annexation plus an adjoining 12.10 acres to the north which is already within the city
limits and is owned by Hays Family Development, LL.LP. (See attached vicinity map.) Of
the total 49.4 acres, the property owned by Hays entities (45.93 acres) is proposed for
development. A single family residential subdivision compatible with the area is
proposed. Rsf-4 zoning allows 4 single family dwellings per acre, but the actual density
for the 45.93 acres can only be approximately 2.8 units per acre, because of the land area
required for streets and utilities (45.93 acres x 2.8 units per acre = 128 total units. Two
existing houses are on the property.)
Facts supporting Rsf-4 zoning are:
(1) City Planning Staff recommends approval of the rezoning;
(2) The Fayetteville Planning Commission recommends approval of
the rezoning;
(3) The City Land Use Plan (General Plan 2020) designates this area for
residential use. Rsf-4 zoning is compatible with this designation;
