HomeMy WebLinkAboutOrdinance 4439 ORDINANCE NO 4439 AN ORDINANCE TO REPEAL §31 .30 (E) (1) OF THE CODE OF FAYETTEVILLE AND REPLACE IT WITH A NEW §31 .30 (E) (1) WHEREAS, the Fayetteville City Clerk position's salary in our current Pay Plan is 39.8% below the Average Market according to the last Hay Plan findings; and WHEREAS, the Fayetteville City Clerk as an elected office holder has many substantial and important duties including elections, bond issuances, and records maintenance, pension board responsibilities, City Council meeting minutes and vote records; and WHEREAS, the City Council should set a base level salary for the elected City Clerk as it did last year for City Attorney. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That the City Council of the City of Fayetteville, Arkansas hereby repeals §31 .30 (E) (1) of the Code of Fayetteville and replaces it with a new §31 .30 (E) (1) as stated below: " §31 .30 (E) (1) Salary for a newly elected or appointed City Clerk shall be $45,000.00. (The annual salary for a currently serving City Clerk shall be at least $45,000.00 annually as a beginning salary level.)" PASSED and APPROVED this the 1901 day of November, 2002. The Clerk is the chief election officer ensuring that multimillion dollar elections ($125 million dollar sewer bond election, 12 million dollar annual sales tax election, etc.) are conducted properly with all legally necessary notifications and publications properly completed. Lack of competence by our City Clerk could invalidate or call into question these million dollar decisions. Our Fayetteville City Clerk serves as a member of both Fire Pension Board and Police Pension Board which both oversee investments and pension responsibilities in excess of ten million dollars. The Clerk is also the statutorily appointed secretary for these boards and regularly prepares the pension lists for all the retired police and firefighters and/ or their survivors. As you know the City Clerk keeps accurate minutes of all your meetings as well as original copies of all ordinances and resolutions you pass. She witnesses the Mayor's signature on all ordinances, resolutions and contracts. The bottom line is that her responsibilities justify a base line salary of at least $45,000.00.
