BACKGROUND:
Properly description: The subject property is located north of Wedington Drive along the west
side of 51 't Street. There is currently one single family home with accessory structures located
on the 3 .01 acre tract. Surrounding properties contain single family homes with a church located
east of the site across 5l " Street. Two new subdivisions are currently being constructed further
north and east of the property which will contain single family residences and are zoned RSP-4.
In recent actions, the Planning Commission has approved a rezoning request for the property
immediately north of this tract in order for that piece to be split for one additional single family
home.
Prnpos•ul: The applicant proposed to divide the subject property to provide one additional single
family lot.
Request: The request is to rezone from RA to RSF-4 in order to allow for the creation of one
additional residential lot.
CURRENT STATUS:
On June 28, the Planning Commission voted 7-0-0 to forward this item to the City Council with
a recommendation for approval .
RECOMMENDATION:
Staff recommends approval of the requested rezoning.

Warrick . This property is located north of Wedington Drive along the west side of

Street. Two new subdivisions are currently being constructed further
north and east of the property which will contain single- family residences
and are zoned RSF-4. In recent actions the Planning Commission has
approved a rezoning request for the property immediately north of this
tract in order for that piece to be split for one additional single- family
home. The applicant proposes to divide the subject property to provide
one additional single-family lot and the request in order to do that is to
rezone the subject property from R-A. Residential .Agricultural to RSF-4,
Residential Single- family four units per acre. The applicant would
propose if this rezoning is successful to bring forward a lot split request in
order to create the second tract. Access to the property is available from
Wedington Drive to the south as well as 51 " Street, which lies around the
eastern boundary. Wedington Drive is classified a principal arterial on the
Master Street Plan. 51 " Street is a local street. 51 " Street north of the
subject property is on the city limits and has been improved adjacent to the
new subdivision, Sage Meadows, which is under construction. Further
north 51 " Street adjoins an additional subdivision, Fairfield, also under
construction and then 51 " Street becomes Sunshine Road. Water and
sewer are both available to this site with a 6" waterline along 51 " Street
and a 15 " sewer main located also along 51 " Street. The General Plan
Future Land Use Map designates this site as residential . Therefore, the
zoning request to single-family residential is consistent with that plan.
With regard to findings: The first finding is consistency with the plan and
I ' ve mentioned that. Second. with regard to whether it is justified or
needed: The consistency with the adopted land use plan and policies does
justify this rezoning request. Also, the ability to further develop the
property a different zoning designation is required in order to do that. The
R-A, Agricultural zoning district would only permit one single-family
home to be located on this property. It contains three acres and the
minimum lot size for a single-family home in this zoning district is two
acres. Determination as to whether the zoning would create or appreciably
increase traffic danger and congestion: ]'he finding is that the proposed
zoning will only allow the development of one additional single-family

home on the property. The addition of approximately ten vehicle trips per
day will not substantially impact the existing street infrastructure. Also,
the final finding with regard to whether the proposed zoning would alter
population density in a manner to undesirably increase the load on public
services: The proposed zoning will not alter population density in any real
way. We are talking about one additional single-family dwelling which
could be developed without the creation of a subdivision and Planning
Commission review. Anything further than the single- family dwelling
would require additional reviews and infrastructure or offsite
improvements potentially if we were looking at something more than just
a lot split to create one additional lot. With that, staff is recommending in
favor of the request and 1 will be happy to answer any questions.

McDougall : I am Doug McDougall. I ' m the applicant and I just wanted to mention,
there was an issue that 1 discussed with Renee earlier the possibility that
an adjacent land owner may want some of the property in the back for
which I would have no use after I completed my project so i might
possibly request a property line adjustment and I don ' t know if I need to
say that now but [ just don' t want to be denied that in the future because it
wasn't mentioned on the front end.

back to the Commissioners.
Bunch: Seeing that this project is the same tenor as other projects in the immediate

along the east boundary. Wedington Drive is classified as a principal arterial on the Master
Street Plan and 51 " Street as a local street. 51 " Street north of the subject property is on the city
limits line and has been improved adjacent to the new subdivision. Sage Meadows, which is
under construction currently. Further north, 51 " adjoins an additional subdivision (Fairfield)
under construction and becomes Sunshine Road.
Water and sewer are both available to this site with a 6" water line along 51 " Street and a 15"
sewer main also along 51 " Street.
LAND USE PLAN: General Plan 2020 designates this site Residential . Rezoning this property
to RSP-4. Residential single family. 4 units/acre, is consistent with the land use plan and
compatible with surrounding land uses in the area.
FINDINGS OF THE STAFF
I . A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The proposed zoning is consistent with land use planning objectives and with
the City's adopted Future Land Use map and General Plan 2020. The area is

already developed with single family dwellings and this request is consistent
with recent rezoning and development approvals.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The proposed zoning is justified in that it is consistent with adopted land use
policies. In order to further develop this property, a different zoning
designation is necessary. In the RA zoning district, only one single family
home on a minimum of 2 acres can be permitted.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: The proposed zoning will only allow for the development of one additional
single family home on the property. The addition of approximately 10
vehicle trips per day will not impact the existing street infrastructure.
Engineering — This rezoning would not affect the existing transportation system.
Police - It is the opinion of the Fayetteville Police Department that this rezoning will ,.
not substantially increase traffic congestion in the area.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning will not alter population density in any real way. One
additional single family dwelling is the most that could be developed without
the creation of a subdivision and planning commission review which would
include consideration of on and off -site improvements.
Engineering - The property currently has access to a 6" water line along 51"Avenue.
This line should be sufficient to provide water service to the existing facility as well as
redevelopment of the site.

Police - It is the opinion of the Fayetteville Police Department that this rezoning will
not substantially alter the population density and thereby undesirably increase the load
on police services.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would he impractical to use the land for any of the uses permitted
under its existing zoning classifications;
h. There are extenuating circumstances which justify the rezoning

Checklist Item 5
A. The current owner of this 3.02 acre parcel is the applicant, Douglas
McDougall, who plans to request a lot split for a second house as soon as the
rezoning is approved. (Survey for the proposed lot split is attached.)
1.3. This rezoning is necessary because the current Al zoning precludes the
subdivision of a 3 acre parcel (i.e. minimum 2 acre lot size requirement).
C. Of the seven adjacent properties, five are 1.52 acre or smaller and four already
contain single family dwellings. The property across the street to the east is a
church, and the property to the west is a 9.44 acre pasture which I would
expect to be developed in the foreseeable fixture. Therefore, building a second
home on this 3.02 acre parcel is very much in line with current land use in this
neighborhood. North 51" Avenue is just 300 feet off Highway 16W
(Wedington Dr.). The addition of one single family dwelling that close to a
major road should have no adverse affect on traffic.

Checklist Item 6
A. The area immediately to the east of this parcel has already been rezoned and
mostly developed with single family housing and some duplexes. It is my
understanding that the land just to the north is slated for annexing and will he
zoned R- I.
B. This rezoning request is justified because the proposed improvement is very much
in keeping with current land use. It is desirable because 3 acres is just too much to
mow! (The previous owner allowed the back 1-'/a acres to grow up for hay.) It is
necessary because 3.02 acres cannot be divided in Al zoned areas.
C. One additional home located this close to Highway 16 W, part of which has been
widened already, should have no affect on traffic. North 51'" Avenue (Washington
County 877) is being improved at this time because of a subdivision that is
currently underway just to the north of this property.
D. This is a prime area for residential development for which there is a tremendous
demand. I feel certain that planning is underway to respond to the growing need
for city services on the west side. As for population density, two homes on 3.02
acres is still very low.
Ii. Agricultural activities are becoming less and less desirable in this area which is
about 2 minutes from the 1-540 by-pass. The "open" portion of this property has
residences on three sides, so livestock would be unwelcome in this area.
Residential use is the obvious choice.
