AN ORDINANCE APPROVING VAC 03-3.00 TO VACATE
AND ABANDON A PORTION OF THE MOST EASTERLY
8' OF A 20' UTILITY EASEMENT LOCATED AT 3305 N.
SOUTH RIDGE DRIVE AS DESCRIBED ON THE
ATTACHED MAP AND LEGAL DESCRIPTION
WHEREAS, the City Council of the City of Fayetteville has the authority
under A.C.A. § 14-54-104 to vacate public grounds or portions thereof which are
not required for corporate purposes, and;
WHEREAS, the City Council of the City of Fayetteville has determined
that the following described utility easement is not required for corporate
purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the City Council of the City of Fayetteville, Arkansas
hereby vacated and abandons all of its right, together with the rights of the
public generally, in and to the following described utility easement:
See Exhibit "A" attached hereto and made a part hereof.
Section 2. That a copy of this Ordinance duly certified by the City
Clerk, along with the map attached hereto and labeled Exhibit "B" shall be filed
in the office of the Recorder of the County and recorded in the Deed Records of
the County.
PASSED and APPROVED this the 151 day of April, 2003.

VAC 03-3.00: Vacation (Mee), pp 214) was submitted by Seaside Pools, Inc. on behalf of David
and Sue Ellen Mee for property located at 3305 South Ridge Drive (lot 2 Hemingway Ridge
Subdivision). The property is zoned R- 1 , Low Density Residential. The request is to vacate an 8 '
wide portion of an existing 20' utility easement.
Background: No objections from the adjacent property owners have been submitted to the
City. Utility companies had no objections but AEP/SWEPCO did request a
condition to release 8 ' only in the area of the pool. They retain the existing
20' easement on both sides of the concrete decking of said pool.
Current Status: On March 10, 2003, the Planning Commission voted 9-0-0 to forward the
Vacation to the City Council with a recommendation for approval.
Recommendation: Approval of the proposed easement vacation 03-3 .00 subject to the condition
of approval listed below.
Conditions of Approval:
I . The easement shall be vacated for the 8' only in the area that the pool is located.
