Home My WebLink AboutOrdinance 4513 ORDINANCE NO, 4513 AN ORDINANCE TO PROHIBIT THE SALE, DISTRIBUTION, OR GIVING AWAY OF ANIMALS FROM PUBLIC PROPERTY AND FROM PRIVATE COMMERCIALLY OR INDUSTRIALLY ZONED PROPERTY (EXCEPT FROM ESTABLISHED ANIMAL BUSINESS ENTERPRISES WITH PERMANENT STRUCTURES) BY ENACTING A NEW § 92.29 OF THE FAYETTEVILLE CODE WHEREAS, the sale, distribution and giving away of dogs and cats from public property and from parking lots of commercial establishments endangers the animals and may result in animals being unsuitably adopted without proper vaccinations and veterinarian care; and WHEREAS, it has become a burden on certain commercial establishments to prevent a portion of their parking lots from being misappropriated by itinerant pet sellers on numerous occasions; and WHEREAS, established pet stores, the Washington County Livestock Auction and the animal shelter provide much more appropriate and safe venues for the sale or distribution of dogs, cats, and other animals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby enacts a new §92.29 Prohibition of sale of animals from certain locations to become part of the Fayetteville Code as shown below: "§92.29 Prohibition of sale of animals from certain locations.
