AN ORDINANCE TO ENACT A NEW SECTION OF THE
FAYETTEVILLE CODE, §33.112 SEWER COMMITTEE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby
enacts a new section of the Fayetteville Code, §33.112 Sewer Committee as shown
below:
"SEWER COMMITTEE
"§33.112 Sewer Committee.
"(A) There is hereby established a Sewer Committee pursuant to state law. The
Sewer Committee shall be composed of four aldermen who serve at the pleasure of the
entire City Council. The mayor may appoint, subject to City Council approval, all
members, (including replacement members) of the Sewer Committee.
(B) The Sewer Committee shall have all powers, duties and responsibilities
provided to such committee in A.C.A. § 14-235-207, et. seq. All actions and
recommendations of the Sewer Committee must be ratified and approved by the City
Council to become effective. The City Council expresses its intent to exercise its control
of the Sewer Committee to the maximum extent possible pursuant to state law.
(C) The Sewer Committee is also designated advisory authority over the clean
water system of the city."

RE : Ordinance for Sewer Committee
State statutes require a city to have either a "sewer committee",
"sanitary board", or water and sewer commission (like Springdale has).
Although we have had a water and sewer committee for at least a dozen
years, it should be named officially "sewer committee" according to A.C.A.
§ 14-235-206 (a)(3). (copy attached) The sewer committee can be granted
great authority by the City Council pursuant to A.C.A. § 14-235 -207. (copy
attached) However, the City Council can retain control of this committee
as it does with all other aldermen committees (street, equipment,
nominating, ordinance review) if it passes the proper ordinance.
"The committee will function under the control of
the council to such extent as may be provided in
the ordinance or resolution appointing the committee."
A.C .A. § 14-235-206(a)( 1 )(B). (emphasis added)
Since I could not find an existing ordinance establishing the City
Council ' s ultimate authority over the Sewer Committee, I believed it would
be prudent to draft one for your consideration. This new section of the
Fayetteville Code only clarifies and does not change the procedures and
function exerted by the Water and Sewer Committee since 1992.
ORDINANCE NO.
AN ORDINANCE TO REPEAL §33.226 AND §33.227
HISTORIC DISTRICT COMMISSION AND ENACT A
REPLACEMENT §33.226 SEWER COMMITTEE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 : That the City Council of the City of Fayetteville, Arkansas hereby
repeals §33 .226 and §33 .227 dealing with the Historic District Commission which has
long been inactive and enacts a replacement §33.226 Sewer Committee as shown
below:
"SEWER COMMITTEE
"§33.226 Sewer Committee.
"(A) There is hereby established a Sewer Committee pursuant to state law. The
Sewer Committee shall be composed of four aldermen who serve at the pleasure of the
entire City Council. The mayor may appoint, subject to City Council approval, all
members, (including replacement members) of the Sewer Committee.
(B) The Sewer Committee shall have all powers, duties and responsibilities
provided to such committee in A.C.A. § 14-235-207, et. seq. All actions and
recommendations of the Sewer Committee must be ratified and approved by the City
