AR Bette Stemos Circuit Clerk ORDINANCE NO. 4588 Flle2004-00032431 AN ORDINANCE TO ANNEX INTO THE CITY OF FAYETTEVILLE, ARKANSAS SEVERAL PARCELS COMPLETELY SURROUNDED BY THE INCORPORATED LIMITS OF FAYETTEVILLE WHEREAS, the annexation policy of the City of Fayetteville adopted by the City Council is to annex those parcels of land which have become completely surrounded by the incorporated limits of Fayetteville; and WHEREAS, after annexation into the City of Fayetteville, the inhabitants of those lands will be afforded the same services of police and fire protection and solid waste collection as current citizens of Fayetteville enjoy; and WHEREAS, all of the lands identified in Exhibit A (map) and Exhibit B (legal descriptions) comply with at least one of the five requirements for annexation stated in A.C.A. § 14-40-302; and WHEREAS, at the time of the adoption of this ordinance, the highest and best use of these lands is NOT for agricultural or horticultural purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby annexes into the City of Fayetteville, Arkansas the lands identified in Exhibit A (map) and Exhibit B (legal description). Section 2: That the City Council of the City of Fayetteville, Arkansas hereby assigns the zoning of these lands to be RSF-1, Residential Single Family, one unit per acre except for parcels identified as numbers 001-11380-001 and 001-11399-000 which are assigned the zoning of RA, Residential Agricultural. Section 3: That the City Council of the City of Fayetteville, Arkansas hereby assigns the parcels identified as numbers 001-10695-000; 001-10677-002, 001-11176-000, 001-11176-002, 001-11177-000; 001-10757-001,(also: 765-13158-001), 001-10763-000, 001-10764-000, 765- 13156-000, and 001-10800-000 to Ward 1. BACKGROUND On June 1, 2004, the City Council approved three resolutions (Resolutions 87-04, 88-04, and 89-04) to propose ordinances calling for the annexation of parcels of land completely surrounded by the incorporated limits of the City of Fayetteville. A notice of Public Hearing was sent to all property owners by Certified Mail with return receipts on June 9, 2004 regarding a public hearing to be held on Tuesday, June 29, 2004 at 6:00 p.m. in room 219 and the City Council meeting on Tueday, July 6, 2004. The City of Fayetteville adopted an annexation policy in 2001 that recommends annexation of completely surrounded unincorporated areas or "islands" as part of the City's long range plan — General Plan 2020. There are currently 70 identified parcels and 55 addressed structures within the proposed annexation areas. Over half of the area to be annexed is owned by the University of Arkansas. The City held an informational meeting on May 20, 2004 for the property owners in the annexation areas.
