Section 1 . That the zone classification of the following described property is hereby
changed as follows from R- 1 , Low Density Residential to RS, Residential
Small Lot as shown in Exhibit A attached hereto and made a part hereof.
Section 2. That the official zoning map of the City of Fayetteville, Arkansas, is hereby
amended to reflect the zoning change provided in Section 1 above.

The property is zoned R- 1 , Low Density Residential and contains approximately 0.35 acres. The
request is to rezone to R-S, Residential Small Lot.
BACKGROUND:
Property Description: The subject property is located on the northwest corner of Jerry Avenue
and Helen Street. It is a vacant .35 acre lot. The neighborhood is characterized by one and two
family structures. The average lot size in the neighborhood is approximately .30 acres.
Proposal: The applicant proposes to split the lot into two separate lots and build single family
structures on each lot. The current zoning of R- 1 Low Density Residential requires a minimum
lot area of 8,000 square feet, requiring a minimum of 16,000 square feet for two lots. The
property has only 15,246 square feet and cannot be split under this zoning district.
Request: The applicant is requesting to rezone the property from R- 1 Low Density Residential to
RS Residential Small Lot. The RS district has a minimum lot size of 6,000 square feet. The
applicant would be able to meet the requirements for a lot split with the proposed zoning.
Findings: The land use remains single family which is compatible with surrounding land use and
consistent with the General Plan which designates this area as residential. The lot size is slightly
smaller than existing residential lots in the neighborhood, however, several of those lots contain
duplexes. Therefore, the proposed density is consistent with the adjacent properties.
CURRENT STATUS:
On Oct. 28, 2002, the Planning Commission voted 8-0-0 to forward the request to the City
Council for approval.
RECOMMENDATION:
Approval of the requested rezoning.

Finding: The proposed zoning is consistent with the Future Land Use Plan. Single-family
residential is consistent with the surrounding land use.

Finding: The proposed zoning is needed in order for the applicant to split the lot and
construct two single family structures.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.

From Public Works: The proposed rezoning is located on the northwest corner
of Jerry Ave, and Helen St. south of Huntsville Rd. The proposed rezoning
from R-1 to R -S may or may not result in additional traffic danger and
congestion for this area. The proposed zoning allows a density of up to 7
dwellings per acre. That means this lot could have up to 2 dwellings on this .25
acre tract.
From Police: The Police Department states that the rezoning may increase
traffic from what it is at present; the rezoning will not impact police functions to
the degree that they could not be performed adequately; therefore, the Police
Department does not oppose this rezoning request.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and sewer
facilities.
Finding: From Planning: The proposed zoning will not significantly increase population
density. The RS zoning will permit two families on this property.
From Public Works: The site has access to an existing 6" water line on the south
side and east side of the property. A 6" sewer main is also located along Jerry
Ave. and Helen Street. The proposed rezoning and ultimate development is not
likely to increase the load on the water and sewer facilities.

RZN 02-35.00 (1017): Rezoning (Habitat, Jerry Street, pp 566) was submitted by Patsy
Brewer on behalf of Habitat for Humanity for property located at 1075 & 1093 S. Jerry
Avenue. The property is zoned R-1, Low Density Residential and contains approximately 0.35
acres. The request is to rezone to R -S, Residential Small Lot.
Aviles: Item seven on our agenda is another rezoning, which is RZN 02-35.00. It was
submitted by Patsy Brewer on behalf of Habitat for Humanity for property
located at 1075 & 1093 S. Jerry Avenue. The property is zoned R-1, Low
Density Residential and contains approximately 0.35 acres. The request is to
rezone to R -S, Residential Small Lot.Shelli?
Rushing: This property is located on the northwest corner of Jerry Avenue and Helen
Street. It is south of Huntsville Road. Currently it is vacant. The neighborhood
is characterized by one and two family structures. The average lot size in the
neighborhood is approximately .30 acres. The applicant is proposing to split the
lot and build two single-family structures. Under the current zoning district of
R-1 the minimum lot area is 8,000 sq.ft. and the current lot area is 15,246 sq.ft.
Therefore, they would not be able to split the lot under the current zoning
district. They are requesting to rezone the property from R-1, Low Density
Residential to RS, Residential Small Lot. The RS district allows a minimum lot
size of 6,000 sq.ft., which would permit them to split the lot and build the two
single-family structures. The land use plan, General Plan 2020 does designate
this site as residential. It is consistent with the Future Land Use Plan. We don't
find that this rezoning would increase traffic or significantly increase the
population. Therefore, we are recommending approval of the requested
rezoning. We find that the land use does remain single-family. Although the to
size will be smaller than what is in the area, the density is still the same as what
is in the area. The property to the north and south and southwest are duplexes
on .30 acre lots so the density would remain the same.
Aviles: Thank you Shelli. Is there any member of the public that would wish to address
us on this?
Orion: I am Marion Orton, 1641 Halsell. Patsy Brewer is out of town so she has asked
me to come and represent Habitat. I am on the Site Search Committee. It is
difficult to find not only property that is level and that we can afford so that the
price of the houses are not run up because of the expensive lots. Habitat builds
small houses. This is like 1,100 square feet. Because of the small houses, we
feel that this would not detract at all from the neighborhood and we would
appreciate your approving it so that two more families may have houses that
they can afford.
Aviles: Thank you very much. Is there anybody else that would wish to address us on
this rezoning? I will bring it back to the Commission and to the applicant for
further discussion.

Shackelford: Obviously Habitat For Humanity is a very noble cause. Based on the fact that
staff is recommending this and that the land will remain single-family and it is
compatible with the surrounding land uses. I will make a motion that we
approve RZN 02-35.00.
