HomeMy WebLinkAboutOrdinance 4437 ORDINANCE NO. 4437 AN ORDINANCE WAIVING THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING FOR THE PURCHASE OF LED TRAFFIC SIGNAL LENSES FROM TEMPLE, INC. AND DECLARING AN EMERGENCY. WHEREAS, the City of Fayetteville in July 2002, began the replacement of existing conventional traffic signal lenses with high-efficiency LED lenses, which has already saved thousands of dollars in energy costs; and, WHEREAS, the Arkansas Highway and Transportation Department has now given the City permission to replace additional traffic signal lenses; and, WHEREAS, the new signals are needed as quickly as possible to ensure adequate traffic safety in the City; and, WHEREAS, Temple, Inc. has agreed to allow the City to purchase additional lenses at the substantially discounted price of its July 2002 contract; and, WHEREAS, the City Council finds that such circumstances constitute an exceptional situation where competitive bidding is not feasible or practical. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 . That the City Council of the City of Fayetteville, Arkansas, hereby waives the requirements of formal competitive bidding for the purchase of LED traffic signal lenses from Temple, Inc. Section 2. Emergency Clause. That the City Council of the City of Fayetteville, Arkansas, having found that the installation of new traffic signals is essential to provide adequate traffic safety to the citizens of Fayetteville without undue delay, hereby declares this ordinance to be necessary to preserve the public safety, and because of such, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from the date of its passage and approval.
